Cook County state's attorney candidate O'Brien accuses incumbent of misusing power

Judge Pat O'Brien, a Cook County state's attorney candidate, said no one is above the law and this includes Kim Foxx.

"Equal treatment means that no one is above the law, and no one is beneath its protection," O'Brien said on his website. "That includes Kim Foxx."

O'Brien said that by giving special treatment to Jussie Smollett, a Hollywood celebrity, Foxx "unequivocally" misused her power. 

Not only is she misusing her power, but is lacking judgement and integrity, O'Brien said in his press release. 

"More than that, she displayed a lack of judgment and integrity, ignorance of the law, a capacity to lie and conceal, a betrayal of true victims of hate crimes, a willingness to sabotage the Chicago police, and proof that Foxx values her own self-interest above everyone else’s," he said in the press release. 

O'Brien highlighted five ways in which Foxx's behavior in Smollett's case isn't appropriate:

1) Foxx had tried to close the investigation into Smollett, while also displaying a lack of judgment.

2) When caught trying to end the investigation, Foxx said "she was recusing herself," which was a lie.

3) Foxx was attempting to control the case without anyone knowing.

4) Without informing police of the public, she tried to get all charges dropped in a secret deal.

5) When caught trying to make the secret deal, O'Brien wrote that she said "this type of deal happened all the time," but only provided weak evidence based on lies.

O'Brien concluded by saying her actions made it harder for the public to believe victims of actual hate crimes. 

"As we wait for Mr. Webb to complete his investigation, the question whether Kim Foxx offered special favors to Smollett seems clear," O'Brien said.
