City of Waukegan City Council met Nov. 6.

The Council of the City of Waukegan met in regular session on Monday, November 6, 2023 at 7:08 PM

City Council Chambers, City Hall. 100 N. Martin Luther King Jr. Ave, Waukegan.

Mayor; Ann B. Taylor, Deputy City Clerk; David A. Patterson, City Treasurer; Dr. John R. Schwab, & Corporation Counsel; Stewart J. Weiss, were present.

City Clerk Janet E. Kilkelly, was absent.

1. Opening Items

Procedural: D. PROCLAMATION - “Hindu American Foundation Diwali Awareness Day - November 12, 2023” [This proclamation will be read into the record by: Yash Desai, Midwest Regional Director, Hindu American Foundation.]

3. Audience Time

Rodney Coleman: Coleman a disabled veteran who lives on the 200 Block Genesee. Coleman is having parking issues and can no longer park in the back of the building where Coleman resides. Coleman recently applied for a handicap spot, but the city could not help. Coleman was able to park at a handicap spot when Coleman spoke with Sgt. Rasmussen but continued to receive tickets. Coleman now has a 30-day termination letter from the apartment building, and believes is due to retaliation. Coleman thanked city staff Sgt. Rasmussen, Tyler from Planning and Zoning and Alderman Felix.

Chuck Rukstales: Waukegan resident. Rukstales spoke about the Lake County Concerts 70th year. Upcoming concert is happening November 20th at the CLC in Grayslake. Rukstales said that there was a scheduling conflict with the Waukegan location and invited the city council to attend. Rukstales spoke about having 5 concerts per year and its memberships. Rukstales also spoke about the landscape ordinance commercial properties exception, air quality and business owners following the landscape ordinance just like everyone else.

Antony Johnson: Resident of the 2nd ward- 11th Court. Johnson shared that people are dumping item on ditch located on his backyard. Johnson obtained helped from Ald Bolton but have not heard back from Ald Guzman and the Code Compliance inspector. Johnson said that 11th Court is also facing drug selling, illicit sex, unpaved streets and more. Johnson is asking the city for help.

Diane Verratti: Resident of Waukegan who has attended many meetings with different administrations. Verratti spoke about the current administration disagreements, dysfunctional, chaos, unpreparedness, holding items over and disrespectfulness. Verratti said it is painful to watch the meetings now and unnecessary because the current administration is not taking care of the city’s business. Verratti advised the elected officials to take their responsibility seriously of serving the community, respect the department heads, and overall do better because the people in Waukegan deserve better.

Karen Long McLoud: Resident of the 6th ward and a member of the Clean Power Lake County Steering Committee. Read a prepared statement regarding Parking Lot Landscaping exemptions for commercial properties and the tree preservation and landscape ordinance. McLoud shared objectives that are important for Waukegan that help health, sustainable communities and help with pollution. Also shared that tree in the commercial landscape have not being considered but trees help with things such as economic development, tourism, shoppers, air quality and more

Sue Sedar: Life long resident of Waukegan. Sedar spoke about Greenwood school traffic and her concerns about the kids in the area because there are cars speeding through the area. Sedar also shared that people do not obey the parking rules and she does not know what to do anymore as she has reached out to everyone and everyone in the area are scared.

Eddy Flores: Disappointed regarding the tree ordinance and the landscaping ordinance and how this is being handled by the elected officials. Flores spoke about the negative changes and the community impact. Flores said rushing the process and bypassing the UDO is reckless. Shared the burdens this will have on the residents. Flores mentioned that as part of Clean Power Lake County they have fought to ensure families live in a safe and healthy environment. Shared that the city suffers lack of green spaces. Requested for the ordinance to be opposed

Celeste Flores: Read from prepared comments on behalf of Dulce Ortiz who could not be in attendance this evening. Dulce is a longtime resident of Waukegan, member of the Clean Power Lake County Steering Committee and a Commissioner on the Illinois Environmental. Dulce’s comments talked about the amendment of the parking lot landscape for commercial properties and its negative effect. The financial burden on the city, its residents, and the fact that this process is being rushed and more. Comments also included the benefits of having trees. Requested for the ordinance to be opposed.

Angel Gonzales: Gonzales spoke about issues happening in Waukegan such as crime, speeding and business not following the rules. Gonzales said that forming a committee to further discuss the issues outside would be a good idea.

Clyde McLemore: McLemore said that the mayor is a bully to the citizens of Waukegan. Spoke about the city wanting to charge the school Wrap Around Center $650,000 for permit. McLemore shared that the School District refused to pay for these permits, the mayor refused to turn on their water. McLemore also shared that mayor wants to charge $250,000 for officers working at the district. McLemore spoke the mayor going after another black man’s business, Big Ed’s. McLemore said that they were fined by the city for having picnic tables. Told the mayor to stop going after the businesses.

Rayon Edwards: Edwards encouraged everyone to come to the meetings so that everyone can understand what is happening. Spoke about the School District Wrap Around Center working without permits and said that the city should fine them just like they do with any other business. Edwards spoke about Ald Turner receiving a speeding ticket. Edwards also spoke about the unpreparedness of the elected officials, Latino aldermen not advocating for the Latino Community and advised everyone to do their homework.

Margaret Carrasco: Carrasco spoke about the crime in Waukegan and said that all the mayor cares about generating revenue to pay for stupid spendings. Carrasco shared that this instance happens on communities with high population of minorities. Carrasco also spoke about mayor violating civil rights, potential constitutional concerns, intentional racism, disproportionate ticketing, political targeting and more. Mayor’s phone number is not listed on the city’s phone directory. Carrasco said that she applied for a business license two months ago, left messages and sent emails without a response back.

Action (Consent): New Business: H. Ordinance annexing certain territory contiguous to the City of Waukegan and approving an annexation agreement for 35704 N. Garrick Avenue. [This matter was presented to the Community Development Committee on November 6, 2023.]

Action (Consent): New Business: I. Ordinance approving Zoning Calendar #V-3-23, the Vacation of a Portion of the Right-of-Way South of Glen Flora Avenue, near 1207 Yeoman Street. [This matter was presented to the Community Development Committee on November 6, 2023.]

Ald Newsome shared that this item was amended in committee therefore, it is as amended. Ald Guzman asked if this amendment can still be added or will it be separate. Corporation Counsel Stew explained that the amendment that was recommended in committee was to reduce the compensation to be paid for the vacation from $1,142 down to $850.00.

Action: A. Motion by Ald Turner, second by Ald Bolton to approve Ordinance approving Zoning Calendar #2719, a Map Amendment (Rezone) for 2226 N. Northern Avenue from CR, Conservation/Recreation/Agriculture, to R1, Single-Family Residence. [This matter was presented to the Community Development Committee on August 7, September 5, and September 18, 2023.]

Ald Florian said she will recommend to approve this however, she wants the owner to understand the permit process and want him to make sure that the proper steps are taken by owner. Mayor Taylor spoke about having consequences if owner does not follow the ordinances and codes.

Action: B. Motion by Ald Florian, second by Ald Hayes to Override Mayoral Veto regarding Amendments to Salary Ordinance 23-O-288 [This item was held over at the October 16, 2023 City Council meeting]

Corporation Counsel spoke about the procedural point requiring 2/3 majority of the sitting aldermen therefore, six votes are required to override the mayor's veto. Mayor Taylor further explained that this is the ordinance involving the staff. After the vote was taken, Corporation Counsel explained that the ordinance does not come into effect and the previous ordinance that was amended stands.

Motion by Ald Florian, second by Ald Bolton to approve An Ordinance Amending the Waukegan Code of Ordinances Regarding the Waukegan Municipal Beach [This matter was presented to the Public Works & Infrastructure Committee on October 16, 2023 and was held over at the October 16, 2023 City Council meeting]

Ald Turner ask for clarification. Corporation Counsel read and the summarized the memo that was provided by the Lakefront Coordinator. Mayor Tylor further explained. Ald Guzman, proposed to have this amended and remove "The price for a daily parking permit will be $30.00 on the four official summer holidays: Memorial Day, Juneteenth, Fourth of July, and Labor Day." Ald Felix said that charging $30.00 is not bad. Ald Florian explained that the Police Officers were the ones to request this change because of the overwhelming demand on these holidays and agreed with Ald Felix to leave price as $30.00. Mayor Taylor spoke about the Waukegan beach becoming popular during COVID.

Ald Newsome shared that she wanted to amend to add live bands. Corporation Counsel Stew provided clarification. Discussion took place regarding the offense amounts and the proposed amendments.

Action: T. Motion by Ald Bolton, second by Ald Florian to Postpone Ordinance Amending Section 22-68 of the City Code Regarding Parking Lot Landscaping Requirements for Commercial Properties [This matter was discussed and recommended for approval by the Committee of the Whole at its October 19, 2023 meeting] first meeting in March 4, 2024.

Ald Bolton expressed that she would like this item to be held over. Ald Felix explained that that the plan was to hold this item over and change few things. Ald Florian spoke about trees, heat map and the presentation that was provided by Planning an Zoning. Ald Florian also mentioned a discrepancy on the agenda stating that this item was unanimously recommended for approval by the committee of the whole. Corporation Counsel Stew clarified that is was a split vote and it will be corrected. Ald Felix asked Stew to explain the changes happening. Stew explained. Ald Hayes spoke about letting the Planning and Zoning experts do their job and work together.

9. Closing Items

Alderperson Time

Ald Turner: Shared concerns regarding new trash can delivery from LRS, and how he is working to resolve concerns with duplexes. Urged Mayor to set up a Public Safety Committee. Spoke about speed humps and that a pilot project was agreed upon for 1st and 6th ward and has yet to happen. Asked that we investigate this and if need be, it can be run through the Public Works Committee. Shared helpful information regarding the Waste Management trash bins, and that residents should leave them out. In addition, he shared the leaf pick-up schedule for the 6th Ward.

Ald Donnenwirth: Spoke about leaf pick-up concerns in the 7th Ward, and asked residents to keep Waste Management trash bins at the curb to be picked-up.

Ald Florian: Shared gratitude to AAA for the grant the City of Waukegan received for speed signs, and shared how speed signs are beneficial. Thanked the Aldermen that supported holding over the Landscaping Ordinance until the UDO is complete.

Ald Hayes: Pass – No Comment.

Ald Bolton: Shared program information from the Waukegan Township, and gave a shout out. Thanked Public Works Department for their assistance in the 1st Ward Dumpster Clean-Up. Thanked Residents for attending. Shared dates for leaf pick-up, as well as rules and the phone number to Waste Management. Spoke about rezoning for Waukegan Housing on Lake Street and that the city should look into this matter.

Ald Guzman: Spoke about Mayoral Veto Ordinance that was on the agenda this evening, shared information on the discussion, and defended his efforts on the proposed ordinance. At this time, Ald Guzman made a motion to freeze salaries until April when the tiers and steps are fixed, second by Ald Felix. Corporation Counsel Weiss provided clarification on the proposed motion, which he stated is asking for an ordinance to be placed on a future agenda to amend the salary ordinance to freeze salaries until April when tiers and steps are fixed. Ald Guzman confirmed, and continued to explain his reasoning. Mayor Taylor shared that the information on salaries is all on the website. At this time, Mayor Taylor and Ald Guzman discussed. Mayor Taylor asked COS George Bridges Jr to respond. Ald Guzman stated he is speaking about management only. COS Bridges Jr stated everyone gets these step increases, and explained. Ald Guzman shared further detail about why he is bringing this forward. Mayor Taylor shared information. Ald Guzman and Mayor Taylor discussed. COS Bridges Jr shared there shouldn’t be any reason for punishment as these salaries were already budgeted. Corporation Counsel Weiss provided clarification on the budget and salary ordinance process. Corporation Cousnel Weiss reiterated the motion – Motion by Ald Guzman, second by Ald Felix to put an amendment to the salary ordinance at a future date. COS Bridges Jr asked if we could please have some further discussion outside of City Council before moving forward with this. Ald Guzman agreed, and withdrew his proposed motion, and will discuss with COS Bridges Jr. Ald Guzman stated to an audience member that he is more than reasonable, and if they smirk again, he won’t be. Ald Guzman continued his Aldermen Comments. Encouraged residents to use safety regarding snow plowing season, and to move out of the way so areas can be cleared. Shared concerns from residents regarding speeding, speed bumps, speed humps, rumble sticks, and would like to start the conversation. Asked residents to respect the stop signs on school buses, and use safety.

Ald Martinez: Thanked Pastor Richards for the invocation. Spoke in favor of the noise ordinance passed this evening, and looks forward to it being implemented. Shared information on leaf pick-up from Waste Management, and new can delivery from LRS. Asked everyone to please be patient. Encouraged residents to reach out to him should they have any questions, or reach out to Customer Service at LRS 844-633-3577. Shared a special welcome to a new business in Waukegan’s 3rd Ward, Master Sushi. Shared his phone number with residents – 847-390-2689. Asked residents to use caution when driving as it is getting dark earlier – be safe, be mindful and be good neighbors.

Ald Felix: Spoke about the proposed Parking Lot Landscape Ordinance, and shared the concerns he has regarding the ordinance, in particular the tree aspect, and spoke about $19,000 in funds that are just now being brought forward. Shared concerns with certain Aldermen and their strategies at City Council. Stressed that there have been no new trees brought forward, and that he is not against the environment and is all for new trees. Shared that he would like to see a balance with the city being pro-business. Claimed that ‘these guys’ [certain Aldermen] are shutting down discussion, and using scare tactics regarding Tree Ordinance. Spoke about Ramada concerns and Julian Tower concerns, and stated that the city is working towards safety on certain things. Stated we need to move forward and know how to use legislative rights, he is not a ‘yes person’. Thanked the principal at Washington Campus for reaching out to him regarding traffic concerns, and shared that he will attend a School Board Meeting with Alderman Martinez to address traffic issues. Called out Alderman Florian and shared that he feels she is using scare tactics regarding the environment, and raised how many trees have been planted in the amount of time that she has been Alderman. Praised certain newspapers for sharing both sides of the story and stated that a certain Spanish newspaper does not. Shared concerns regarding Ald Florian’s comments on limiting Alderperson Time – shared that he has a lot to say, and she might not. Continued to stress that Alderman Florian allegedly continues to use scare tactics. Ald Florian asked Mayor Taylor for an opportunity to respond. Mayor Taylor denied Ald Florian from responding.

Ald Newsome: Shared information regarding leaf pick-up. Shared helpful information regarding new LRS trash services. Stated that residents should reach out to LRS if they do not have their trash cans by November 21 at 844-633-3577. Asked residents to leave their old Waste Management bins at the curb for them to be picked up.

At this time, Mayor Taylor shared closing comments. Ald Newsome offered clarification regarding the tree fund discussion at Ald Felix Alderperson Time. Mayor Taylor continued her comments, before entertaining a motion to adjourn.
