City of Wheaton City Council met April 4.

2. Presentations
Mayor Suess read and presented a proclamation recognizing the Gnarly Llamas of Wonder, GLOW, for winning the FIRST Lego League Illinois State Championship. Gnarly Llamas of Wonder members, Luci, Sonora, June and Nooriya, accepted the proclamation and presented a slide show to demonstrate their winning robotic entry.
Mayor Suess read and presented a proclamation to Mr. Ted Witte, Chair of the Environmental Improvement Commission proclaiming Earth Year 2022 in Wheaton. Mr. Witte thanked the Mayor and City Council and reminded everyone of upcoming events hosted by the Environmental Improvement Commission.

Councilman Barbier moved and Councilwoman Bray-Parker seconded that Ordinance No. 0-2022-13, An Ordinance Granting a Special Use Permit for a Nursery School and a Planned Unit Development to Allow the Construction and Use of Two Commercial Buildings on Certain Property Commonly known as 222 and 250 E. Roosevelt Rd. - Quattro Development, LLC - CALC Holdings, LLC, be passed.
City Manager Dzugan stated the City Council held a public hearing on March 28, 2022 to consider the Special Use Permit for the construction of two commercial buildings at the southwest corner of Naperville and Roosevelt Roads.

7. Adopt Resolution R-2022-27, A Resolution Authorizing the Execution of Amendment #1 of Agreement No. 117 Between the City of Wheaton, Illinois and Metro Paramedics, Inc. for Paramedic Services and Emergency Medical Services ("EMS”) Billing Services
Councilwoman Fitch moved and Councilman Brown seconded that Resolution R-2022-27, A Resolution Authorizing the Execution of Amendment #1 of Agreement No. 117 Between the City of Wheaton, Illinois and Metro Paramedics, Inc. for Paramedic Services and Emergency Medical Services (“EMS”) Billing Services, be adopted.
City Manager Dzugan stated the amendment increases the current contract by approximately $300,000 per year for the remaining three years. He specified the entire increase will be allocated to the increase of salaries for contracted paramedic employees. He stated staff will complete a cost recovery analysis in the 2nd quarter of 2023 to determine if the Council's established 90% recovery metric is being met.

8. Adopt Resolution R-2022-28, A Resolution Authorizing Service Credit in the Illinois Municipal Retirement Fund for Military Service
Councilwoman Robbins moved and Councilman Weller seconded that Resolution R-2022-28, A Resolution Authorizing Service Credit in the Illinois Municipal Retirement Fund for Military Service, be adopted.
Councilman Barbier added clarification that IMRF required up to four years or none. Mayor Suess added the resolution expands the group eligible to buy back military service credit as it was previously offered only to police officers and fire fighters.

9. First Reading of An Ordinance Amending the Pay Schedules for Officers, Assistants, and Employees of the City of Wheaton, Illinois City Manager Dzugan specified the Ordinance would amend the pay schedules for the 2022/2023 year for employees not in collective bargaining units. He stated the adjustments are being suggested primarily to keep the City's pay scales competitive.
Director of Human Resources Holly Schulz stated a 2.5% range adjustment is recommended by staff following the department's annual review of the City's Compensation Plan and market factors including Employment Cost Index, CPI and City union wage increases. Director Schulz detailed the Employment Cost Index when reviewed in 2021 rose 4%, whereas in February 2022 it rose 7.9%. She detailed the unions' increases over last five years averaged 2.35%, whereas nonunion averages over last five years were 1.95%. Director Schulz detailed both General scale and part time employees will receive the 2.5% increase effective May 1st, and step movement provided an acceptable performance review, whereas the Department Head open range will be adjusted on May 1st, and they will be eligible for a 0-4% increase, based on their rating, at the time of their annual performance reviews.
10. Pass Ordinance No. 0-2022-14, An Ordinance Amending City of Wheaton Ordinance Nos. E-3843, F-1067, and 0-2021-03 “An Ordinance Amending the Wheaton Zoning Map and Granting a Special Use Permit for a Planned Unit Development on a Certain Piece of Property Commonly known as Morgan's Orchard Lake Subdivision” Councilwoman Fitch moved and Councilwoman Robbins seconded that Ordinance No. 0-2022-14, An Ordinance Amending City of Wheaton Ordinance Nos. E-3843, F-1067, and 0-2021-03 “An Ordinance Amending the Wheaton Zoning Map and Granting a Special Use Permit for a Planned Unit Development on a Certain Piece of Property Commonly known as Morgan's Orchard Lake Subdivision", be passed.
City Manager Dzugan stated the requested amendment to the existing PUD includes the increase of single family lots from 10 to 11. He detailed an additional lot was formed following the demolition of a single-family structure. He stated a public hearing is not required as the amendment, although major, remains in conformity with the approved PUD. City Manager Dzugan noted property owners within 250 feet were notified and to date no comments have been received. He also highlighted had the property not been part of the PUD, the subdividing of the lot into two lots without variation would only require City Council approval without a Public Hearing.
Councilman Weller detailed had the lots not in been in a PUD, they would still far exceed minimum lot size requirements for the zoning district in which they are in.

Gary Avenue - GMX Real Estate Group, LLC
Councilman Barbier moved and Councilwoman Bray-Parker seconded to receive Planning & Zoning Board Report Re: ZA #22-05/Planned Unit Development/ 2031 N. Gary Avenue/ GMX Real Estate Group.
City Manager Dzugan noted the report recommended unanimous approval of the Special Use Permit along with seven conditions specified in the attached ordinance as recommended by the Planning and Zoning Board.

Councilman Barbier expressed his support of the proposed use. He detailed that his support is reinforced by the importance of supporting investors throughout their business cycles in effort to minimize risks or uncertainties associated with investment in Wheaton.
Councilwoman Fitch expressed concern regarding the proposed use. She referenced the Wheaton Zoning Ordinance and pointed out the lack of public benefit, and two specific standards applicable to Special Use Permits; standard two which states the use shall not be injurious to the uses and enjoyment of other property in the immediate vicinity for the purposes already permitted and standard three which states the special use shall not impede the normal and orderly development and improvement of the surrounding property for uses already permitted. She stated there is potential for residential redevelopment and additional annexations in this area and stated approval for a mega gas station will alter characteristics of the area.
Mayor Suess expressed support of the proposed use of the property which has been on the market for an extended amount of time. Mayor Suess detailed the use does not impact the surrounding environment as the nearest residential property is more than 1000 feet away.

12. First Reading of An Ordinance Amending Chapter 30 "Fire Prevention and Protection” Section 30-2 and Chapter 70 “Traffic and Vehicles” Sections 70-148, 70-387 and 70-517 of the Code of Ordinances, City of Wheaton, Illinois - First Reading
City Manager Dzugan stated staff found the need to clarify certain fines within the City Ordinances which were adopted as part of the adjudication ordinance passed in 2021. He stated the ordinance simply clarifies fines and will not increase them.
13. Council Comment
Mayor Suess highlighted the City of Wheaton Newsletter which provides an overview of events and news in the City.
14. Approval of Warrants
Councilwoman Fitch moved and Councilman Barbier seconded that Warrant No. 821 in the amount of $745,076.82 be approved.
