City of Wheaton City Council met March 7.

1. Call to Order and Roll Call The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

2. Presentations Mayor Suess presided over the police officer's swearing-in ceremony for Officer Justin Isaac and Officer Jorge Sanchez following remarks by Chief of Police William Murphy.
Mayor Suess read and presented a proclamation recognizing the 110th anniversary of Girl Scouts to first grade Daisy Girl Scout Troop 56434 and their leader Noel Wiedman from St. Michael Parish School. Ms. Wiedman spoke on behalf of Troop 56434 and thanked the Mayor and City Council.
3. Citizens to be Heard Mr. Steve Fixler, 1102 E. Willow Ave., announced the upcoming VA S.A.V.E. training event on Thursday, April 21, 2022, from 6:30 p.m. to 8:00 p.m. at the American Legion Post #76, 570 S. Gary Ave., Carol Stream presented by the DuPage County Veteran Suicide Prevention Coalition. Mr. Fixler stated the Veteran's suicide prevention presentation is open to the public and all are welcome to attend.
4. Consent Agenda Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on the Consent Agenda items:
1. Approve the minutes of the February 22, 2022 Wheaton City Council Regular Meeting as submitted.
2. Pass Ordinance 0-2022-08, An Ordinance Amending the Wheaton Liquor Control Ordinance, Chapter 6, Article III of the City Code – Decrease in the Number of Class O and I (Manufacture of Beer and Restaurant) License (Emmett's WT LLC D/B/A Emmett's Brewing Co. 121 W. Front Street).

6. Pass Ordinance No. 0-2022-09, An Ordinance Amending City of Wheaton Ordinance No. F-1843 “An Ordinance Authorizing the Signing of an Annexation Agreement - Vacant Lot Located Just North of 1970 North Gary Avenue – Bergo, Inc. - Rebecca Lingo" To Allow Improvements on 1960 N. Gary Ave Councilwoman Fitch moved and Councilwoman Robbins seconded that Ordinance No. 0-2022-09, An Ordinance Amending City of Wheaton Ordinance No. F-1843 “An Ordinance Authorizing the Signing of an Annexation Agreement - Vacant Lot Located Just North of 1970 North Gary Avenue - Bergo, Inc. - Rebecca Lingo" To Allow Improvements on 1960 N. Gary Ave, be passed.
City Manager Dzugan specified the proposed ordinance amends an annexation agreement dated January 5, 2015, to permit two small additions on the rear of the existing building and the installation of a 4-foot-high open fence to enclose a new outdoor play area. City Manager Dzugan clarified city code permits the amendment without a public hearing as the changes are minor.

In response to property owner, Mr. Peter Savenok, 17W300 22nd St., Oakbrook Terrace, City Manager Dzugan clarified staff's recommendation for referral to the Planning and Zoning Board for public hearing is to obtain feedback from the public as the property abuts to residential property.

8. Adopt Resolution R-2022-17, A Resolution Authorizing the Execution of Agreement No. 278 with Schroeder & Schroeder, Inc. for the 2022 Spring New Sidewalk Program for a Total Amount Not to Exceed $570,826.65. Councilwoman Robbins moved and Councilman Barbier seconded that Resolution R-2022-17, A Resolution Authorizing the Execution of Agreement No. 278 with Schroeder & Schroeder, Inc. for the 2022 Spring New Sidewalk Program for a Total Amount Not to Exceed $570,826.65, be adopted.
City Manager Dzugan detailed the agreement for construction is specific to part one, spring construction, of the City's New Sidewalk Program.
In response to Councilwoman Bray-Parker, Assistant City Manager Duguay explained approximately 325 notices were mailed to residents on both sides of affected streets.
Mayor Suess noted the City's significant progress towards their goal of having one sidewalk on at least one side of every street. Director of Engineering Tebrugge confirmed 11,000 feet of new sidewalk will be completed in both the Spring and Fall for a near total of four miles of sidewalk.

City Manager Dzugan confirmed the existing water main system that runs through Danada Square East and West had experienced several breaks potentially due to acidic soils.
In response to Mayor Suess, Director of Engineering Tebrugge clarified the water mains were constructed prior to the use of protective measures such as propylene bags as protection from adverse soil conditions.

10. City Manager Dzugan detailed the purchase will allow for the replacement of approximately 20% of current desktops and laptops with the remaining be completed over the next few years prior to the end of support date for Windows 10.

11. Adopt Resolution R-2022-20, A Resolution Authorizing the Execution of a Side Letter Agreement and 3rd Amendment to Intergovernmental Agreement Between the Wheaton Sanitary District and the City of Wheaton for the Construction of a Water Main Related to the Sanitary District's North Side Interceptor Sewer Project Councilwoman Fitch moved and Councilwoman Robbins seconded that Resolution R-2022-20, A Resolution Authorizing the Execution of a Side Letter Agreement and 3rd Amendment to Intergovernmental Agreement Between the Wheaton Sanitary District and the City of Wheaton for the Construction of a Water Main Related to the Sanitary District's North Side Interceptor Sewer Project, be adopted.
City Manager Dzugan stated the agreement allows the opportunity to benefit from a cost-effective approach to replace the water main on Pin Oak Court by utilizing the Wheaton Sanitary District's contractor. He confirmed the Pin Oak water main has been on the City's radar for replacement as it has experienced a numerous breaks prior to the Sanitary District's work.
In response to Councilman Barbier, Director Tebrugge confirmed there would be the required ten-foot separation between the sanitary and water pipes.

12. Approve Downtown Wheaton Association 2022 Budget Amendment. Councilman Barbier moved and Councilwoman Bray-Parker seconded that the Downtown Wheaton Association 2022 Budget Amendment be approved.
City Manager Dzugan detailed the Special Service Area Eight Agreement provides for Council to approve any amendments to the budget.
Allison Orr, Executive Director for the Downtown Wheaton Association, confirmed the bottom line remains unchanged along with updates to revenue and expenses. Executive Director Orr detailed specific to revenue, the plan to obtain larger sponsors in lieu of many small sponsors as well as a new online gift card process. She highlighted the removal of low performing events and proposal of new events, such as Parents Nights geared towards young families offering the opportunity for childcare to allow for Downtown shopping and dining. She highlighted upcoming events such as Small Business Saturday, 25 days of Christmas, Winter Wonder Fest, the return of the Chili Cook Off and a new Southside Spring Event in effort to better support Southside Businesses.

13. First Reading of An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 34 - Stormwater Management Regulations In response to Mayor Suess, Director of Engineering Tebrugge explained the first ordinance change relates to the design storm overflow to account for updates using DuPage County's Bulletin 75 for consistency. Director Tebrugge detailed the second change is specific to overflow weir detail design and implementation as well as clarification on certain design parameters.
14. Council Comment Councilwoman Bray-Parker encouraged public participation in some of the many programs and celebrations offered in the community hosted by the DuPage County Historical Association, Wheaton Public Library, League of Women Voters, Habitat for Humanity and Local Schools related to International Women's Day.
Councilman Barbier recounted Franklin Middle School's 9th year of the 2022 Dodgeball Tournament Local Heroes Night organized by Assistant Principal Joe Kish. He highlighted the event raised $15,000 for the DuPage Care Center Foundation.
In honor of Women's Day and Women's Month in March, Mayor Suess, acknowledged the eleven women who have served in Wheaton City Council since 1962; when the City began the Council/Manager form of government.
15. Approval of Warrants Councilwoman Fitch moved and Councilman Barbier seconded that Warrant No. 819 in the amount of $994,408.80 be approved.
