I. Approval of Minutes

a. A motion was made by Commissioner O’Connell to approve the release of the minutes of the February 7, 2018 Board Meeting. The motion was seconded by Commissioner Saldana. The motion was unanimously approved.

II. Director’s Report

a. IL Liquor Control Commission partnered with the Federal Alcohol and Tobacco Tax and Trade Bureau (TTB) in Fall 2017 to look at practices taking place in the State of Illinois based on Pay for Play activities. In the coming months, we will see and announce the results of these investigations.

b. Michael Wukowitch was acknowledged for his work with the TTB and presented with a certificate.

c. The Illinois Liquor Control Commission voted to follow the recommendation of ILCC Executive Director to begin the process for modification of the Of Value Regulations following IL Liquor Control Commission Regulations through the Joint Committee on Administrative Rules process. A motion was made by Commissioner O’Connell to approve the Of Value Regulations. The motion was seconded by Commissioner Saldana. The motion was unanimously approved

III. Enforcement Division

a. The ILCC completed 177 SAM compliance checks, 32 failed. Twenty-two of the compliance checks were repeat violators, only 4 violated again. This gives a compliance rate of 82%.

b. The ILCC was present at Unofficial St. Patrick’s Day at the U of I campus. We worked in conjunction with the Champaign Police Department. The ILCC performed under-age compliance details as well as walk-thru checks of all campustown bar locations.

c. The ILCC anticipates 3 new LC-13 training partners in March, which will include 7 inspectors and 168 licensees to be inspected. These will be inspected by 6/30/2018.

d. From July 1, 2017 – January 31, 2018, LC-13 partners performed 2,476 inspections resulting in 723 licensees with violations and 1,105 total violations. This a compliance rate of 81%.

IV. Licensing Division

a. Dusanka Marijan stated that the percentage of online renewals is 78%. Mrs. Marijan also provided a report of all new licenses issued for February 2018.

b. Winery Shipper license applications have increased due to the Cease & Desist letters mailed earlier this year.

c. All licensees will soon receive an email notification indicating the liquor license is due for renewal. The emails will be sent 60 days in advance and again 30 days in advance of expiration.

d. Non-sufficient funds letters are now generated through Gentax. Licensees are given two weeks to remit payment.

V. Industry Education

a. The total number of BASSET applicants trained in February 2018 was 5,980.

b. The total number of trainees in the BASSET system is 247,172.

c. Cook County BASSET certification cards are approaching their expiration date and will need to be renewed. BASSET cards need to be renewed every 3 years.

d. Fifty-two counties are required to be BASSET certified by 7/1/2018.

e. The ILCC 2017-2018 Winter Newsletter will be emailed to approximately 45,000 individuals.

VI. Legal Division

a. Richton Liquors sent a Notice to Appear for an illegal importation case in front of the ILCC. After hearing from both parties, the Licensee and Chief Legal Counsel Sean O’Leary, the Commission took a brief recess. After the recess, Commissioner Saldana made a motion to approve a 10-consecutive day suspension and $10,000 fine. Motion was seconded by Commissioner O’Connell. Motion unanimously approved.

b. The Commission was asked to vote on a default Revocation for Club Suavee. Commissioner Saldana made a motion to approve the default Revocation. Motion was seconded by Commissioner O’Connell. Motion unanimously approved.

c. A deletion amendment of the October 18, 2017 approval to begin the process for rescission or modification IL Liquor Control Commission Regulations through the Joint Committee on Administrative Rules process affects the following Regulations.

1. 11 Ill. Adm. Code 100.275-Hotel/Motel Mini Bars and Room Service

2. 11 Ill. Adm. Code 100.310-Food Service at Park Districts

3. 11 Ill. Adm. Code Section 100.370-Procedures Before the Commission

VII. ALJ Recommendations

a. A motion was made by Commissioner O’Connell to approve the Administrative Law Judge tax recommendations. The motion was seconded by Commissioner Gibbons. The motion was unanimously approved.

VIII. Closing Remarks and Adjournment to Hearing

a. Commissioner O’Connell made a motion at 2:28P.M. to adjourn the meeting. Motion was seconded by Commissioner Pulido Sanchez. Motion unanimously approved.
