Village of Cherry Valley Committee of the Whole met June 22.

Village President Jim E. Claeyssen called the Committee of the Whole Meeting to order at 7:00 PM.

Roll call was taken by Deputy Village Clerk Heather Riley:

Also present: Public Works Director Chuck Freeman, Attorney Jim Stevens, Attorney Roxanne Sosnowski, Chief Robert Swank and Deputy Village Clerk Heather Riley.

ADOPT THE AGENDA:

Trustee Hollembeak moved to adopt the agenda. Trustee O’Hara seconded. All “AYE;” None opposed. Motion carried by voice vote.

APPROVE THE COMMITTEE OF THE WHOLE MINUTES – June 8, 2020

Trustee Fustin moved to approve the June 8, 2020 Committee of the Whole Meeting Minutes. Trustee Schroeder seconded. All “Aye;” None opposed. Motion carried by voice vote.

PUBLIC COMMENT: None.

ORDINANCE –CHAIRMAN TRUSTEE NANCY BELT. 

CHAIRMAN’S REPORT: None.

PUBLIC WORKS – VILLAGE PRESIDENT CLAEYSSEN FOR CHAIRMAN TRUSTEE JIM ALSBURY.

ENGINEER’S REPORT:

• Engineer’s Report submitted by Village Engineer Sheri Kosmos and placed with the permanent file.

UNFINISHED BUSINESS: None.

NEW BUSINESS:

1. Village Attorney Stevens stated that he is still waiting for one more easement and has been going back and forth with Mr. Patrick Holland, who is the principle for the Mango Creek Development Cherry Valley LLC, which is the owner of the property where an easement is needed. The document will be sent to Thailand tomorrow which is where Mr. Holland currently is, and it typically takes him 2-3 days to get back to us (the Village). The easement is for a twenty foot (20’) in depth temporary construction easement as well as a twenty foot (20’) in width water main easement along the property.

2. Village President Claeyssen moved to send to the Village Board for approval a Design Engineering Agreement with C.E.S. Inc. for ADA curb and sidewalk improvements/updates in our Newburg Village and Valley Woods Neighborhoods at a cost of $13,000.00 from line item 5095 Capital Improvements. Motion seconded by Trustee Hollembeak. Motion carried by 4 “AYES” with 1 “NAY” voice vote.

DIRECTOR’S REPORT:

1. Project Updates:

• The new fence is now installed at the old school property and lawn restoration to be completed by July 3, 2020. 

CHAIRMAN’S REPORT: No Report.

EX-OFFICIO’S RECREATION BOARD REPORT:

Trustee Schroeder stated that the next Recreation Board Meeting will be held July 29, 2020 at 7:00 PM. All are welcome to attend.

FINANCE – CHAIRMAN TRUSTEE JEFF O’HARA.

NEW BUSINESS:

1. After some discussion, Trustee O’Hara moved to send the Comcast Franchise Agreement that was reviewed by Attorney Stevens to the July 7, 2020 Village Board Meeting for approval. Trustee Hollembeak seconded.

2. The committee discussed the Addendum Contract with Melrose Pyrotechnics, INC for the July 4th 2020 Fireworks display. The Village is required to pay 50% ($11,500.00) of the contract which will be applied as a deposit for the 2021 fireworks display from line item 5360A -Tourism. Melrose Pyrotechnics has explained that if the Village decides to put on a fireworks show this calendar year, and the Village gives them a 30-day notice that Melrose Pyrotechnics could still put the show on for the Village, and would only pay the other half owed. Trustee O’Hara moved to send to the Village Board for approval of an Addendum Contract with Melrose Pyrotechnics, INC. regarding our July 4th Fireworks. Trustee Hollembeak seconded.

EXECUTIVE SESSION:

Trustee O’Hara moved that the Committee of the Whole go into Executive Session for the following reasons:

(5 ILCS 120/2) (C)(1) (Personnel Matters) The appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body or legal counsel for the public body, including hearing testimony on a complaint lodged against an employee of the public body or against legal counsel for the public body to determine its validity.

(5 ILSC 120/2) (C)(11) (Pending Litigation) Litigation, when an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent, in which case the basis for the finding shall be recorded and entered into the minutes of the closed meeting. Trustee Hollembeak seconded. A roll call vote was taken:
