City of Wheaton City Council Proceedings met Feb. 6.

1. Call to Order and Roll Call
The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

City Manager Dzugan thanked Attorney Jim Knippen for the twenty years of service to the City of Wheaton. Mayor Suess presented Attorney Jim Knippen with a gift on behalf of the City.
3. Report of City Attorney
City Attorney Jim Knippen thanked the City of Wheaton staff and elected officials throughout his years of service.
4. Citizens to be Heard
Erica Nelson, Kay Road, spoke on behalf of the Community Relations Commission and presented updates to the City Council and the Community on upcoming events in 2023.
Brian Henricks, 1531 Creekside Cove, inquired whether the Streams Lakes will be dredged in 2023. City Manager Dzugan reported that staff continues to research and explore the project which remains in the 2023 budget. City Manager Dzugan confirmed further information regarding the Streams Lakes Meander Project will be on the City of Wheaton website when available.
Bill Filippello, 2035 Creekside Drive, detailed concerns pertaining to the Streams Lakes project. Mr. Filippello presented the City Council with information for alternative solutions and vendors.
Ronald Almiron, 455 W. Front Street, thanked City Attorney Jim Knippen for his service to the City of Wheaton.
5. Consent Agenda
Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on the Consent Agenda items:

8. Postpone to February 21, 2023, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 42 (Offenses and Miscellaneous Provisions), Article IV (City Parks)
Councilwoman Fitch moved and Councilwoman Robbins seconded that An Ordinance Amending the Code. of Ordinances of the City of Wheaton Chapter 42 (Offenses and Miscellaneous Provisions), Article IV (City Parks), be postponed to February 21, 2023.
City Manager Dzugan stated the City Council had a first reading on January 17 regarding amendments to Chapter 42 pertaining to city parks. He confirmed that based upon public comments at that meeting changes were made to Section 42-106.3 which would allow organized activities using city parks to permit the study of flora and fauna.
Councilwoman Fitch noted edits need to be made to permit school children to use the parks for various activities with attention to how versus who uses the parks and passive versus active activity use.
Councilman Barbier stated presentation of updated signage reflecting the ordinance is needed.

Councilman Barbier moved and Councilwoman Robbins seconded that O-2023-03, An Ordinance Amending Portions of City of Wheaton Employee Rules and Regulations, be passed.
City Manager Dzugan highlighted based upon changes to federal and state laws the City is required to amend certain provisions of the Employee Manual which relate primarily to the Family Bereavement Act.

City Manager Dzugan detailed the report and recommendation from the Planning and Zoning Board propose the approval of an application from DuPage County to amend an existing special use permit for improvements at the County's Animal Services Building.

Councilman Barbier moved and Councilman Weller seconded that R-2023-04, A Resolution Authorizing the Purchase of One (1) 2023 Ford Truck Chassis from Sutton Ford for a Total Amount Not to Exceed $54,666.86, be adopted.
City Manager Dzugan highlighted the chassis will be purchased directly from the dealer which is extended the same pricing discounts from the Northwest Municipal Conference Cooperative contract which recently expired.

Councilwoman Fitch moved and Councilwoman Robbins seconded that R-2023-06, A Resolution Authorizing the Purchase of Axon In-Squad Cameras from Axon Enterprise, Inc. in Accordance with the Sourcewell Purchasing Cooperative for a Five (5) Year Term and a Total Amount Not to Exceed $216,121.20 ($43,224.24 Annually), be adopted.
City Manager Dzugan detailed the replacement of the in-squad camera system through Axon will integrate body worn camera, License Plate Recognition camera, and in-squad camera systems to the same Axon network.
In response to Mayor Suess, Sergeant Salzmann stated the City owns the hardware and pays for the service. He confirmed the City will continue to be eligible for grant reimbursement annually.

Councilman Brown moved and Councilman Weller seconded to Receive Planning & Zoning Board Report Re: ZA #22-28/ Text Amendment - Definition of Family, Variation Accommodation, and Group Care Homes/ Articles II, V, VII, VIII, IX, X, XI, XII, XIII, XIV, & XIX
City Manager Dzugan stated amendments to the text of the Wheaton Zoning Ordinance and Wheaton City code are a result of the elimination of the Group Care Home Commission. He detailed upon close review of the zoning ordinance, legal recommended several changes to the City's provisions given the Federal Fair Housing Act.

16. First Reading of an Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 26 (Business), Article VI, (Group Care Homes Director Kozik stated the draft ordinance creates an administrative review process through a committee comprised of the director of finance, the director of building and code and the city social worker to replace work previously performed by the Group Home Care Commission. He highlighted the committee would review applications for new Group Care Homes not licensed by another governmental entity. He detailed the ordinance creates an appeal process for licenses that are denied by the administrative review committee.
In response to Mayor Suess Director Kozik stated the City currently has three Group Care Homes licensed by the City and none licensed by another governmental entity.
17. Council Comment
Councilwoman Fitch expressed her admiration and respect for Attorney Knippen and extended congratulations and best wishes in retirement.
Councilwoman Bray-Parker congratulated Attorney Knippen on his retirement and thanked him for his professionalism. She thanked the Wheaton Park District for the Volunteer Mixer honoring their volunteers.
Councilman Barbier thanked Attorney Knippen for his service to the City and reflected upon his enthusiasm and passion.
Mayor Suess thanked Attorney Knippen for his years of service to the City and reflected upon his knowledge, initiative and proactivity.
18. Approval of Warrant
