Mayor Suess presented Certificates of Excellence to the following 2022 National Merit Finalists: Linnea Barron and Joshua Nigrelli (Wheaton Warrenville South High School), Daniel Janiak (Wheaton North High School) Katherine Fulton (Benet Academy), and Jeremy Kang (Wheaton Academy). Marguerite Larson (Wheaton North High School) was not present.
3. Citizens to be Heard
Mr. Ronald Almiron, 455 W. Front Street, addressed the City Council and staff regarding City Hall facilities.
4. Consent Agenda
Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on the Consent Agenda items:
Approve the minutes of the March 28, 2022 Wheaton City Council Public Hearing and the April 4, 2022 Wheaton City Council Regular Meeting as submitted.

5. Pass Ordinance No. 0-2022-16, An Ordinance Amending Chapter 30 "Fire Prevention and Protection” Section 30-2 and Chapter 70 “Traffic and Vehicles” Sections 70-148, 70-387 and 70-517 of the Code of Ordinances, City of Wheaton, Illinois
Councilwoman Bray-Parker moved and Councilman Weller seconded that Ordinance No. O-2022-16, An Ordinance Amending Chapter 30 “Fire Prevention and Protection” Section 30-2 and Chapter 70 “Traffic and Vehicles” Sections 70-148, 70-387 and 70-517 of the Code of Ordinances, City of Wheaton, Illinois, be passed.
City Manager Dzugan stated the ordinance, which had a first reading on April 4th, aligns certain fines which were adopted as part of the adjudication ordinance in 2021 with other sections of the City Code. He confirmed there are no increases.

6. Pass Ordinance No. 0-2022-17, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois
Councilwoman Bray-Parker moved and Councilman Barbier seconded that Ordinance No. O-2022-17, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois, be passed.
City Manager Dzugan stated the ordinance, which had a first reading on April 4th, amends pay schedules for the 2022-2023 year for staff positions not included in collective bargaining units to keep pay scales competitive.

7. Adopt Resolution R-2022-29, A Resolution Authorizing the Purchase of Crack Sealing and Seal Coating Services from SKC Construction, Inc Through the Joint Purchasing Program with the Village of Woodridge for a Total Amount Not to Exceed $85,150
Councilwoman Robbins moved and Councilman Barbier seconded that Resolution R-2022-29, A Resolution Authorizing the Purchase of Crack Sealing and Seal Coating Services from SKC Construction, Inc Through the Joint Purchasing Program with the Village of Woodridge for a Total Amount Not to Exceed $85,150, be adopted.
City Manager Dzugan stated three bids were received through a joint purchasing program with several other municipalities for crack sealing and seal coating services which will be applied to high traffic roads paved in 2019 and 2020.

Councilman Barbier moved and Councilwoman Bray-Parker seconded that Ordinance No. 0-2022-18, An Ordinance Amending Ordinance F-1895, “An Ordinance Granting Planned Unit Development Approval to Allow the Construction and Use of a 130,579 Square Foot Self Storage Facility Located at 1830 East Roosevelt Road - ROC 1830 Roosevelt LLC”, be passed.
City Manager Dzugan stated the applicant seeks to change the color around the entrance to match their national branding. He stated although staff interprets this as a major change, it is in conformity with the original PUD and therefore does not require a public hearing.

Councilman Barbier recused himself at 7:15 p.m. from the discussion and voice vote on Regular Business Item No. 3, Intergovernmental Notification and Comment Form – Dupage County Zoning Petition Zoning – 2022-000015 due to a potential conflict of interest.
9. Council moved to postpone Intergovernmental Notification and Comment Form - DuPage County Zoning Petition Zoning - 2022-000015 to a date certain of May 16, 2022.

City Manager Dzugan stated a request from the applicant was received to defer action for thirty days to allow AT&T to discuss details with the Wheaton Sanitary District.
The motion was approved by a unanimous voice vote.
Councilman Barbier rejoined the meeting at 7:16 p.m.
10. Receive Planning & Zoning Board Report ZA#22-10/ Corner Side Yard Setback Variation/ 1603 W. York Lane/ Stahr and Pass Ordinance No. 0-2022-19, An Ordinance Granting a Corner Side Yard Setback Variation on a Certain Piece of Property Commonly known as 1603 W. York Lane - Stahr
Councilwoman Robbins moved and Councilman Weller seconded to receive Planning & Zoning Board Report Re: ZA#22-10/ Corner Side Yard Setback Variation/ 1603 W. York Lane/ Stahr.
City Manager Dzugan stated the Planning & Zoning Board unanimously recommended approval of a request for the use of a second-floor addition with a corner side yard setback of 19.56 feet in lieu of the required 26.45 in the board report. He noted the variation created was a result of the City's setback averaging.

11. Adopt Resolution R-2022-30, A Resolution Authorizing the Execution of an Intergovernmental Agreement Between the City of Wheaton and Milton Township for the Purchase of Fuel
Councilwoman Robbins moved and Councilman Barbier seconded that Resolution R-2022-30, A Resolution Authorizing the Execution of an Intergovernmental Agreement Between the City of Wheaton and Milton Township for the Purchase of Fuel, be adopted.
City Manager Dzugan noted the two following items are Intergovernmental Agreements permitting Milton Township and District 200 to use the City's fueling facilities. He stated the Township is a new agreement with 3 to 4 vehicles. He confirmed District 200 had an agreement from 1977 in need of updates.
In response to Councilman Barbier, City Manager Dzugan confirmed the additional service fee of .10 per gallon covers clean up, maintenance and key fobs related to the use of the City's fuel facilities.

13. Adopt Resolution R-2022-32, A Resolution Supporting the Necessity and Benefits of Projects Submitted by the City of Wheaton for Community Project Funding
Councilman Weller moved and Councilwoman Bray-Parker seconded that Resolution R-2022-32, A Resolution Supporting the Necessity and Benefits of Projects Submitted by the City of Wheaton for Community Project Funding, be adopted.
City Manager Dzugan noted the resolution seeks the Council's support to request grant funding from the Federal Community Project Funding Opportunity, provided though Representative Sean Casten's office for five City projects.
In response to Councilwoman Bray-Parker, Grant Coordinator Brandon Kowalke confirmed the deadline was met for project submission to Representative Casten's office by April 18, 2022. He noted Representative Casten's deadline for review and selection for consideration in the Federal 2023 budget is May 29.

14. Council Comment Councilwoman Bray-Parker announced the Environmental Improvement Commission is hosting a Native Plant Sale and Prairie Path Clean up in celebration of Earth Day and directed those interested in volunteering to do so on the City's website.
Mayor Suess congratulated Councilman Brown for finishing in the Boston Marathon with a time of 3 hours and 28 minutes.
15. Approval of Warrants Councilman Barbier moved and Councilwoman Bray-Parker seconded that Warrant No. 822 in the amount of $1,221,493.82 be approved.
