Village of Cherry Valley Planning and Zoning Commission met Aug. 17.

EX-OFFICIO’S REPORT : TRUSTEE JEFF FUSTIN
Trustee Fustin stated that the Village Board passed by ordinance both the Text Amendment and Variance extension (related to the Solar Farm Project) that came out of the July Planning and Zoning Commission Meeting at the August 1, 2022 Village Board Meeting.
NEW BUSINESS:
1. Gary Tiffany moved to approve a request for a Variance under Section 82-55 for one year to commence the variance to Section 6-101 of the Code of Ordinances for the Village of Cherry Valley, Illinois to allow a two-faced electronic message board at the location indicated on the map filed at the Village Hall for the following described property 7163 Charles Street, Rockford, Illinois PIN: 12-35-352-006. Jim Smetana seconded.
Village Attorney Stevens read the Findings of Facts A – F to the Commission as follows: a. Because of the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the chapter regulations were to be carried out; 5-AYE 2-NAY
b. The conditions upon which a petition for a variation is based are unique to the property for which the variation is sought and are not applicable generally to other property within the same zoning classification; 7-AYE 0-NAY
c. The purpose of the variation is not based exclusively upon a desire to increase the value or income potential of the property;

d. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located;

e. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets or increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the neighborhood; and

f. The proposed variance complies with the spirit and intent of restrictions imposed by this chapter.

2. Jim Smetana moved to approve a Map Amendment under Section 82-56 of the Code of Ordinances for the Village of Cherry Valley, Illinois from R-2 – Two-Family Residential District under Section 82-206 to OF - Office District under Section 82- 261 for the property legally described as PIN: 16-01-254-017. Gary Tiffany seconded.
• Dr. Jason Jones stated that he is looking to get the zoning changed to OF – Office for the zoning classification for both of the parcels. Dr. Jones stated that he thought that the zoning was already OF-Office. Dr. Jones stated that he is looking to expand his parking lot and eventually add an additional building that would be for another sort of Health Care Facility.
• Pam Stahl who lives at the Lawrence St Condos stated that she would not have a problem with Dr. Jones future plans.

Sally Fleegle moved to approve a Map Amendment under Section 82-56 of the Code of Ordinances for the Village of Cherry Valley Illinois from CN – Commercial Neighborhood District under Section 82-233 to OF – Office District under Section 82-261 for the property commonly known as 706 E State Street, Cherry Valley, Illinois and legally described as PIN: 16-01-254-015. Larry Gray seconded. A Roll Call Vote was taken:

4. A presentation was made by Mr. Jayson Shull for the development of a PUD (Planned Unit Development) at 3349 South Mill Rd in Cherry Valley. After a lengthy discussion, the committee asked the Petitioner Jason Shull to consider some stipulations and bring back more information to the September 21, 2022 Planning and Zoning Commission Meeting for a continuation of this potential development. Pat Stegemann moved to table this request for discussion until the September 21, 2022 Planning & Zoning Commission Meeting. Larry Gray seconded. A Roll Call Vote was taken:
