Here is the minutes provided by the Commission:

HRA Chairperson, Ashley Casati opened the meeting of the Chicago Regional Human Rights Authority (HRA) at 5:39 p.m. The meeting was held at Madden Mental Health Center, Hines, IL.

Members Present: Ashley Casati, Michael Shukis, Eric Mathiasen, and Donna Claffy.

Members Absent: Sheila Orr, Regina Pessagno, Nicole Erickson, Paul Porter, and Cindy Gerena.

Staff Present: Pat Betzen

Guests: None

Ashley noted that a quorum was not present. Meeting Minutes will be voted on at the next quorumed meeting. A vote for all other actions will be secured by email. Ashley read the Confidentiality Statement.

Communications: None

New Business

New Complaints:

#17-030-9013 The complaint alleges that a facility refused to honor the recipient’s 5-day request for discharge, that the recipient was not given the right to refuse scheduled medication, and that the recipient was administered forced emergency medication for no adequate reason. A release has been obtained. A motion was made to accept the complaint for investigation. The motion was properly seconded and passed.

#17-030-9014 The complaint alleges that a physician lied about a recipient in court, causing the recipient to be admitted involuntarily. A release has been obtained. A motion was made to not accept the complaint for investigation. The motion was properly seconded and passed.

#17-030-9015 The complaint alleges that a recipient was thrown to the floor and his neck grabbed by staff members when he refused to sign a voluntary application for admission and refused to remove his clothing. A release has been received. A motion was made to accept the complaint for investigation. The motion was properly seconded and passed.

Mike made a motion to enter into closed session at 5:40 p.m. pursuant to Section 21 of the Guardianship and Advocacy Act (20 ILCS 3955/21) and Section 120/2 (c) (4) of the Open Meetings Act (5 ILCS 120/2); the motion was seconded by Eric and carried. The purpose of the closed session was as follows: to discuss updates of open cases and case closures.

The HRA returned to open session at 6:15 p.m. having taken no action in closed session. A summary of the closed session includes a review of reports of findings as well as case closures.

Unfinished Business

Report of Findings:

#17-030-9006 St. Mary’s Hospital. The HRA reviewed the report for case #17-030-9006 St. Mary’s. A motion was made to accept the report without revision. The motion was properly seconded and passed.

Case Closures:

#15-030-9020 Hines VA. The HRA considered case closure for case #15-030-9020 Hines VA. A motion was made to close the case and make the report part of the public record. The motion was properly seconded and passed.

#17-030-9005 Madden. The HRA considered case closure for case #17-030-9005 Madden. A motion was made to close the case and make the report part of the public record. The motion was properly seconded and passed.

#17-030-9007 Mercy Hospital. The HRA considered case closure for case #17-030-9007 Mercy Hospital. The release that was obtained for this case was rightfully rejected by the provider and the complainant could not be found to sign another one. A motion was made to close the case. The motion was properly seconded and passed.

Case Status Reports:

#17-030-9008 Madden. Site visit has been scheduled for 1/26/17.

#17-030-9011 Hartgrove. The record has been received.

#17-030-9012 Sabin Magnet. The HRA has been contacted by the attorney representing the Board of Education of the City of Chicago and she does not feel the HRA has the authority to investigate a case. Meanwhile, the HRA has been informed by the complainant that measures have been taken by the school to address the issues brought to the HRA, however she is still planning on removing the child from the school. The HRA would like to look at the record and complete the investigation if the complainant does not rescind her release. The complainant will be contacted by the HRA for this information.

Announcements and Comments:

The next meeting of the HRA is tentatively scheduled for Tuesday, February 14, 2017 at Madden Mental Health Center.
