City of Wheaton City Council met Oct. 5.

1. Call to Order and Roll Call
The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

2. Presentations
Mayor Suess presided over a Police promotion/swearing-in ceremony for Officer Patricia Potter’s promotion to Sergeant following remarks by Chief Murphy.
Mayor Suess read and presented a proclamation to Ms. Larniecia Smith and Mr. Tony Asta of the City’s Community Relations Commission proclaiming Saturday, October 24, 2020 as “Make a Difference Day” in Wheaton. Ms. Smith thanked the Council for the proclamation. Mr. Asta thanked the community for their participation and generosity in this important event.
Ms. Jennifer Merck, President, student Excellence Foundation, stated their foundation engages in activities to help District 200 students meet their potential. She stated they initiated a Food Insecurity Fund this year and have provided over 6,000 food boxes to local food pantries. Ms. Merck stated they have also started a fund for essential needs for students to provide winter weather gear and learning enrichment.
Mayor Suess read a proclamation proclaiming October 25, 2020 as “World Polio Day” in Wheaton in recognition of the efforts of the Rotary Club of Wheaton and the Rotary Club of Wheaton A.M. to eradicate polio throughout the world.
Ms. Kaitlyn Wild, President, Rotary Club of Wheaton A.M., thanked the Mayor and City Council for recognizing the efforts of Rotarians worldwide to eradicate polio. She stated polio has now been kicked out of all 47 countries in Africa and only Pakistan and Afghanistan are experiencing cases.

4. Consent Agenda
Councilman Barbier moved and Councilwoman Bray-Parker seconded that the following action be taken on the Consent Agenda items:
1. Approve the minutes of the September 21, 2020 regular Wheaton City Council meeting as submitted.
2. Adopt Resolution R-2020-85, A Resolution Authorizing the Disposal of Certain Surplus Property (PW).
3. Adopt Resolution R-2020-86, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (1957 Chatham Drive).
4. Approve City Manager Compensation.
5. Adopt Resolution R-2020-87, A Resolution Approving Bucky’s Express Plat of Consolidation and Vacation of Easement.
6. Adopt Resolution R-2020-78, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (1210 W. Thomas Road).
7. Adopt Resolution R-2020-85, A Resolution Authorizing the Disposal of Certain Surplus Property (IT).

Approve Appointment/Reappointments to City Boards and Commissions Mayor Suess moved and Councilman Rutledge seconded that David Duve be appointed to the Fine & Cultural Arts Commission, Chris Ellerman be reappointed to the Group Care Home Commission and Emelie Engling be reappointed to the Historic Commission, all for three-year terms.

6. Pass Ordinance No. O-2020-33, An Ordinance Authorizing a Protective Fence – St. Michael Parish – 317 W. Willow Avenue
Councilman Rutledge moved and Councilwoman Robbins seconded that Ordinance No. O-2020- 33, An Ordinance Authorizing a Protective Fence – St. Michael Parish – 317 W. Willow Avenue, be passed.
City Manager Dzugan advised the City received a request from St. Michael Parish to install a 4- foot black aluminum fence to protect an area the church is using for outdoor play at 317 W. Willow Avenue. He stated City Code allows a 3-foot fence but allows institutions to petition the Council for authorization to install a higher protective fence.

7. Adopt Resolution R-2020-90, A Resolution Authorizing the Execution of Agreement No. 151 with CHC Wellbeing for Wellness Services for a Total Amount Not to Exceed $34,500 and Authorizing the Execution of Exhibit E (Business Associate Agreement) to Agreement No. 151 Councilwoman Fitch moved and Councilman Barbier seconded that Resolution R-2020-90, A Resolution Authorizing the Execution of Agreement No. 151 with CHC Wellbeing for Wellness Services for a Total Amount Not to Exceed $34,500 and Authorizing the Execution of Exhibit E (Business Associate Agreement) to Agreement No. 151, be adopted.
City Manager Dzugan stated the City’s current vendor for wellness services went out of business. He advised City received two bids for these services and staff believes the program and services offered by CHC Wellbeing best meets the City’s needs.

Councilwoman Bray-Parker moved and Councilwoman Robbins seconded that Resolution R 2020-91, A Resolution Authorizing the Purchase of a Skid Steer Loader Through the Omnia Partners Joint Purchasing Program with Altorfer Caterpillar for a Total Amount Not to Exceed $51,750, be adopted.
City Manager Dzugan indicated this is a new, larger skid loader being added to the City’s fleet which will assist in Downtown snow removal operations. He stated the larger unit is necessary due to larger sidewalk and amenity zones which leave less space for snow to be piled on.

9. Council Comment
Councilwoman Bray-Parker feels the Wheaton Library has done a great job with programming during COVID and encouraged residents to check out their on-line programming.

Councilman Rutledge moved and Councilwoman Fitch seconded that Warrant No. 785 in the amount of $684,724.39, be approved.
