City of Wheaton City Council met July 5.

Here are the minutes provided by the council:

1. Call to Order and Roll Call The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. 

Upon roll call, the following were:

2. Presentation Mayor Suess presided over the swearing-in ceremony for Police Officer Steven Larson following remarks by Police Chief William Murphy.

3. Citizens to be Heard Mr. Barry Nelson, 1734 Kay Road, read a statement expressing concerns regarding the engineering design for the installation of sidewalks on Kay Road. Mr. Nelson detailed Kay Road is a cul-de-sac with low pedestrian and car traffic which he feels would not improve pedestrian safety as the proposed sidewalk doesn't connect to a network. He also expressed concerns regarding the potential impact of the roots of mature trees and the installation over an existing city water main.

Mrs. Erica Nelson, 1734 Kay Road, read a statement expressing concerns regarding the engineering design for the installation of sidewalks on Kay Road. Mrs. Nelson detailed the proposed sidewalk dead ends and feeds into the street. She encouraged councilmembers to visit Kay Road. Ms. Nelson expressed gratitude to witness the installation of the new City of Wheaton Police Officer and to Mayor Suess for his opening comments expressing condolences to the Highland Park Community. Ms. Nelson expressed sympathy for the Highland Park tragedy.

Ms. Donna Estler, 1070 Dartmouth Drive, expressed concern regarding a parking meter citation. Ms. Estler explained she was under the assumption parking enforcement would not apply on June 20, 2022, Juneteenth, a legal holiday as defined at the federal and state level. She detailed the potential for confusion as the term legal holiday is broad. She

WHEATON CITY COUNCIL PROCEEDINGS July 5, 2022 explained the public is generally aware of both federal and state holidays but may not know the observed holidays of individual municipalities.

Mr. Dave Basener, 609 N. Wheaton Avenue, expressed concerns regarding traffic related to the proposed Willow Avenue Apartment development. Mr. Basener asked the council to consider traffic mitigation on various streets including Wheaton Avenue. Mr. Basener listed suggestions pertaining to traffic mitigation.

4. Consent Agenda Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on the Consent Agenda items:

1. Approve the minutes of the June 13, 2022 Wheaton City Council Public Hearing and the June 20, 2022 Wheaton City Council Regular Meeting as submitted.

2. Adopt Resolution R-2022-55, A Resolution Authorizing the Disposal of Certain Surplus Property (FD).

3. Approve Bond Waiver and Issue Raffle License to St. Michael Parish School.

4. Approve Bond Waiver and Issue Raffle License to FT Cares Foundation “FTC”.

5. Pass Ordinance 0-2022-30, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 22 - Buildings and Building Regulations City Manager Dzugan stated the ordinance amends the requirements of when a sump pump is required to connect to a public storm sewer. He detailed connection to a public storm sewer would only be required in cases of a new home or addition as opposed to anytime a resident installs a sump pump.

Councilman Brown moved and Councilman Barbier seconded that Ordinance O-2022-30, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 22 - Buildings and Building Regulations, be passed.

6. Approve Appointments to City Board / Commission Mayor Suess moved and Councilwoman Fitch seconded that Jim Wozniak and Stephen Siemer be appointed to the Environmental Improvement Commission, for three-year terms.

7. Adopt Resolution R-2022-56, A Resolution Authorizing the Execution of Agreement No. 312 With MYS, Incorporated for Parking Lot Improvements at Fire Station No. 38 for a Total Amount Not to Exceed $169,956.50 City Manager Dzugan added three bids were received to replace the 30-year-old concrete apron at Fire Station No. 38 on Fapp Circle. He detailed the bid amount is 40% higher than the budgeted amount, however, reserves are available in the capital project fund to accommodate the cost increase.

Councilwoman Robbins moved and Councilman Weller seconded that Resolution R-2022-56, A Resolution Authorizing the Execution of Agreement No. 312 With MYS, Incorporated for Parking Lot Improvements at Fire Station No. 38 for a Total Amount Not to Exceed $169,956.50, be adopted.

8. Council Comment Councilman Barbier acknowledged the Wheaton Park District for the many events the past holiday week including the Field of Honor and the Parade.

Councilwoman Robbins expressed gratitude for all the wonderful community events. Councilwoman Robbins reflected on Mayor Suess' opening comments regarding the tragedy in Highland Park and expressed her support for the residents of Highland Park.

Mayor Suess expressed appreciation for last week's Wheaton Municipal Band annual patriotic concert.

9. Approval of Warrant Councilwoman Fitch moved and Councilman Brown seconded that Warrant No. 827 in the amount of $1,860,816.58 be approved.
