State of Illinois Human Rights Commission met Feb. 19.

I. Call to Order

A meeting of the Illinois Human Rights Commission Panel B was called to order on Wednesday, February 19, 2020 at 9:09 a.m. by Panel Chair Cantone.

Pursuant to the Illinois Open Meetings Act, 5 ILCS 120/1 et seq. and 775 ILCS 5/8-103 of the Illinois Human Rights Act, it was determined that:

1) All three Commissioners were physically present at the meeting.

II. Minutes -- January 29, 2020

Panel B adopted the minutes as submitted by staff. Motion made by Chair Ferg-Cadima; seconded by Commissioner Turner. Motion carried 3-0-0.

III. Requests for Review

A. Lisa Parker Gates, on behalf of J.G., a minor v. Francis W. Parker School

Charge No.: 2018CP2181 ALS No.: 19-0067

Panel B adopted the proposed order sustaining the Department’s dismissal of the charge for Lack of Jurisdiction. Motion made by Commissioner Turner; seconded by Chair Ferg-Cadima. Motion carried 3-0-0.

B. Medical Auxillary Network, Inc. vs. Prairie Winds of Saint Charles, LLC, Prairie Winds, LLC and PW Apartment Management, LLC

 Charge No.: 2019CH0704 ALS No.: 19-0197

Panel B adopted the proposed order sustaining the Department’s dismissal of the charge for Failure to Proceed. Motion made by Commissioner Turner; seconded by Chair Ferg-Cadima. Motion carried 3-0-0.

C. Darolyn Lee v. Mercy Hospital and Medical Center

Charge No.: 2018CP2109 ALS No.: 19-0380

Panel B adopted the proposed order vacating the Department’s dismissal of the charge, and remanded to the Department for entry of a finding of Substantial Evidence and further proceedings consistent with the order and the Act. Motion made by Commissioner Turner; seconded by Commissioner Cantone. Motion carried 3-0-0.

D. Kyle McAllister-Grum v. State of Illinois Office of the State Appellate Defender

 Charge No.: 2019CF2830 ALS No.: 19-0425

Panel B adopted the proposed order sustaining the Department’s dismissal of the charge for Lack of Substantial Evidence. Motion made by Commissioner Turner; seconded by Chair FergCadima. Motion carried 3-0-0.

E. Frank L. Amato v. Sysmex America, Inc.

 Charge No.; 2017CR1388 ALS No.: 19-0427

Panel B adopted the proposed order sustaining the Department’s dismissal of Count E of the charge for Lack of Jurisdiction, and Count H for Lack of Substantial Evidence. Motion made by Commissioner Turner; seconded by Chair Ferg-Cadima. Motion carried 3-0-0.

F. Amany Al-Hallaq v. County of DuPage, Department of Community Services

Charge No.: 2019CH0570 ALS No.: 19-0434

Panel B rejected the proposed order and vacated the Department’s dismissal of the charge, and remanded to the Department for entry of a finding of Substantial Evidence and further proceedings consistent with the order and the Act. Motion made by Commissioner Cantone; seconded by Chair Ferg-Cadima. Motion carried 3-0-0.
