City of Wheaton City Council met Nov. 1.

Here are the minutes provided by the council:

1. Call to Order and Roll Call The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

2. Citizens to be Heard None. 

3. Consent Agenda Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on the Consent Agenda items: 

Approve the minutes of the October 18, 2021 regular Wheaton City Council meeting as submitted.

4. Pass Ordinance 0-2021-49, An Ordinance Amending the Wheaton Liquor Control Ordinance, Chapter 6, Article Ill of The City Code – Increase in Class A (Restaurants) Liquor License 302 Wheaton, LLC DBA 302 Wheaton 401 Town Square Wheaton Councilwoman Robbins moved and Councilwoman Bray-Parker seconded Ordinance 0-2021-49, An Ordinance Amending the Wheaton Liquor Control Ordinance, Chapter 6, Article III of The City Code - Increase in Class A (Restaurants) Liquor License 302 Wheaton, LLC DBA 302 Wheaton 401 Town Square Wheaton, be passed. 

City Manager Dzugan stated the Liquor Control Commission unanimously recommended approval for retail sale on the premises as well as within the courtyard area of 401 Town Square. 

Councilwoman Fitch feels 302 Wheaton will be an excellent addition as well as a great investment in the Town Square area.

Councilman Weller recused himself at 7:04 p.m. from the discussion and vote on Regular Business Item No. 2, An Ordinance Authorizing an Extension of Time and Minor Architectural Plan Changes to Ordinance No. 0-2018-29 – “An Ordinance Granting a Special Use Permit and A Rear Yard Setback on a Certain Piece of Property Commonly known as 1004 Wheaton Place – Eddy" due to a potential conflict of interest. 

5. Pass Ordinance 0-2021-50, An Ordinance Authorizing an Extension of Time and Minor Architectural Plan Changes to Ordinance No. 0-2018-29 – “An Ordinance Granting a Special Use Permit and A Rear Yard Setback on a Certain Piece of Property Commonly known as 1004 Wheaton Place - Eddy" Councilman Brown moved and Councilwoman Fitch seconded that Ordinance 0-2021-50, An Ordinance Authorizing an Extension of Time and Minor Architectural Plan Changes to Ordinance No. 0-2018-29 - “An Ordinance Granting a Special Use Permit and A Rear Yard Setback on a Certain Piece of Property Commonly known as 1004 Wheaton Place – Eddy”, be passed. 

City Manager Dzugan stated the Ordinance approves the extension of time for a special use permit and rear yard setback to allow both construction and a smaller sized garage at 1004 Wheaton Place.

Councilman Weller rejoined the meeting at 7:05 p.m. 

6. Receive Planning & Zoning Board Report Re: ZA#21-23 / Side Yard Setback Variation / 301 W. Oak Avenue / Western Dupage Landscaping, Inc. Councilman Barbier moved and Councilwoman Robbins seconded to receive the Planning & Zoning Board Report Re: ZA#21-23 / Side Yard Setback Variation / 301 W. Oak Avenue / Western Dupage Landscaping, Inc. 

City Manager Dzugan stated the report from the Planning and Zoning Board recommended the approval of a variation from the interior side yard setback requirement which would allow a .5-foot setback rather than the required 6-foot setback.

Pass Ordinance O-2021-51, An Ordinance Granting an Interior Side Yard Setback Variation on a Certain Piece of Property Commonly known as 301 W. Oak Avenue - Western Dupage Landscaping, Inc. Councilman Barbier moved and Councilman Brown seconded that Ordinance O-2021-51, An Ordinance Granting an Interior Side Yard Setback Variation on a Certain Piece of Property Commonly known as 301 W. Oak Avenue - Western DuPage Landscaping, Inc., be passed.

7. Council Comment Councilman Barbier shared his enjoyment of the pleasant Halloween weather. He noted Downtown Glen Ellyn closed some streets for their Trick-or-Treating event. 

Mayor Suess called attention to the City of Wheaton's ranking on WalletHub's recent publication of the Best Small Cities in America. He stated Wallethub's study reviewed over 1,300 small cities with populations between 25,000 and 100,000 people. He highlighted Wheaton being in the top three of only 5 cities in Illinois and ranking #59 nationally. 

8. Approval of Warrant Councilwoman Fitch moved and Councilman Brown seconded that Warrant No. 811 in the amount of $3,457,362.65 be approved.
