Public Testimony

Authorization as a public speaker shall only be granted to those individuals who have submitted in writing, their name, address, subject matter, and organization (if any) to the Secretary 24 hours in advance of the meeting. Duly authorized public speakers shall be called upon to deliver testimony at a time specified in the meeting agenda. Authorized public speakers who are not present during the specified time for public testimony will forfeit their allotted time to speak at the meeting. Public testimony must be germane to a specific item(s) on the meeting agenda, and the testimony must not exceed three minutes; the Secretary will keep track of the time and advise when the time for public testimony has expired. Persons authorized to provide public testimony shall not use vulgar, abusive, or otherwise inappropriate language when addressing the Board; failure to act appropriately; failure to speak to an item that is germane to the meeting, or failure to adhere to the time requirements may result in expulsion from the meeting and/or disqualify the person from providing future testimony.

Title 1 Chapter 8 Section 2: Contracts and Purchases

BE IT ORDAINED, by the Forest Preserve District of Cook County Board of Commissioners, that Title 1 - Administrative, Chapter 8 - District Finances, Section 2 - Contracts and Purchases of the Forest Preserve District of Cook County Code is hereby amended as Follows:

Sec. 1-8-2. Contracts and Purchases.

I. Powers and duties of Purchasing Agent: The District Purchasing Agent shall, pursuant to the terms, exceptions, or restrictions established by this Code and the President and Board of Commissioners:

1. Purchase or contract for all supplies, materials and equipment, and contractual services required by any Office, department, institution or agency of the District subject to the provisions, restrictions and limitations of this Subsection;

2. Establish and enforce standard and non-standard specifications established in accordance with this Subsection which shall apply to all supplies, materials and equipment purchased for the use of any Office, department, institution or agency of the District;

3. Transfer to or between, and/or assign to the various offices, departments, institutions or agencies of the District and the Forest Preserves Foundation (as an approved Donee), or otherwise trade in and/or sell supplies, materials and equipment that are surplus, obsolete, abandoned, or unusable, except for such property which has been approved for donation as a charitable contribution per Section 1-8-2(O) below;

4. Have charge of such other purchasing activities as the Board of Commissioners may assign from time to time;

5. Distribute or cause to be distributed to the various Offices, departments, institutions or agencies of the District all supplies, materials and equipment purchased by the Office of the Purchasing Agent;

6. Require all vendors to submit a notarized certification or affidavit of their compliance with all requirements imposed by this Subsection on forms promulgated by the Purchasing Agent, which shall include, but shall not be limited to: an affirmation that the vendor is a registered business in good standing with the State of Illinois and, in the case of a contractor operating under an assumed name, with the County Clerk, and an affirmation with respect to Section 1-8- 2(U) of this Ordinance (Child Support), Section 1-8-2(D) of this Ordinance (Taxes and Fees) and that said vendor is in compliance with the District's Ethics Act including the provisions regarding receiving and soliciting gifts and favors as well as the limitations of contributions to candidates and elected officials and an economic disclosure statement disclosing all persons or entities who have made lobbying contacts on behalf of the vendor with respect to the contract.

Except as otherwise expressly provided by law, no supplies, materials or equipment or contractual services shall be purchased or contracted for by any Elected Official, department, institution or agency of the District, or by any officer or employee thereof, but all such supplies, materials, equipment or contractual services shall be purchased or contracted for by such Purchasing Agent in accordance with this Subsection.

*** 6. Distribution of assets:

a. Notwithstanding any other provisions of this section, the District Board reserves the right to designate certain unusable, surplus and/or obsolete personal property, equipment or other property The Purchasing Agent, in conjunction with the applicable District department(s), is authorized to approve or deny the distribution of supplies, materials and equipment that have been declared unusable, surplus, abandoned, and/or obsolete per Section 1-8-2(I) above (hereinafter referred to collectively as "assets" for distribution for purposes of this Subsection 6) as charitable donations. Assets may be designated for distribution as charitable donations as specifically authorized by State of Illinois statute(s), or if:

(1) A determination has been made that the assets are not needed by any department or division of the District;

(2) The assets are of a type that would provide a beneficial service in either the medical, or education fields to a another entity education, public safety, social services, environmental, and/or conservation fields; and

(3) The recipient of the assets is a legitimate nonprofit organization, or a local or foreign governmental entity.

b. The assets shall be transferred by an appropriate instrument of transfer, which shall include:

(1) A provision that requires the recipient to use the property in a manner that primarily promotes the implementation or improvement of educational services available to the public via the medical, education, public safety, social services, environmental, and/or conservation fields; and

(2) A provision that indicates that ownership of the assets automatically reverts to the District if the entity at any time fails to use the property in that manner.

The responsibility for determining the recipient of the donation, pursuant to the above guidelines shall reside in the Office of the President of the District Board, with approval by the District Board.

Proposed Partnership Agreement

Request: Requesting authorization for the Forest Preserve District of Cook County (the “Preserves”) to enter into a Partnership Agreement with CBS EcoMedia Inc., 919 Manhattan Avenue, Suite 100, Manhattan Beach, California, 90266.

Reason: The Preserves wishes to enter into a partnership agreement with CBS EcoMedia (“EcoMedia”) whereby the Preserves will be considered for future funding and sponsorship support for qualified projects on which the Preserves, EcoMedia, and a potential sponsor agree. If and when a qualified project is agreed to by the Preserves, EcoMedia and a potential sponsor, a separate support agreement for the project will be executed. Please note that it is anticipated that EcoMedia will provide the Preserves, under a separate agreement, with a one year $25,000 grant for a paddling program located in the Preserves’ central zone and focused in Maywood, Illinois.

Proposed Intergovernmental Agreement

Request: Authorization to enter into a Memorandum of Understanding (“MOU”) regarding a Stormwater Management Wetlands Project in the Skokie Lagoons Preserves, south of Willow Road.

Goods or Services: Winnetka would like to use approximately 18.6 acres of Preserves property to construct, operate, and maintain Stormwater Management Wetlands Project.

Summary: The proposed Stormwater Management Wetlands Project consists of an open-water feature, wetlands and sedge meadow. The project will provide an additional 74 acre-feet of stormwater storage on the Preserves land as part of a comprehensive stormwater plan that includes a variety of additional conveyance, storage, and green infrastructure facilities. Winnetka will provide water quality improvement measures upstream of discharge points onto the Preserves, and provide water quality monitoring.

Upon execution of the MOU, Winnetka will work on the following action items in relation to the project: (1) finalizing construction drawings, and (2) obtaining approval from other local units of government controlling open spaces to be incorporated for stormwater storage, conveyance, or water quality improvements, including the Winnetka Park District, Winnetka School District 36, and New Trier High School District. Upon satisfactory completion of the above-referenced items, the Preserves and Winnetka will work together amicably to finalize an Intergovernmental License Agreement, which will be presented to this governing body for further review and consideration.

Under such license, it is anticipated that the Land Use License Fee will be $1,405,925, consisting of a (i) License Fee component; (ii) Youth Education, Land Acquisition, Restoration (YELAR) Program Fee; (iii) Construction Permit Fee component; and (iv) License Application Fee. An additional contribution of $500,000 is anticipated for ecological land restoration in the sub-watershed. Tree removal mitigation fees, estimated at $1,103,533, will be based upon the Preserves’ tree mitigation requirements. Further, it is anticipated that Winnetka will pay an estimated $24,000 in costs associated with a Construction Inspector/Owner’s Representative. Construction is anticipated to start late 2018/early 2019 and be substantially complete by the end of 2019.

Summary:The proposed intergovernmental agreement (“IGA”) provides for the creation and implementation of the Preserves’ “Sustainability Master Plan” with ISTC’s assistance. In 2014/2015 ISTC, a unit of the Prairie Research Institute at the University of Illinois at Urbana-Champaign worked with Preserve staff to assess the current state of materials management operations and opportunities for improvement. Previous collaborations with ISTC resulted in the completion of the following: Recycling and Waste Reduction Opportunity Assessment, the Solid Waste Characterization and Zero Waste Implementation Assessment and the Waste Stream Characterization Study and recycling pilots. The document summarizes the goals and principles informing the expansion and restoration of the Preserves, as outlined in the Next Century Conservation Plan and Natural and Cultural Resources Master Plan. The Land Management Guidelines were created to provide confidence and transparency in the Preserves’ land management program, to both the Board of Commissioners and the general public.

Monday, 8/21; Noon - 2:45 pm Spectacular Solar Eclipse, Little Red Schoolhouse, Willow Springs Watch this rare natural phenomenon here. We will have telescopes ready for viewing during the entire partial eclipse of the sun. The sun will be at maximum eclipse at 1:19 pm with 87% coverage.

Monday, 8/21; 12:30 - 2:30 pm (Almost) Total Solar Eclipse, Trailside Museum of Natural History, River Forest Learn about and view our closest star, the sun, through a special filter on our telescope as we experience an (almost) total solar eclipse. The maximum coverage of our sun by the moon will be between 1 - 1:40 pm.

Saturday, 9/9 - Sunday, 9/10 CLIC Training, Camp Sullivan, Oak Forest The Camping Leadership Immersion Course (CLIC) Training is an overnight course that provides skills such as camping equipment use and care, outdoor activities, teamwork and nature-based education for leaders of school, community, Scouting or youth groups. After completing this training, you and your group of up to 30 are eligible to borrow tents, sleeping bags, sleeping pads and cookware for a one-night campout at Camp Sullivan. Sunday, 9/10; Anytime from Noon - 2 pm GPS Scavenger Hunt, River Trail Nature Center, Northbrook Stop in and learn about this technology inspired scavenger hunt. We’ll provide you with coordinates of some hidden treasures to find in the forest. Check out one of our GPS units or bring your own. Supplies are limited.

Makin’ Music Bluegrass Jam, Trailside Museum of Natural History, River Forest Make a simple musical instrument from an invasive plant species, then join the fun in a bluegrass jam circle!
