Village of Cherry Valley Liquor Commission met Nov. 4.

Here is the minutes provided by the commission:

Chairman Jim E. Claeyssen called the meeting to order at 6:45 PM.

A roll call was taken by Deputy Village Clerk Heather Riley:

Also present: Trustee David Schroeder, Trustee Jeff O’Hara, Trustee Jeff Fustin, Attorney Roxanne Sosnowski and Deputy Village Clerk Heather Riley.

ADOPT THE AGENDA: Trustee Hollembeak moved to adopt the agenda. Trustee Belt seconded. All “Aye”; none opposed. Motion carried.

APPROVE THE MINUTES: Trustee Belt moved to approve the minutes of April 16, 2019. Trustee Hollembeak seconded. All “Aye’”; none opposed. Motion carried.

PUBLIC COMMENT:

UNFINISHED BUSINESS: None.

NEW BUSINESS:

1. Discussion was had regarding the possible motion for revocation or suspension of a Class A, E, G, K, and L liquor license for the Cherry Bowl located at 7171 Cherryvale N. Blvd, Rockford IL. Attorney Sosnowski informed the commissioners that typically with a first offense like this one, the Village will reach out to the license holder and give them an opportunity to enter into a stipulation and hold a hearing to go over what the stipulations would be and sign some sort of document that states that the license holder agrees to certain terms to rectify the situation and avoid them from happening in the future. These stipulations are usually associated with a small fine for the first-time offense. Mr. Brad Sommer, a representative from the Cherry Bowl, addressed the commissioners. Mr. Sommer stated that he does not want to agree to a stipulation because he feels he should not have to claim fault for the incident. Attorney Sosnowski informed the commissioners that since The Cherry Bowl does not want to enter into a stipulation that a hearing will be scheduled for November 19, 2019 at 6:00 PM at Village Hall. Attorney Sosnowski stated that a court reporter must be present to create a transcript for the hearing, and that the Village’s witnesses (the Officers on scene at Cherry Bowl during the incident) will need to be present for the hearing.

2. After some discussion, Trustee Sally Hollembeak moved to send to the Village Board for approval of the liquor license for Cattle & Cream, 105 N. Cherry Street, or a “Class B, E, & K” license for the remainder of Fiscal Year 2019- 2020. Trustee Belt seconded. All “Aye’”; none opposed. Motion carried.

ATTORNEYS REPORT: None.

ADJOURNMENT: Trustee Hollembeak moved to adjourn the Liquor Commission Meeting at 6:50 PM. Trustee Belt seconded. All “Aye”; none opposed. Motion carried by voice vote.
