The Council of the City of Waukegan met in regular session on Monday, June 05, 2023 at 7:00 PM City Council Chambers, City Hall. 100 N. Martin Luther King Jr. Ave, Waukegan. Mayor; Ann B. Taylor, City Clerk; Janet E. Kilkelly, City Treasurer; Dr. John R. Schwab, & Corporation Counsel; Stewart J. Weiss, were present.

1. Opening Items

Procedural: A. Roll Call

2. Resolutions/Proclamations/Presentations/Appointments

Action: A. Motion by Ald Florian, second by Ald Hayes to ratify appointments to the Waukegan Public Library Board of Trustees (Christa Sanchez) - Ms. Sanchez had the opportunity to speak after being confirmed by the Alderpersons.

3. Audience Time

Rev. Barbara Brown, Joyce Epperson, Dorothy Bulls: Representing Trinity AME Church, located at 210 South Ave, Waukegan IL 60085 - shared information on their work at Trinity AME Church.

Rayon Edwards: Stated that Trinity AME Church has been exactly who they say they are. He shared his support of making Trinity AME Church a landmark. Shared his childhood memories of Trinity AME Church. Shared and spoke this evening in advocacy for the children of our community. Shared that he is disappointed that the City Clerk's salary is the only one that has been re-visited out of all the salaries that they've seen. He encouraged the new Alderpersons to speak on behalf of the people - stated that they should not come here and say that the people are worried about the salaries, as the community doesn't even understand the salaries. Continued, and spoke about the violence in the community. Spoke about his Juneteenth event 'for his kids' at Whitter and Webster School on June 19th, 2023 - stated he would like to see who shows up and stated one day they will be in those seats. Stressed that all they want to do is be loved, and we are the leaders - if we keep on fighting, what are we teaching them.

Rabbi Michael Ben Yosef: Congratulated everyone that has received awards. Spoke in advocacy for Marcellus Stinnette, killed by former Waukegan Police Officer Dante Salinas.

Parvin Vakili: Introduced herself as a 1st Ward Resident. Stated that she spoke with the Mayor and her staff regarding graffiti that she was promised would be cleaned. She shared that the graffiti was never cleaned after promised by the Mayor's Office. Stated that Ald Bolton called Public Works in her presence, and stated that the graffiti still hasn't been cleaned. She explained that sometimes she feels the City of Waukegan has forgotten about the 1st Ward. Spoke about the issue of the roads not being done, and stated that she was told the reasoning is because of the lead pipe replacement project. She stated that the money was there under Mayor Cunningham. She raised the question asking if the money was diverted to other places, why, and why is it not getting done.

Clyde McLemore: Thanked the City Council for the proclamation for 'June 19th is Juneteenth in Waukegan'. He shared his concerns regarding the colors of the flag that is currently flying for Juneteenth. Stated that the current flag flying out there is not their colors - and that he brought the correct flag there today with the correct colors. Spoke regarding the Waukegan Casino and Mayor's position on it now, vs. when she was an Alderperson. Stated that he realizes it is about the dollar. Spoke regarding 'Ivy Hall' and shared an exhibit - he explained his exhibit, and stated that he believe there is fraud going on. Asked Chief Navarro to arrest Mayor Taylor for fraud. He called for 'Ivy Hall' to be shut down and for a complete investigation.

Calvin Mathis: Black Abolition Movement for the Mind (B.A.M.M.). Congratulated the new board members on their victory and new position. Stated that he assumes they got their new Alderperson Badges, and that they should pull those out if they are ever in an accident at an intersection, so they don't get an illegal search, such as the one he shared he got. Shared that they are calling for a Civilian Office of Police Accountability, and shared what their responsibilities would look like.

Brother Blanks: Black Abolition Movement for the Mind (B.A.M.M.). Shared a complication of poetry written by one of his students from Jack Benny Middle School. Shared that the poem was written by one of his youngest students, who was lost to the ignorance of the streets - his name is Dontrell Bell. He stated that the individual that ordered him to be beat until he fell to his death was here at city council a few weeks ago, stating if an elderly lady hit him, he would allegedly hit her back. Spoke about how everyone has a past, and stressed the alleged comments that were made by the individual against the elderly.

Megan McKenna, CEO Boys and Girls Club of Lake County & Germain Castellanos, COO Boys and Girls Club of Lake County: Shared an update from the Boys and Girls Club of Lake County, in Waukegan - spoke about summer programming, highlighting Gun Violence Prevention Month. Spoke about the 'Stepping up for Safety Walk and Vigil' on Weds Jun 28th at 4:00 PM which will take place at their building 730 S. MLK Jr, Ave, Waukegan. Thanked the Mayor and City Council for their support.

Viviana Arzate: Fiesta Padres: Represents the festivals celebrated for the people of Latin America. Shared that she has met many of the City Council Members, and she is delighted to see many brown and black people in the City Council. Stated that she like to see people who represent herself and the community. Stated that she would like to petition to have the opportunity to organize their parade in September to continue to celebrate Fiesta Padres, and stressed the importance of this celebration for our community.

Elizabeth Marrero: She read a letter in Spanish, from a from Senator in Mexico in support of a petition in the community from Latinos, regarding Fiesta Padres.

Margaret Carrasco: She raised concerns regarding the 'balanced budget' that she claims Mayor Taylor allegedly brags about in public, and held an exhibit from the City of Waukegan's website regarding 'fiduciary funds' - better known as 'police and fire pension'. She stressed that there are very strict laws regulating/restricting mandatory reporting for these funds. She read from her exhibit, stating if you look at it, it ends in the year 2020. Continued to explain that the whole term Mayor Taylor was in office, it is allegedly missing. She encouraged Waukegan Police and Firemen to raise concern to Mayor Taylor. Stated that she is glad State Senator Johnson is present tonight sitting in the first row, because allegedly she was present during the discussion of the events for their Waukegan Community Fiesta's Padres, which she states has taken place over the last 20 years - she claims she has text proof from Mayor Taylor. She spoke about a $6,000.00 charge that she believes was charged illegally to the Waukegan Latino Community. She claims Mayor Taylor denied her application and instead gave it to out of towners. She claims Waukegan people aren't going anywhere, and they are going to do it. Asked for support from the Aldermen.

Corporation Counsel Stewart J. Weiss provided clarification regarding Ivy Hall. Corporation Counsel Weiss explained that Ivy Hall operated their business for three days without a business license. He stated they were immediately citied, as well as received tickets for every single day, in which he stated they did pay the fines for. Corporation Counsel Weiss stated that there are plenty of businesses that unfortunately, violate the law by not having a business license. He stated that they receive tickets, and they go through the adjudication process, which he stated is exactly what happened here.

Mayor Taylor stated they chose to pay the fines, and they were told about it. She continued, stating that there was no representation for their opening, until such time as their license had cleared. Mayor Taylor stated to the audience if they are going to fact check, fact check - but they will not be debating this here. Mayor Taylor continued, stating that Ivy Hall put out a soft opening, and that they were told no city officials would be there, because they had not completed their business license accurately. Mayor Taylor continued, talking about the inspection process - stating there was a misunderstanding and that they were fined immediately, and they paid their fines. She continued, stating that when they received their business license, they had an opening from the City of Waukegan. Mayor Taylor continued to state to the audience that this is not a time to debate this, and that they had audience time. Mayor Taylor stated that they are simply responding to what happened, and reiterated. Mayor Taylor invited the audience member to check with Building Commissioner George Sellas, and pull everything out, but stated that those are the facts on what happened. Mayor Taylor again reiterated that they don't do openings until they can verify people have their licenses. She stated that people tell them all the time they have their licenses, but they don't particularly have the 'i's' and 't's' crossed.

Audience member asked Mayor Taylor if she back-dated the document. Mayor Taylor stated no, they did not. Mayor Taylor shared that we are now moving on to the next thing.

Mayor Taylor stated that there is only one application that has been put in so far for a parade. She stated that they put in early, in January and currently are the only ones that have an approved parade. She continued, stating they were due and people could put in for anything, citing the different types of applications, stating they could be put in as of January 9th. Mayor Taylor explained this has been advertised. She continued, stating if you put in an application after that, the city takes every application under consideration, but a date for that parade in September was put in for September 17th and they put that in on January 9th. Mayor Taylor again stated she is just letting everyone know what they put in.

Mayor Taylor shared that we will now be moving on to the Consent Agenda. First, Mayor Taylor asked for a motion to hear New Business item 7. H. before the Consent Agenda.

Motion by Ald Newsome, second by Ald Bolton to hear item New Business 7. H. before the Consent Agenda.

Action: 7. New Business: H. Motion by Ald Bolton, second by Ald Turner to approve an Ordinance approving HPC Calendar #L-1-23, the proposed landmarking of Trinity African Methodist Episcopal Church located at 210 South Avenue. This matter was presented to the Community Development Committee on June 5, 2023.

A, C - F, excluding item 4. B.

Action (Consent), Minutes: A. Motion to approve the Regular Meeting Minutes from Monday May 15, 2023

Action: B. Motion to Approve Honorary Street Signs in Honor of Ald. Larry TenPas at Various Locations in 6th Ward. This matter was presented to the Code Revisions, Appeals & Negotiations Committee on May 15, 2023.

Ald Guzman explained why he would like to have this item held over. Shared that he would like a motion to hold the item over. Explained that he told Ald Turner he was all for this motion and that he would do it for him. He continued, explaining that it was supposed to go to Public Works & Infrastructure Committee - stated that it went there, and asked the questions of what the criteria was for this type of item. Stated he has has three or four people already ask him if he [Ald Turner] can do it, why can't they do it. Explained that there is no structure in place, and he doesn't want to see every street named by every other person. Stated he he has to hold this over as he has had multiple people calling him, until this is cleared up.

Mayor Taylor asked Corporation Counsel Stewart J. Weiss, if a second is needed for a motion to hold over. Corporation Counsel Weiss explained that the Waukegan Code allows for one Alderperson to hold something over until the next regular meeting, unless there is a two-thirds vote to overrule.

Corporation Counsel Weiss reiterated that there is a motion to hold over by Ald Guzman, and entertained if anyone would like to make a motion to overrule that, or let it stand so it appears on the next meeting.

Ald Turner shared he would like to make a motion to overrule the Aldermanic motion to Hold Over by Ald Guzman of item 4. B.

Ald Bolton asked how long have we been talking about this. Mayor Taylor stated not all of the Alderpersons have been involved, besides the one other committee meeting, referring to the newly elected Alderpersons. Mayor Taylor stated this is up to the Alderpersons. Ald Turner stated he doesn't know how many more meetings we need to discuss this item. Stated he has been chasing this items for over a year. Ald Turner explained to Ald Guzman that there is a process, and shared why he feels there is zero point to holding this item over to debate. Ald Turner stated all Ald Guzman had to do was ask how do you do this process. Mayor Taylor again reiterated the motion:

Motion by Ald Turner, second by Ald Donnenwirth to overrule the Aldermanic motion to Hold Over by Ald Guzman of item 4. B.

Corporation Counsel reminded the Alderpersons that this requires 6 out of 9 Alderpersons to overrule. 'AYE' means to hear it tonight, and 'NAY' means to allow the hold over to stand, and this item will be heard at the next meeting.

Corporation Counsel Weiss explained that this item will return to Old Business on Tuesday, June 20, 2023.

Action (Consent): C. Motion to Approve Regular Payroll dated May 19, 2023 in the total amount of $1,769,172.20.

Action (Consent): D. Motion to Approve Miscellaneous Payroll (PD-HBB & CT Cashout, Vacation Cashout, SEIU Uniform Allowance, Retro, Final Payout, and FY End Time Bank Cash Out) dated May 19, 2023 in the total amount of $386,683.85.

Action (Consent): E. Motion to approve vendor payments dated June 5, 2023 in the amount of $4,264,601.91.

7. New Business Motion by Ald Florian, second by Ald Newsome to omnibus vote New Business items 7. A, B, F - K, M - N excluding items 7. C, D, E & 7. L

Action: (omnibus) A. Resolution approving and authorizing the proper City Officials to award the Waste Hauling RFP to Lakeshore Recycling Systems (LRS) for residential waste collection services beginning December 1, 2023 and end on November 30, 2028 based on the attached pricing. The City is in agreement with the most favorable amount submitted by LRS for $25.60 per month per household for the start of the contract. This matter was presented to the Public Works & Infrastructure Committee on June 5, 2023.

Action: (omnibus) B.  Resolution approving and authorizing the proper City Officials to award the bid for the 2023 Annual Commodities, concrete portion only, to Ozinga for the highlighted pricing on the bid tab. It is anticipated that an amount up to $125,000.00 may be spent for the bid. This matter was presented to the Public Works & Infrastructure Committee on June 5, 2023.

Action: C. Motion by Ald Turner, second by Ald Newsome to approve a Resolution approving and authorizing the proper City Officials to award the 2023 Bi-Weekly Mowing bid to Dean Investments per Sec. 2-458(i)(7)(Good Faith Waiver) for a not to exceed amount of $60,000.00. This matter was presented to the Public Works & Infrastructure Committee on June 5, 2023.

Ald Guzman raised questions about the character of the vendor, and things he has heard. Ald Turner asked what he heard. Ald Hayes, and Mayor Taylor commented. Mayor Taylor stated anything he has heard, shouldn't be commented on as it is all hearsay at this point.

Ald Guzman stated exactly, and he doesn't want this approved and that it should be held over until they find out about these rumors.

Ald Turner commented on Ald Guzman's concerns, and shared the conversation that was had with Building Commissioner George Sellas, which included that the previous concerns with the previous administration are no longer a factor and totally resolved.

Ald Turner shared that he is confidence in Building Commissioner Sellas reassurance, and would like to vote to move this forward.

Mayor Taylor asked if they would like to hear from the Public Works Director on this item. Ald Turner stated that this would also include Building.

Mayor Taylor invited Building Commissioner Sellas, and Public Works Director Garland to clarify any concerns. Mayor Taylor invited Ald Guzman to share.

Ald Guzman stated he would rather hold this over, as this is more of a private matter. Stated he is comfortable taking Ald Turner's word on the clarification he received by Building Commissioner Sellas. Building Commissioner Sellas provided clarification, stating under the previous administration there was a mistake with the contract that was signed. Commissioner Sellas continued, stating that he has used the contractor now and there hasn't been an issue. Stated that he discussed this with the Public Works Director, and he there shouldn't be any issue if the contract states exactly what needs to be done.

Mayor Taylor and Commissioner Sellas touched base on the disadvantages of not having this contract, including vacant lots not being taken care of. Ald Guzman stated he understands but wants the job done by straighten arrowed people, and no funny business. Public Works Director Garland assured Ald Guzman that they will have straighten arrowed people.

Ald Guzman thanked the directors for their clarification. Mayor Taylor asked if we can take a vote on this item and move forward. Ald Guzman confirmed we can move forward with item 7. C.

MOTION APPROVED

Action: D. Motion by Ald Turner, second by Ald Newsome to approve a Resolution approving and authorizing the proper City Officials to award the 2023 Weekly Mowing bid to G & S Services for a not to exceed amount of $53,600.00. This matter was presented to the Public Works & Infrastructure Committee on June 5, 2023.

Ald Guzman raised concerns with both items 7. D & E regarding G&S. Stated this is regarding the same issue. Mayor Taylor asked both Directors to come up and clarify any concerns.

Ald Turner stated he is confused - what is the question. Mayor Taylor stated this item would only be clarified by Director Garland. Mayor Taylor stated to Ald Turner that Ald Guzman would just like clarification on both 7. D & E.

Ald Turner and Director Garland asked what Ald Guzman would like clarification to. Corporation Counsel Weiss stated it might be beneficial if Director Garland and Shannon C from the Public Works Department could speak on the bidding process and qualifications. Mayor Taylor asked about the bidding and when the items were posted. Shannon provided clarification regarding the bids received for items 7. D & E, and well as the bid posting process.

Ald Turner asked when G&S will start. Shannon shared that they will be notified if this item is approved, first thing tomorrow morning. Ald Turner shared that we need to get them start ASAP, and shared his experience with neglected vacant properties that need attention. Ald Guzman stated he understands, but we need good contractors, so we don't have complaints or favoritism. Shannon continued to share how vendors are communicated to, including where the bids are shared.

Ald Hayes spoke on the process of bringing the item back if they are not happy with the vendor, or if there are concerns. Ald Guzman again reiterated he wants the city to receive its correct services. Mayor Taylor asked if we have had problems with G&S in the past. Director Garland and Shannon stated no. Shannon shared the detail the vendor received for each property, and the specifications.

Ald Guzman raised the question how much longer would this take if the item is brought back for a bid. Shannon stated a month and a half with everything.

Ald Martinez shared his concerns about how we are supposed to be leading by example, and added that we need to expedite this with all the issues with certain properties. Stated now that we know more, we should be more cautious and conscious. He added that holding it over is ridiculous and he agrees with Ald Turner that this needs to be done. He continued to stress that he doesn't want us to have to wait any longer, and that this needs to be done.

Ald Newsome shared the history of this vendor and the issues out there are not with the City of Waukegan and this vendor - shared that they will not longer be a vendor if they don't resolve those issues, but for right now we need to get the grass on the properties cut. Corporation Counsel Weiss clarified that G&S satisfied all the legal requirements.

Motion by Ald Newsome, second by Ald Turner to approve a Resolution approving and authorizing the proper City Officials to award the 2023 Cemeteries Mowing bid to G & S Services for a not to exceed amount of $31,000.00. This matter was presented to the Public Works & Infrastructure Committee on June 5, 2023.

Action: (omnibus) F. Resolution approving and authorizing the proper City Officials to allow leak detection services performed by M.E. Simpson per Sec. 2-458(i)(3)(Joint Purchasing) for a not to exceed amount of $40,000.00. This matter was presented to the Public Works & Infrastructure Committee on June 5, 2023.

Action: (omnibus) G. Resolution approving and authorizing the proper City Officials to enter into a contract with Office Plus for the purchase of office furniture for Public Works per Sec. 2-458(i)(3)(Joint Purchasing) for a not to exceed amount of $37,120.84. This matter was presented to the Public Works & Infrastructure Committee on June 5, 2023.

Action: (omnibus) I. An Ordinance approving the purchase of real property located at 623 S. Genesee Street in the amount of $40,000. This matter was presented to the Community Development Committee on June 5, 2023.

Action: (omnibus) J. A Resolution to authorize the IT Department to purchase professional services and material and support of the Council Chambers audio video system from AVI Systems LLC. This matteSaver was presented to the Community Development Committee on June 5, 2023.

Action: (omnibus) K. A Resolution to authorize the IT Department to extend purchasing authorization and ratify prior expenditures for computers maintenance and professional services from Pentegra Systems LLC. This matter was presented to the Community Development Committee on June 5, 2023.

Action: L. Motion by Ald Hayes, second by Ald Florian to approve A Resolution Approving an Agreement with The Arena Strategic Communications, LLC for Professional Communications Consulting Services in the amount of $108,000. This matter was presented to the Community Development Committee on June 5, 2023.

Ald Felix shared concerns in regards this item. He said that he does not have a clear distinction between what Brad from the Arena Strategic Communication and what Waukegan Public Relations do. Mayor Taylor answered and clarified. Ald Felix asked for this item to be held over and asked for a description of what his services are. Item will be held over for June 20th.

HOLD OVER ALD FELIX

Action: (omnibus) M. Resolution approving the execution of agreement by Mayor on behalf of the City of Waukegan with The Public Entity Professionals of Alliant Insurance Services, Inc. for the July 1, 2023 property and casualty insurance renewal for an estimated amount of $1,983,006.00. This matter was presented at the regular Government Operations & Oversight committee meeting on June 5, 2023.

Action: (omnibus) N. Resolution approving the execution of agreement by Mayor on behalf of the City of Waukegan with Origami Risk LLC for a three (3) year Risk Management centralized system contract for an estimated amount of $63,667.00. This matter was presented at the regular Government Operations & Oversight committee meeting on June 5, 2023.

Alderperson Time

Ald Martinez: He thanked Pastor Jesus Gerena for his invocation tonight. He suggested residents to reach out to him 847-390-2689 or by email juan.martinez@waukeganil.gov in regards to neighborhood watch or anything the residents need. He gave special thanks to those to have reached out and those who supported him. Furthermore, he spoke about potholes, increase in crimes and encourage everyone to be good neighbors and leave a porch light on. Lastly, he congratulated Arturo Torres, Public Works Superintendent on his retirement and the 35 years of service to the community. Ald Martinez shared he also speaks Spanish.

Ald Felix: He spoke about the Road Program and encouraged everyone to visit the city website and obtain the road list. He also asked to reach out to him regarding the 4th ward streets. He shared that he attended the African American Museum and also shared about fourth ward neighborhood meeting happening near Julian Towers. He told everyone to register on the city website in order to receive public notices, asked organizations to reach out to him if they provide senior assistance and spoke about the 2023 Annual Budget.

Ald Newsome: She tanked Public Works: Chris Garland, Edie, Dante, YCC staff and the youth for coming out and cleaning the 5th ward alleys. She thanked the YCC for their partnership with the City of Waukegan. She sent condolences to the Cook family and congratulated Pastor Stevenson for his pastoral services.

Ald Turner: He spoke about car burglaries, encouraged everyone not to leave grass clippings out when cutting the grass and to clean along curved lines. He thanked the YCC for also cleaning up his ward, talked about having a dumpster for his ward next month-more details to come. He shared tentative ward meeting happening on Tuesday July 4th at Upton Park- will be confirming soon. Next, he spoke about speed humps, speed bumps, having a pilot project and shared that there are many areas where they have these bumps/humps and he does not see why the city cannot have them. He mentioned that residents have asked why is the Council camera not focused on the speakers when they are at the podium. Residents have requested to have the camera show the speakers. Moreover, he asked Corporation Counsel Stew about the policy on placing items in the agendas. He explained the old and new way of placing items on the agenda and asked Corporation Counsel for clarification. Stew, clarified. Ald Turner shared that the new process is time consuming and ineffective. The application has to be downloaded online, completed, obtain 2 signatures from aldermen and submitted back to the Mayors Office. Ald Felix, Ald Bolton, Ald Martinez commented on new procedural process. Ald Bolton asked that Chief of Staff Bridges further explains the new process. COS Bridges, explained along with Mayor Taylor.

Ald Donnenwirth: He thanked everyone who has called him regarding issues on his ward. He shared that he saves everyone's numbers who call him. Moreover, he thanked Art Torres, Public Works Superintended, Code Compliance and Police Department for all their work and for always getting back to him. Lastly, he said that he would like to be addressed as 'alderman'.

Ald Florian: She congratulated Arden Shore, the new Waukegan Library Trustee, Community Action: Payton Stewart and George Lawrence. Next, she spoke about liquor licenses and having consequences for those businesses selling liquor without a license.

Ald Hayes: Pass-No Comment.

Ald Bolton: She congratulated Trinity AME Church, constituent having block parties and acknowledged Brother Blanks and his organization for coming out. She shared and invited everyone to her Facebook page, "First Ward Dr. Alderman Sylvia Bolton" . She also shared her two phone numbers 847.390.2692 and 224.607.8445 where residents can reach her.

Ald Guzman: He congratulated Art Torres, Public Works Superintended for his 35 years of service and his retirement. He also thanked the Building Department for helping one of his residents with applying for a permit online and Public Works Director Garland for sending workers to fix craters. He shared he was upset about seeing speed bumps at the Harbor Place and spoke about garbage cans used for parking. Lastly, he spoke about elective officials raises and shared he is not supporting. Ald Felix suggested that City employees should say their names when answering phone calls.
