1. Call to Order and Roll Call The regular Wheaton City Council Meeting was called to order at 7:03 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

2. Citizens to be Heard Ms. Michelle Dunlap, 1336 S. Main Street, presented a proposal to the City Council on behalf of the Bicycle Advisory Commission as Co-Chair. She stated the Bicycle Advisory voted unanimously in support of painting a white line, not a dedicated biking lane, on Seminary Avenue between Hale and Washington during the resurfacing project scheduled in 2023. Ms. Dunlap highlighted the proposed line would increase safety by offering a visual for vehicles passing cyclists encouraging the required 3 foot passing distance and may calm traffic speeds.
Mr. John Monino, Milton Township Supervisor along with Mr. Andrew Deitz, Milton Township Programs Coordinator presented a flyer to the Mayor and City Council for Milton Fest. He stated Milton Fest, a community event benefiting the Milton Township Food Pantry, will be held on September 17, 2022 from 2 p.m. to 10 p.m. at the DuPage County Fairgrounds.
Mr. Doug Gilmour, 413 Westwood Drive, appealed to the Mayor and City Council to adjust sidewalk plans by considering resident feedback. He asked the Council to consider changes to City Code specific to Chapter 58, Article II, Sections 58.67 and 58.74.
3. Consent Agenda
Councilman Barbier moved and Councilwoman Bray-Parker seconded that the following action be taken on the Consent Agenda items:
1. Approve the minutes of the Wheaton City Council Regular Meeting - July 18, 2022, as submitted.
2. Pass Ordinance 0-2022-31, An Ordinance Amending Section 70-354 “Restrictions or Prohibitions on Certain Streets and Off-Street Lots” of Division 1, “Generally" of Article IV, “Stopping Standing and Parking" of Chapter 70 “Traffic and Vehicles” of the Wheaton City Code.
3. Approve Bond Waiver, Principal Place of Business and Issue Raffle License to Prairie Star Quilters Guild, Inc.
A request was made by Mayor Suess to remove agenda item 6-B. 2., An Ordinance Amending the Official Motor Vehicle and Traffic Schedules (Chapter 70) for the City of Wheaton from the consent agenda to regular agenda item 7-A. 1.

4. City Council moved to postpone An Ordinance Amending the Official Motor Vehicle and Traffic Schedules (Chapter 70) for the City of Wheaton to a date certain of August 15, 2022 Councilman Barbier moved and Councilman Brown seconded a motion to move An Ordinance Amending the Official Motor Vehicle and Traffic Schedules (Chapter 70) for the City of Wheaton to a date certain of August 15, 2022.
City Manager Dzugan stated the ordinance codifies the geographic area which persons living or working within a certain area are eligible to obtain leases for parking in the city's two parking structures.
Mayor Suess expressed concern regarding the proposed ordinance definitions specific to the classification and definition of commercial lease and how it relates to employee parking and commercial vehicle parking.

Councilman Barbier recused himself at 7:22 p.m. from the discussion and voice vote on Regular Agenda New Business item No. 1, A Resolution Authorizing the Mayor to sign and Directing the City Clerk to Attest to That Certain Intergovernmental Agreement Between the City of Wheaton and the County of Dupage, Illinois for the Dorset Flood Improvement Project, due to a potential conflict of interest.
5. Adopt Resolution R-2022-60, A Resolution Authorizing the Mayor to Sign and Directing the City Clerk to Attest to That Certain Intergovernmental Agreement Between the City of Wheaton and the County of DuPage, Illinois for the Dorset Flood Improvement Project City Manager Dzugan highlighted the city was successful in obtaining a 40% grant through DuPage County to complete the city's first overland flooding capital project along Dorset Park.
Councilwoman Bray-Parker moved and Councilman Weller seconded that Resolution R-2022-60, A Resolution Authorizing the Mayor to sign and Directing the City Clerk to Attest to That Certain Intergovernmental Agreement Between the City of Wheaton and the County of DuPage, Illinois for the Dorset Flood Improvement Project, be adopted.
Mayor Suess expressed appreciation to DuPage County and their Stormwater Committee for their work and commitment for funding of upcoming City of Wheaton projects.

Adopt Resolution R-2022-61, A Resolution Authorizing the Purchase of a Replacement Hydraulic Pipe Boring Machine from Pow-R Mole Sales, LLC For a Total Amount Not to Exceed $24,149.27 City Manager Dzugan detailed the current specific directional drilling machine is 15 years old. He stated five votes are recommended due to city code language that pertains to sole source providers.

8. Pass Ordinance 0-2022-32, An Ordinance Granting a Rezoning and a Special Use Permit for a Planned Unit Development, with Exceptions, to Allow the Construction and Use of a Mixed-Use Building on the Block Bounded by Liberty Drive on the North, Hale Street on the East, Willow Avenue on the South, and Wheaton Avenue on the West - Willow Avenue Apartments, LLC City Manager Dzugan stated the ordinance prepared by the City Attorney as directed by City Council at the July 18, 2022 City Council meeting, grants a rezoning and special use permit for a planned unit development requested by Willow Avenue Apartments, LLC.
City Attorney Knippen detailed updates to item I on page 12 of the proposed ordinance specific to the inclusion of language requiring rededication of the public alley and right-of-way easements back to the city as they existed at the time of vacation and full payment with no interest returned to the developer should the proposed project not be substantially commenced within three years from the date of the ordinance.
City Attorney Knippen additionally proposed the inclusion of language to allow the alley to remain open for public use and access for emergency vehicles between the time of alley vacation and the demolition of surrounding buildings.
Councilman Brown moved and Councilwoman Fitch seconded that Ordinance 0-2022-32, An Ordinance Granting a Rezoning and a Special Use Permit for a Planned Unit Development, with Exceptions, to Allow the Construction and Use of a Mixed-Use Building on the Block Bounded by Liberty Drive on the North, Hale Street on the East, Willow Avenue on the South, and Wheaton Avenue on the West - Willow Avenue Apartments, LLC, as presented with the agenda be amended as proposed by City Attorney Knippen.
Mr. Tom Sumnski, Banner Multifamily, LLC., 300 S. Riverside Plaza, Chicago, stated he was comfortable with the alley remaining open until demolition.

Mr. Ronald Almiron, 455 W. Front Street, called upon City Council to deny the pending Special Use Permit. Mr. Almiron expressed various concerns regarding the proposed development.
Mr. Mike Andrews, 317 S. Hale Avenue, expressed concerns regarding the proposed development and offered various plan revision suggestions and considerations to City Council.
Councilwoman Bray-Parker expressed appreciation for the respectful community dialogue. She thanked City staff for the thoughtful consideration and time put into the preparation of the proposed Ordinance.
Councilman Barbier stated his appreciation for notable ideas that have come from community dialogue. He highlighted an example from Mr. Mike Andrews who suggested repurposing materials for use as a cornerstone of the foundation to incorporate historical significance in new structures.

9. Pass Ordinance 0-2022-33, An Ordinance Vacating a Public Alley Right-of-Way and Abrogating Existing Easements Willow Avenue Apartments LLC City Manager Dzugan stated given the approval of the previous Ordinance, the council is requested to consider vacation of the alley at the fair market value of $250,000. He confirmed per City Code, the item required an affirmative vote of five members of the City Council.
Councilwoman Fitch moved and Councilman Weller seconded that Ordinance 0-2022-33, An Ordinance Vacating a Public Alley Right-of-Way and Abrogating Existing Easements Willow Avenue Apartments LLC, be passed.
Mr. Ronald Almiron, 455 W. Front Street, urged the City Council to use the alley as an opportunity to leverage the developer. He called upon City Council to take careful consideration in the best interest of the City and citizens.
Councilwoman Fitch asked for clarification if a third condition requiring the petitioner to obtain a demolition permit from the City in section 2 of the proposed ordinance would be necessary. City Attorney Knippen confirmed an amendment to the ordinance would be appropriate.

10. Adopt Resolution R-2022-63, A Resolution Authorizing the Execution of an Agreement Between the City of Wheaton and the International Union of Operating Engineers, Local 150 City Manager Dzugan stated the ratified five-year agreement with Operating Engineers Local 150 covers 55 City Public Works employees.
Councilwoman Bray-Parker moved and Councilman Barbier seconded that R-2022-63, A Resolution Authorizing the Execution of an Agreement between the City of Wheaton and the International Union of Operating Engineers, Local 150, be adopted.
Councilman Barbier expressed appreciation to Human Resources Director Holly Schulz and City staff for their efforts to prepare an equitable agreement for the City workforce.

11. First Reading of an Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 2 (Administration), Article V (Boards, Commissions and Committees) City Manager Dzugan stated a draft of the proposed ordinance reflects numerous planning session meetings and was presented to City Council at the July 25 City Council meeting. City Manager Dzugan asked for City Council clarification in regard to Section 2-345, specific to the Planning and Zoning Board and the appointment of a five year term for the Chair.
In response to Councilwoman Bray-Parker, Mayor Suess explained the term limit in the proposed Ordinance is reflective of the request from the Planning and Zoning Commission. He clarified if an individual were appointed as chair their term would change to be reflective of the five-year Chair appointment term.
12. Council Comment Mayor Suess announced the Wheaton Police Department's National Night Out at Memorial Park on August 2, 2022 at 6 p.m. He expressed appreciation to the Illinois Governor and Lieutenant Governor for coming to Wheaton to present a tourist grant program established that benefited Cantigny.
13. Approval of Warrant Councilwoman Fitch moved and Councilman Barbier seconded that Warrant No. 829 in the amount of $1,819,518.36 be approved.
