1915 Beach Road and 3706 N Lewis Avenue, Map amendment to rezone each property from B2, Community Shopping, to R4, General Residential

Applicant: Pivotal Development LLC

Property Owner: LPML, LLC

Request: Map amendment to rezone each property from B3, General Commercial to R4, General Residential

Zoning Calendar items #2823 and #2824 were for the same project, presented together, and voted on separately. The map amendment is being requested to rezone 1915 Beach Rd and 3706 Beach Road to commercial use to allow a new affordable housing development to be built for seniors. Tyler Williams, Planner, presented the proposal.

Commissioner Bill swore in Wyllys Mann, Sr. VP of Pivotal Housing, to discuss the project and its relation to the surrounding wetlands, and to answer questions.

Commissioner Bill swore in all audience members who spoke about the proposal. Mr. Mann was available to address questions and concerns from audience members and the commissioners.

Donna Washburn, neighbor, expressed concerns about water flowing into her yard, the building obstructing her backyard view, and increased traffic.

Lisa Creekmore, represented her mother who is a neighbor, expressed concerns about the location being ill-suited for seniors due to noise level from an apartment complex nearby and flooding issues. Also, concerned about the destruction of  the natural beauty.

Todd Creekmore, husband and son-in-law, expressed concerns about having adequate parking, the absence of turn lanes and increased congestion, and requested a fence to surround their parking lot.

Lynn Florian, 8th Ward Alderman, commented that this was the first time she’s heard complaints about the apartment complex.

Regina Muller asked about how this proposal will impact property values.

Motion to adopt the Findings of Fact and recommend that the City Council approve Zoning Calendar #2823, a map amendment to rezone 1915 Beach Rd and 3706 Beach Road from B2, Community Shopping, to R4, General Residential with the conditions listed in the staff report.

Motion to adopt the Finding of Fact and to recommend that the City Council approve Zoning Calendar #2824, a Planned Unit Development for multi-unit dwelling in the R4, General Residential Zoning District to include a Conditional Use Permit and Variance with the Conditions identified in the staff report.

Request: To rezone the properties from B2 Community

Shopping to B3 General Commercial

Zoning Calendar items #2825 and #2826 were for the same project, presented together, and voted on separately. The applicant is requesting that the property be rezoned to aB3 commercial use to allow for a 7 Brew drive-through coffee location at the SE corner of the parking lot located at 1620 & 1720 N Lewis Avenue (Tony’s Fresh Market). A variance was requested to allow for a 4 ft buffer zone, instead of the 10-foot requirement, to help prevent traffic issues. Tyler Williams, Planner, presented the proposal.

Commissioner Bill swore in Matt Noida and Laura Pacino, franchisees for 7 Brew. They provided a presentation and discussed the project, traffic flow, and business operations for this site.

Abraham Felmar, supported the proposal, but expressed concerns about congestion and how it will be prevented. Responding, Mr. Noida discussed the ways 7 Brew will keep  the traffic flowing.

Motion to accept the Findings of Fact and recommend that the City Council approve the Map Amendment to rezone 1620 & 1700 N Lewis from B2 Community Shopping to B3 General Commercial
