Village of Cherry Valley Village Board of Trustees met Oct. 6.

Here is the minutes provided by the board:

President Jim E. Claeyssen Called The Village Board Meeting To Order At 7:00 Pm And Led The Pledge Of Allegiance.

A roll call was taken by Village Clerk Kathy Trimble:

Also present: Attorney Jim Stevens, Attorney Roxanne Sosnowski, Public Works Director Chuck Freeman, Treasurer Maureen Gumowski, Interim Police Chief Roy Bethge, Police Sergeant Jesse Pearse and Village Clerk Kathy Trimble.

ADOPTION OF THE AGENDA:

Trustee Schroeder moved to adopt the agenda. Trustee Hollembeak seconded. All “Aye;” none opposed. Motion carried by voice vote.

APPROVAL OF THE VILLAGE BOARD MINUTES:

Trustee Hollembeak moved to approve the September 22, 2020 Village Board Minutes. Trustee O’Hara seconded. Trustee Fustin stated that he would like Trustee Belt’s statement removed from the permanent record or his rebuttal email attached to the minutes. Attorney Stevens stated that Trustee Fustin’s email cannot be attached to the September 22, 2020 minutes because it wasn’t presented at this meeting but it can be attached to tonight’s meeting minutes. After some discussion it was the consensus of the Village Board to have copies of Trustee Belt’s statement be placed in their mailboxes and to table the approval of the minutes until the October 20, 2020 Village Board Meeting. Trustee Hollembeak withdrew the motion to approve the minutes and Trustee O’Hara seconded. All “Aye;” none opposed. Motion carried by voice vote.

PUBLIC COMMENT: No one has signed up for Public Comment.

TREASURER’S REPORT:

Treasurer Gumowski stated that revenues in the General Fund of $498,000 were higher than expenditures of $485,000 by $13,000. Expenditures were mainly Salary & Benefits ($379,000), Engineering for the Swanson Park Path Project ($6,000), Legal ($23,000), Winnebago Co. 911 ($10,000), Commodities ($10,000), Animal Control Services ($6,000). Revenues of $102,000 were higher than expenditures of $54,000 in the Water Fund by $48,000. Expenditures were mainly Salary & Benefits ($34,000), Commodities ($6,000), Utilities ($5,000), Metering Pump ($2,000). In the Capital Improvements Fund, revenues of $57,000 were higher than expenditures of $34,000 by $23,000. Expenditures were mainly the Clayton Street Drainage Repairs Project ($31,000), and Engineering for the ADA Sidewalks & Clayton Street Projects ($3,000). Trustee Hollembeak moved to have the September 2020 Treasurer’s Report placed on file with the minutes. Trustee O’Hara seconded. All “Aye;” none opposed. Motion carried by voice vote.

PRESIDENT’S REPORT:

1. Proclamation: Breast Cancer Awareness Month. President Claeyssen read the Proclamation. Trustee Hollembeak moved to adopt the Proclamation proclaiming October 2020 as Breast Cancer Awareness Month in the Village of Cherry Valley.

Trustee Belt seconded. All “Aye” none opposed. Motion carried by voice vote.

2. Trustee Schroeder moved that the Village Board approve the IDOT Traffic Safety Grant with the award amount of $17,945.93. Trustee Hollembeak seconded. A roll call vote was taken:

3. Trustee Schroeder moved that the Village Board approve Resolution 2020-14; A Resolution Authorizing the Village President to enter into and execute the Intergovernmental Agreement with the Illinois Department of Transportation regarding the STEP Grant. Trustee Fustin seconded. A roll call vote was taken:

4. Trustee Hollembeak moved that the Village Board approve Resolution 2020-15; A Resolution of The Village of Cherry Valley, Illinois Authorizing the Village President to Enter into and Execute the Plan Adoption Agreement with Liberty National Life Insurance Company. Trustee O’Hara seconded. Attorney Sosnowski stated that there is a change to the Resolution to include Accident Protection, and an after-tax benefit Life Insurance Policy. Attorney Sosnowski will draft a new resolution with the changes. A roll call vote was taken:

5. Trustee Belt moved that the Village Board approve Village Clerk Kathy Trimble to participate in (4) online training sessions with the Municipal Clerks of Illinois, “The Role of the Clerk” at a cost of $100.00 from line item 5195A. Trustee O’Hara seconded. A roll call vote was taken:

ATTORNEY’S REPORT: JIM STEVENS:

Attorney Stevens stated that he is working on various projects for the village.

ENGINEER’S REPORT: SHERI KOSMOS, C.E.S. - No Report.

JEFF FUSTIN – PLANNING AND ZONING COMMISSION:

Trustee Fustin stated that there will not be a meeting in October.

DAVID SCHROEDER – RECREATION BOARD:

Trustee Schroeder stated that the Recreation Board will be meeting tomorrow at the Public Works Building at 7:00PM to discuss Halloween. Everyone is welcome to attend.

ORDINANCE REPORT BY TRUSTEE NANCY BELT:

1. Trustee Belt moved that the Village Board consider this the first reading of “An Ordinance Amending the Code of Ordinances for The Village of Cherry Valley, Illinois, Chapter 6 – Advertising”. Trustee Hollembeak seconded. All “Aye” none opposed.

Motion carried by voice vote.

2. Trustee Belt moved the Village Board waive the rules and consider this the second and final reading of “An Ordinance Granting a Variance Under Section 82-55 of the Code of Ordinances for The Village of Cherry Valley, Illinois to Section 82-7(F)(2) to allow Fencing to Extend Beyond the Rear of The House Towards the Front of The House on The North and South Sides of The House for The Property Commonly Known as 6581 Deer Isle Drive, Cherry Valley, Illinois”. Trustee O’Hara seconded. A roll call vote was taken:

3. Trustee Belt moved that the Village Board pass and approve Ordinance 2020-25; “An Ordinance Granting a Variance Under Section 82-55 of the Code of Ordinances for The Village of Cherry Valley, Illinois to Section 82-7(F)(2) to allow Fencing to Extend Beyond the Rear of The House Towards the Front of The House on The North and South Sides of The House for The Property Commonly Known as 6581 Deer Isle Drive, Cherry Valley, Illinois”. Trustee O’Hara seconded. A roll call vote was taken:

4. Trustee Belt moved that the Village Board waive the rules and consider this the second and final reading of “An Ordinance Granting A Variance Under Section 82-55 of The Code of Ordinances for The Village of Cherry Valley, Illinois To Section 6-41(B)(7) To Allow a Third Pole Sign in The Locations Indicated On The Site Plan For The Property Commonly Known As 2408 South Perryville Road, Rockford, Illinois”. Trustee O’Hara seconded. A roll call vote was taken:

5. Trustee Belt moved that the Village Board pass and approve Ordinance 2020-26; An Ordinance Granting A Variance Under Section 82-55 of The Code of Ordinances for The Village of Cherry Valley, Illinois To Section 6-41(B)(7) To Allow a Third Pole Sign in The Locations Indicated on The Site Plan for The Property Commonly Known As 2408 South Perryville Road, Rockford, Illinois”. 6. Trustee Belt moved that the Village Board waive the rules and consider this the second and final reading of “An Ordinance Regarding Hourly Rate of Pay for Part-Time Police Officers Assisting in the IDOT STEP Grant in the Village of Cherry Valley, Illinois”. Trustee O’Hara seconded. A roll call vote was taken:

7. Trustee Belt moved that the Village Board pass and approve Ordinance 2020-27; “An Ordinance Regarding Hourly Rate of Pay for Part-Time Police Officers Assisting in the IDOT STEP Grant in the Village of Cherry Valley, Illinois”. Trustee O’Hara seconded.

Trustee Fustin expressed his concern over this Ordinance and the proposal. We need to clarify what constitutes overtime; is it over 8 hours a day or 40 hours a week? Sergeant Pearse stated that in the 10 years he has been involved with invoicing IDOT, the grant pay has been based off of the highest paid Patrol Officer. This year IDOT changed that formula and the rate is now $52.29 per hour per Patrol Officer that works any IDOT grant. The liaison for the IDOT grant stated that we can no longer pay parttime patrol officers time and a half and that an Ordinance needs to be put in place stating that part-time Patrol Officers will make $39.00 per hour when they work these grants. Sergeant Pearse also stated that it is much easier to use part-time Patrol Officers to work these IDOT grants than using full-time Officers. A roll call vote was taken:

FINANCE REPORT BY TRUSTEE JEFF O’HARA:

1. Trustee O’Hara moved that the Village Board approve the Audit Proposal for Fiscal Years Ending April 30, 2021 thru April 30, 2024 (4 years) from Lauterbach & Amen, LLP for a total cost of $45,350.00. Trustee Belt seconded. A roll call vote was taken:

1. Trustee Fustin moved that the Village Board approve SPECIAL ORDER 20-1 – Issued October 1, 2020 for the Cherry Valley Police Department regarding COVID-19 Procedures, with an effective date of October 1, 2020. Trustee Hollembeak seconded.

Trustee Alsbury moved that the Village Board award the bid for the ADA Sidewalk Improvements Project (Newburg Village and Valley Woods Neighborhoods) to Stenstrom Excavation and Blacktop, Rockford, Illinois as the lowest responsible bidder in the amount of $37,993.00 from line item 5390 Capital Improvements. Trustee Hollembeak seconded. A roll call vote was taken:

2. Trustee Alsbury moved that the Village Board award the bid for the South Bell School Road Drainage Repairs Project to Stenstrom Excavation and Blacktop, Rockford, Illinois as the lowest responsible bidder in the amount of $45,988.00 from line item 5390 Capital Improvements. Trustee Hollembeak seconded. A roll call vote was taken:

3. Trustee Belt seconded. A roll call vote was taken:

Trustee Hollembeak moved the Village Board hire Mr. Thomas Derken as a Part-time Police Officer for the Police Department at an hourly rate of $26.00 per hour, with a starting date of October 12, 2020 to assist with Evidence Management and various Police Department administrative projects. Trustee O’Hara seconded. A roll call vote was taken:
