Village of Cherry Valley Committee of the Whole met May 11.

Here is the minutes provided by the committee:

Village President Jim E. Claeyssen called the Committee of the Whole Meeting to order at 7:00 PM.

Roll call was taken by Deputy Village Clerk Heather Riley:

Also present: Public Works Director Chuck Freeman, Attorney Jim Stevens, and Deputy Village Clerk Heather Riley.

ADOPT THE AGENDA:

Trustee Schroeder moved to adopt the agenda. Trustee Hollembeak seconded. All “AYE;” None opposed. Motion carried by voice vote.

APPROVE THE COMMITTEE OF THE WHOLE MINUTES:

• Trustee Hollembeak moved to approve the April 27, 2020 Committee of the Whole Meeting Minutes. Trustee Belt seconded. All “Aye;” None opposed. Motion carried by voice vote.

• Trustee Hollembeak moved to approve the minutes from the April 21, 2020 Public Hearing minutes that were reconvened on April 28, 2020. Trustee Belt seconded. All “Aye;” None opposed. Motion carried by voice vote.

PUBLIC COMMENT: None.

ORDINANCE –CHAIRMAN TRUSTEE NANCY BELT.

CHAIRMAN’S REPORT: None.

UNFINISHED BUSINESS: None.

NEW BUSINESS:

1. Trustee Belt moved to send to the Village Board to waive the rules and consider this a second and final reading of “An Ordinance granting a Variance under Section 82-55 to Section 82-450 of the Code of Ordinances for the Village of Cherry Valley, Illinois to allow for a reduction of 32 parking stalls at the Northeasterly corner and the Southeasterly corner of the building for Menards (2001 South Perryville Road, Rockford, Illinois – Menards)”. President Claeyssen seconded. All “Aye;” None opposed. Motion carried by voice vote.

2. After some discussion, Trustee Belt moved to send to the Village Board, pending a revised Ordinance from Attorney Stevens with the added language, a motion that the Village Board waive the rules at the May 19th Village Board Meeting and consider this a second and final reading of “An Ordinance granting a Special Use Permit with conditions under Section 82-54 to Section 82-234 CC – Commercial Community District of the Code of Ordinances for the Village of Cherry Valley, Illinois to allow indoor and outdoor storage on the Southern portion of the property per the attached Site Plan for the property commonly known as 7243 Cherryvale North Blvd., Rockford, Illinois (Pack Stack & Store Inc.)”. President Claeyssen seconded. All “Aye;” None opposed. Motion carried by voice vote.

3. Trustee Belt moved to send to the Village Board to waive the rules and consider this a second and final reading of “An Ordinance granting a Variance under Section 82-55 to Section 82-234(c)(4) CC – Commercial Community District of the Code of Ordinances for the Village of Cherry Valley, Illinois to allow for a rear yard setback of 24’ from 25’ for the property commonly known as 7243 Cherryvale North Blvd., Rockford, Illinois (Pack, Stack & Store Inc.)”. President Claeyssen seconded. All “Aye;” None opposed. Motion carried by voice vote.

4. Trustee Belt moved to send to the Village Board to waive the rules and consider this a second and final reading of “An Ordinance granting a Variance under Section 82-55 to Section 82-234(c)(2) of the Code of Ordinances for the Village of Cherry Valley, Illinois to allow a fence on the Easterly lot line for a zero side yard setback for the property commonly known as 7243 Cherryvale North Blvd., Rockford, Illinois (Pack, Stack & Store Inc.)”. Trustee Alsbury seconded. All “Aye;” None opposed. Motion carried by voice vote.

5. Trustee Belt moved to send to the Village Board to waive the rules and consider this a second and final reading of “An Ordinance granting a Variance under Section 82-55 to Section 82-234(c)(2) of the Code of Ordinances for the Village of Cherry Valley, Illinois to allow a fence 16’ from the West lot line versus a 25’ side yard setback for the property commonly known as 7243 Cherryvale North Blvd., Rockford, Illinois (Pack, Stack & Store Inc.)”. Trustee Alsbury seconded. All “Aye;” None opposed. Motion carried by voice vote.

• Civil Engineer Sheri Kosmos submitted a report that will be placed on permanent file. UNFINISHED BUSINESS: None.

1. Project Updates:

• Ground work by our Public Works Crew for The 9-1-1 Memorial should be completed by the end of the week, then Officer Muraski can contact the concrete company so the concrete can be poured.

CHAIRMAN’S REPORT: No Report. EX-OFFICIO’S RECREATION BOARD REPORT:

1. Due to the COVID-19 situation the June 20, 2020 Movie Night has been cancelled. Trustee Alsbury states PUBLIC WORKS PASSES

Trustee O’ Hara states FINANCE PASSES

PLANNING AND DEVELOPMENT –CHAIRMAN TRUSTEE DAVID SCHROEDER

UNFINISHED BUSINESS: None.

NEW BUSINESS:

1. Trustee Schroeder stated that he met Mr. Aaron Ekberg and reviewed the village’s farmland to see the flooding issues. Trustee Schroeder stated that Aaron Ekberg showed him the areas that are ponding up in the middle of the fields and where the beaver dams have affected the usable land. After Trustee Schroeder visited the land himself, he and Aaron Ekberg met with Attorney Stevens at Village Hall. They discussed a conversation that Aaron Ekberg had with his boss, regarding what could be done to this land to make it farmable. Aaron Ekberg’s boss who works in excavation, told him that creating waterways would be the route to go. It will cost Aaron Ekberg around $40,000.00 to make these waterways. Tiling would not be an option to repair this land because it is so low, flat, and right next to the river. In order for tiling to work you need some slope to the land to get the water to move. The tentative agreement that is on the table currently is Aaron Ekberg will be paying the taxes for the land and will create the water ways in the fields to make them more effective, at his own cost, and then charge him $150.00 per acre for 150 acres total. After additional discussion, Attorney Stevens and Trustee Schroeder will present a contract at the Village Board Meeting for possible approval.

Trustee Hollembeak moved that the meeting be adjourned at 8:10 PM. Trustee Belt seconded. All “Aye;” None opposed. Motion carried by voice vote.
