City of Wheaton City Council Met July 19.

Here is the minutes provided by the council:

1. Call to Order and Roll Call

The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

2. Citizens to be Heard

Ms. Jan Burlingame, 1015 S. Naperville Road, spoke to an issue regarding storage of an RV on their property. She stated the RV has been on their property in the same location since 2001. When the Zoning Code was amended in 2002, Ms. Burlingame quoted Director Kozik statement at the July 1 2002 City Council meeting that her RV was in compliance with the current and proposed regulations. She stated she has now been given a citation for a code violation for the location of her RV. Ms. Burlingame stated it is very difficult to relocate the RV and is asking for a solution in the middle of the road that will avoid a court case. She asked the City to consider an amendment to the code that will allow anyone who was in compliance with the prior ordinance be allowed to keep an RV in its current location.

Ms. Vickie Austin, 925 Arbor Drive, speaking on behalf of the Wheaton Chamber of Commerce, thanked Mayor Suess for attending the Chamber’s Homage to Frida reception and the individuals who collaborated to make the Chamber’s Frida display possible. Ms. Austin also thanked the City and the Downtown Wheaton Association for their efforts to bring events to Wheaton and she looks forward to promoting future programs. In response to Mayor Suess, Ms. Austin stated the Chamber is open every day for foot traffic to view the art display or by appointment.

3. Consent Agenda

Councilwoman Robbins moved and Councilman Barbier seconded that the following action be taken on the Consent Agenda items:

1. Approve the minutes of the July 6, 2021 regular Wheaton City Council meeting as submitted.

2. Adopt Resolution R-2021-65, A Resolution Authorizing the Disposal of Certain Surplus Property (PD).

4. Adopt Resolution R-2021-66, A Resolution Authorizing the Execution of Agreement No. 213 Between the City of Wheaton, the Wheaton Foreign Fire Insurance Tax Board (WFFITB) and Yad Construction for Fire Station #38 Kitchen and Dayroom Renovations for a Total Amount Not to Exceed $79,995

Councilwoman Bray-Parker moved and Councilman Barbier seconded that Resolution R-2021-66, A Resolution Authorizing the Execution of Agreement No. 213 Between the City of Wheaton, the Wheaton Foreign Fire Insurance Tax Board (WFFITB) and Yad Construction for Fire Station #38 Kitchen and Dayroom Renovations for a Total Amount Not to Exceed $79,995, be adopted.

City Manager Dzugan advised the Foreign Fire Insurance Tax Board is funding the renovation of kitchen and dayroom at Fire Station #38 located at 1 Fapp Circle. Due to the fact that the WFFITB is funding the renovation, they are a party to the agreement with the City and the contractor.

5. Pass Ordinance No. O-2021-37, An Ordinance Amending Section 2-293 “Rules and Regulations Adopted,” of Division 3 “Board of Fire and Police Commissioners,” Article IV “Departments,” Chapter 2 “Administration” of the Code of Ordinances of the City of Wheaton

Councilman Brown moved and Councilwoman Robbins seconded that Ordinance No. O-2021-37, An Ordinance Amending Section 2-293 “Rules and Regulations Adopted,” of Division 3 “Board of Fire and Police Commissioners,” Article IV “Departments,” Chapter 2 “Administration” of the Code of Ordinances of the City of Wheaton, be passed.

City Manager Dzugan stated the proposed amendment to the rules and regulations of the Board of Fire and Police Commissioners would provide preference points for Wheaton Police Department interns and community service officers. He believes this amendment will assist the City in their recruitment efforts in hiring quality police officers.

6. Receive Planning & Zoning Board Report Re: ZA-#21-17/Rear Yard Setback Variations/199 Longfellow Drive/Barabas

Councilman Barbier moved and Councilwoman Robbins seconded to receive the Planning & Zoning Board Report Re: ZA-#21-17/Rear Yard Setback Variations/199 Longfellow Drive/Barabas.

City Manager Dzugan stated the Planning & Zoning Board recommended approval of two rear yard setback variations to allow the construction of a patio and outdoor fireplace with the condition that a proposed free-standing portable fountain shall not be placed in the easement area along the rear property line. City Manager Dzugan also stated Building Department staff would verify that the fireplace clearance meets code as part of the permitting process.

Councilman Barbier moved and Councilwoman Robbins seconded that No. O-2021-38, An Ordinance Granting Rear Yard Setback Variations on a Certain Piece of Property Commonly Known as 199 Longfellow Drive – Barabas, be passed.

7. Council Comment

Mayor Suess thanked the Chamber and the DWA for the Frida Kahlo event on July 9. Along with the DWA, he stated he presented an Economic Impact Award to McAninch Arts Center Director, Diana Martinez, that night. He thanked Ms. Martinez and the entire team for their work in bringing an event that could draw over 100,000 people to the exhibit which also provides an economic benefit to the City of Wheaton.

Mayor Suess stated he attended the 7th Annual National Gathering of Native Veterans in Cantigny Park on July 17 and welcomed them to Wheaton.

Mayor Suess thanked the residents on Marian Court who invited him to join them as they celebrated the 50th anniversary of the development of their subdivision with their 50th annual block party.

8. Approval of Warrant

Councilman Barbier moved and Councilwoman Bray-Parker seconded that Warrant No. 804 in the amount of $1,967,508.95 be approved.
