City of Wheaton City Council met May 4.

1. Call to Order and Roll Call

The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess.

Upon roll call, the following were:

2. Citizens to Be Heard

Mr. Ben Waterman, 304 N. Scott Street, said he was attending regarding the property resubdivision item and was available if anyone had any questions.

3. Consent Agenda

Councilman Rutledge moved and Councilwoman Bray-Parker seconded that the following action be taken on the Consent Agenda items:

1. Approve the minutes of the April 20, 2020 regular Wheaton City Council meeting as submitted.

2. Adopt Resolution R-2020-37, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (222 E. Madison Avenue).

3. Adopt Resolution R-2020-38, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (106 E. Farnham Lane).

4. Pass Ordinance No. O-2020-17, An Ordinance Approving a Final Plat of Subdivision and Lot Depth Variations for Certain Property Commonly Known as 304 and 310 N. Scott Street – Waterman Councilman Zaruba moved and Councilwoman Robbins seconded that Ordinance No. O-2020-17, An Ordinance Approving a Final Plat of Subdivision and Lot Depth Variations for Certain Property Commonly Known as 304 and 310 N. Scott Street – Waterman, be passed.

City Manager Dzugan stated the City received a request for a re-subdivision and lot depth variations to allow the property owners to shift their shared property line five feet to the north for future construction of a garage expansion at 304 N. Scott Street.

5. Pass Ordinance No. 2020-18, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois

Councilman Rutledge moved and Councilman Barbier seconded that Ordinance No. 2020-18, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois, be passed.

City Manager Dzugan advised the proposed ordinance establishes pay ranges for the City’s non-union employees for the May 1, 2020 to April 30, 3021 period. He indicated the proposed ordinance includes changes to pay scales as a result of a salary study and merit range movement, both of which were included in the 2020 budget. City Manager Dzugan stated the third component contained in the 2020 budget was a 2% pay range adjustment which has not been included in the proposed ordinance.

Councilwoman Robbins stated she would like to amend the ordinance to provide for a 2% pay adjustment for the General Occupation Scale only and freeze other salary and merit increases.

City Attorney Knippen advised any motion would also need to suspend the requirements of Section C of Chapter 3 of the City’s Employee Manual which provides for salary increases. He stated the motion could also provide for the 2% increase and the freeze in other salary increases.

Councilwoman Robbins moved and Councilman Barbier seconded a motion to: suspend application of Chapter 3, Section C(1) the City of Wheaton Employee Manual; approve a 2% annual range adjustment increase effective May 1, 2020 for all non-union employees in the General Occupation Scale; freeze merit step increases in the General Occupation Scale; freeze merit and salary range increases for all other non-union employees in the Department Head Occupation and Managerial/Professional Occupation Scales; and reconsider the ordinance after further financial information is reviewed on July 6, 2020.

Councilmen Rutledge and Barbier expressed their agreement with the amendment.

Councilwoman Fitch clarified that the cost of living increase would only apply to the General Occupation Scale and not the management scales and the Council would revisit salary adjustments at their July 6 Council meeting.

Councilman Barbier questioned if the City would have sufficient information by July 6 to understand where the City stands with regard to revenues. Director Lehnhardt feels the July 6 date would provide adequate time to receive revenue information. City Manager Dzugan indicated he was less optimistic that the City would have information from the State about sales taxes and income taxes by July 6.

Councilwoman Robbins stated that if the City did not have sufficient information by July 6, that date could be pushed back. Councilwoman Bray-Parker feels that by July the City would have better information regarding what to do with the City’s reserves.

6. Pass Ordinance No. O-2020-19, An Ordinance Amending the Calendar Year 2019 Budget Contained in Ordinance No. O-2018-77

Councilwoman Fitch moved and Councilman Rutledge seconded that Ordinance No. O-2020-19, An Ordinance Amending the Calendar Year 2019 Budget Contained in Ordinance No. O-2018-77, be passed.

City Manager Dzugan stated the Finance Director described the budget amendments in his memorandum and that the amendments are based on the year end accounting entries.

7. Adopt Resolution R-2020-39, A Resolution Authorizing the Purchase of a Replacement Vehicle for Unit 80 Through the Sourcewell Joint Purchasing Program with Custom Truck One Source for a Total Amount Not to Exceed $157,472

Councilman Rutledge moved and Councilman Zaruba seconded that Resolution R-2020-39, A Resolution Authorizing the Purchase of a Replacement Vehicle for Unit 80 Through the Sourcewell Joint Purchasing Program with Custom Truck One Source for a Total Amount Not to Exceed $157,472, be adopted. City Manager Dzugan stated the proposed resolution authorizes the purchase of a replacement aerial bucket lift for the Forestry Division which is important to provide one of the City’s core services which is the annual trimming of parkway trees.

8. Council Comment

Councilwoman Fitch thanked the City’s employees for the work they are doing in providing services to the City’s residents; she stated it is great to see the state will allow curbside pickup and delivery for the City’s retail businesses; and indicated she is eager to see the Library also offer curbside service.

Councilwoman Fitch also stated she was eager to hear from the Wheaton Chamber of Commerce and the Downtown Wheaton Association and thinks the City should share information with residents regarding the economic impact on the community

Mayor Suess advised the Governor has extended the stay at home order to May 29. He advised the DuPage Mayors and Managers Conference is working with the Governor on opening more businesses while maintaining social distancing and no more than ten people in an area. Mayor Suess thanked the residents for their cooperation during this time and encouraged them to continue social distancing and avoiding large groups. He also encouraged people to wear face coverings when in confined areas such as stores as it is a smart thing to do out of courtesy when interacting with other people.

9. Approval of Warrant

Councilman Rutledge moved and Councilwoman Bray-Parker seconded that Warrant No. 775 in the amount of $714,405.50, be approved.
