City of Wheaton City Council met April 19.

The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

Councilwoman Robbins moved and Councilman Rutledge seconded that the following action be taken on the Consent Agenda items:
1. Approve the minutes of the April 5, 2021 regular Wheaton City Council meeting as submitted.
2. Adopt Resolution R-2021-24, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (730 Dawes Avenue).
3. Adopt Resolution R-2021-25, A Resolution Approving Beyer’s Plat of Consolidation (815 and 819 E. Indiana Street).
4. Adopt Resolution R-2021-26, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (312 N. West Street).
5. Adopt Resolution R-2021-27, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (42 Citation Circle).

4. Pass Ordinance No. O-2021-14, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois
Councilwoman Bray-Parker moved and Councilwoman Fitch seconded that Ordinance No. O-2021-14, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois, be passed.
City Manager Dzugan stated the proposed ordinance amends the City’s pay schedules for the 2021/22 year for employees not in collective bargaining units. He indicated the adjustments being made are in large part to make the City’s pay scales competitive with other communities.

Mayor Suess moved and Councilman Rutledge seconded that John Dalby be reappointed to the Band Commission and Cathy Coleman be reappointed to the Environmental Improvement Commission, each for a three-year term and the following be reappointed to the Bicycle Advisory Commission for staggered terms: Nancy Allured and Jim Knasel, each for a one-year term, Rita Nathanson and Bill Nieman, each for a two-year term and Michelle Dunlap and Laurel Salvador, each for a three-year term.

Roosevelt Road – St. Sophia’s Forgotten Felines”
Councilman Rutledge moved and Councilman Zaruba seconded that Ordinance No. O-2021-15, An Ordinance Authorizing an Extension of Time on the Validity of Ordinance No. O-2019-38 – “An Ordinance Granting a Special Use Permit to Allow the Construction, Operation and Maintenance of a Cat Adoption Agency on Property Commonly Known as 525 W. Roosevelt Road – St. Sophia’s Forgotten Felines,” be passed.
City Manager Dzugan reported the City received a letter requesting an extension of time for the property a 525 W. Roosevelt Road due to delays caused by COVID-related issues. He stated the current special event permit, approved in August 2019, is valid for a period of 12 months.
Ms. Nadia Bardock, a volunteer at the agency, thanked the Council for granting the extension.

Councilman Barbier recused himself at 7:08 p.m. from discussion on Planning & Zoning Board Report Re: ZA #21-05/Corner Side Yard Setback Variation/1928 Stoddard Avenue/Karlovitz due to a possible conflict of interest.
8. Receive Planning & Zoning Board Report Re: ZA #21-05/Corner Side Yard Setback Variation/1928 Stoddard Avenue/Karlovitz
Councilwoman Fitch moved and Councilwoman Robbins seconded that the Planning & Zoning Board Report Re: ZA #21-05/Corner Side Yard Setback Variation/1928 Stoddard Avenue/Karlovitz, be received.
City Manager Dzugan advised this property is within Unincorporated DuPage County but is within the City’s planning jurisdiction. He stated the property owner is seeking a corner side yard setback variation from the County. City Manager Dzugan stated the Planning & Zoning Board reviewed the request and unanimously recommended approval, subject to some conditions. He stated staff is asking the Council to receive the report and authorize the Mayor to sign the comment card provided by DuPage County in support of the request, per the conditions set forth by the Planning & Zoning Board that the existing play structure not be relocated to the front yard and landscaping is installed and maintained per the submitted landscape plan.

9. Adopt Resolution R-2021-28, A Resolution Authorizing the Execution of Purchase Order No. 2022049 with Kaneville Tree Farms, Inc. for the Purchase of Trees for Phase 4 of the Downtown Streetscape Project for a Total Amount Not to Exceed $42,330
Councilman Barbier moved and Councilwoman Fitch seconded that Resolution R-2021-28, A Resolution Authorizing the Execution of Purchase Order No. 2022049 with Kaneville Tree Farms, Inc. for the Purchase of Trees for Phase 4 of the Downtown Streetscape Project for a Total Amount Not to Exceed $42,330, be adopted.
City Manager Dzugan indicated the Assistant City Manager has recommended the purchase of 75 hand selected trees for the Phase 4 streetscape work from Kaneville Tree Farms. He confirmed the City’s purchase and selection of the trees as opposed to the contractor doing so will save the City significant money, as well as ensuring the City is getting high quality trees.

10. Council Comment
Councilwoman Fitch expressed her appreciation for the service of Councilman Rutledge and Councilman Zaruba on the City Council. She stated she was grateful for expertise and leadership Councilman Rutledge has brought to the Council. She thanked Councilman Zaruba for stepping in to fill a vacancy on the Council and for the expertise he brought to Council discussions. Councilwoman Fitch thanked them for the excellent job they each did on behalf of their constituents.
Councilman Barbier read a quote from Joe Maggio on why he hustled when a play would not make a difference, to which he replied it was because someone might be watching for the first time. Councilman Barbier thanked both Councilman Rutledge and Councilman Zaruba for bringing their best to the Council and Wheaton residents.
Councilwoman Robbins thanked Councilman Rutledge for all he had done for her and the community. She thanked Councilman Zaruba for his service on the Council and expressed her pleasure in working with him.
Councilwoman Bray-Parker thanked Councilman Zaruba for his service on the Council and the opportunity to work with him. She thanked Councilman Rutledge for his mentorship and leadership.
Councilman Rutledge stated the rumors of his demise are greatly exaggerated as he intends to remain a part of the community. He stated his goals, when interviewed to serve on the Council, were financial investment, economic development and infrastructure. He thanked City staff for executing his vision and expressed his appreciation for such a terrific organization. He said it has been an honor to serve on the City Council for the past ten years.
Councilman Zaruba expressed his appreciation for the opportunity to serve the residents of Wheaton as a member of the City Council and for the opportunity to work with such a terrific organization.
Mayor Suess shared the comments from the City Council and thanked both Councilman Rutledge and Councilman Zaruba for their service to the community. He commented on the fact that in ten years, Councilman Rutledge never had a contested election. He presented Councilman Rutledge with a photo collage which depicted his service and involvement in the community, as well as gift card to a local restaurant.
Mayor Suess thanked Councilman Zaruba for getting involved with the Council and for the insight he brought to Council discussions and decisions. He presented Councilman Zaruba with a plaque expressing appreciation for his service and a gift card to a local restaurant.
11. Approval of Warrant
Councilman Rutledge moved and Councilwoman Fitch seconded that Warrant No. 798 in the amount of $1,888,517.44 be approved.
