1. Call to Order and Roll Call

The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

2. Citizens to be Heard

Erica Nelson, 1734 Kay Rd., Chair of the Community Relations Commission updated the Council on the Wheaton Gives Back program. She expressed her gratitude to Wheaton residents for their donations and the Wheaton Park District, Downtown Wheaton Association, and local businesses for their contributions. She thanked Meg Beasley, Community Relations member, for her efforts to cotlect the 2,200 items donated. Ms. Nelson announced Glenette Tilley Turner's 90th birthday celebration hosted by the DuPage County h^istorical Museum on Monday, November 20 from 4:30 pm to 6 pm. She asked the Council to expect to see upcoming dates related to the Commission's Partner Program focus. She thanked the Wheaton Public Library for their continued support.

Bruce Beiersdorf, 766 Ralph Ct., spoke on behalf of the Pioneer Terrace subdivision stating they do not ^ oppose the annexation of ON239 Gary Ave. to be Zoned as R3 residential district property, however they oppose the building of a new parking lot for Cosley Zoo on the property and other R3 residential properties. hle expressed appreciation to the Mayor and Councilmembers for listening to their concerns and stated that efforts have been redirected to the Wheaton Park District Board. He reiterated a personal concern regarding safety as there are no other park district properties catering to young children where the parking lot sits across a street with a 35 mile per hour speed limit.

Peter Sherrill, 130 Fairway Ln., expressed his support for the proposed development at 100 W. Roosevelt Road and asked for the council to support the allowing of additional parking for families with multiple drivers and adequate visitor parking.

Mark Gross, 1221 Daly Rd., expressed his support for the proposed development at 100 W. Roosevelt Road converting office condos to multifamily dwellings. He detailed his support for the adaptive reuse of office space to multifamily conversions.

Michelle Dunlap, 1336 S. Main St., Co-Chair of the Bicyclist and Pedestrian Commission announced a proposal to the Council based upon a community feedback survey, to add Accessible Pedestrian Signals (APS) and pedestrian push buttons to stop light crossings in Wheaton.

3. Consent Agenda

Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on the Consent Agenda items:

1. Approve the minutes of Regular Meeting - October 16, 2023, and Public hlearing - October 23, 2023, as submitted.

2. Pass Ordinance 0-2023-40, An Ordinance Amending the Official Motor Vehicle and Traffic Schedules (Chapter 70) for the City of Wheaton - Brighton Drive.

3. Adopt Resolution R-2023-92, A Resolution Approving People's Resource Center Plat of Consolidation

4. Approve Application for a Class B Liquor License - Light Sum LLC DBA Fuji Ramen & Sushi - 221 W. FrontStreet.

4. Pass Ordinance 0-2023-41, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 2 (Administration)

Councilman Barbier moved and Councilman Brown seconded that 0-2023-41, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 2 (Administration), be passed.

City Manager Dzugan stated the ordinance clarifies the reading of written comments received and requested to be read by the City Clerk at a public meeting.

City Manager Dzugan clarified to resident Erica Nelson, 1734 Kay Rd., the ordinance provides for written comments submitted by an individual not in attendance to be placed in the record of the meeting but not read aloud by the City Clerk.

5. Approve Appointment and Reappointments to City Board and Commissions Mayor Suess moved and Councilman Weller seconded that Abdul Shakoor be appointed to the Commission on Aging, Robert Van Valzah be reappointed to the Bicyclist and Pedestrian Commission and Robert Gudmundson and Mark Plunkett be reappointed to the Planning & Zoning Board all for three-year terms through November 6, 2026.

Mayor Suess thanked reappointed board and commission members for their willingness to continue serving on a board and commission and thanked the newly appointed commission member for their Interest in serving.

6. Adopt Resolution R-2023-93, A Resolution Authorizing the Execution of an Intergovernmental Agreement Between the County of DuPage and the City of Wheaton Relating to Improvements of the DuPage County Health Department Facilities

Councilman Brown moved and Councilwoman Bray-Parker seconded that R-2023-93, A Resolution Authorizing the Execution of an Intergovernmental Agreement Between the County of DuPage and the City of Wheaton Relating to Improvements of the DuPage County Health Department Facilities, be adopted.

City Manager Dzugan stated the Intergovernmental Agreement with DuPage County grants authority for building code review and inspections in accordance with the city's building ordinances, codes, rules and regulations to the County for the newly proposed improvements to the Health Department's facility located on their campus. He detailed this agreement supports an initiative set forth in the Strategic Plan to pursue intergovernmental cooperation, consolidation or service sharing for governmental efficiencies.

City Manager Dzugan stated a Public Hearing was held by the City Council on October 23, 2023, for the annexation of a parcel located on the east side of Gary Ave.

Councilwoman Bray-Parker moved and Councilwoman Robbins seconded that 0-2023-43, An Ordinance Amending the Wheaton Zoning Map on Certain Property Commonly Known as ON239 Gary Avenue - Wheaton Park District, be passed.

City Manager Dzugan detailed the ordinance zones the property annexed as R-3 which is consistent with surrounding properties.

City Manager Dzugan stated the ordinance amends demolition regulations discussed at the October 23, 2023, City Council Planning Session.

10. First Reading of An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 22 (Buildings and Building Regulations) Article XII (Fences and Flagpoles)

City Manager Dzugan stated the ordinance amends the fence ordinance discussed at the October 23, 2023, City Council Planning Session. hle detailed based upon council comment, the use of masonry pillars and associated lighting was clarified.

11. Adopt Resolution R-2023-94, A Resolution Authorizing the Execution of an Agreement Between the City of Wheaton and Wheaton Patrol Chapter #699 Metropolitan Alliance of Police Councilman Brown moved and Councilman Weller seconded that R-2023-94, A Resolution Authorizing the Execution of an Agreement Between the City of Wheaton and Wheaton Patrol Chapter #699 Metropolitan Alliance of Police, be adopted.

City Manager Dzugan expressed his appreciation to the management team and union teams for their collaborative work on the collective bargaining agreement with MAP 699 for Patrol Officers.

13. Adopt Resolution R-2023-96, A Resolution Authorizing the Execution of Agreement No. 422 with AMS Industries, Inc. for the Replacement of the Reber Street Pump Station Generator for a Total Amount Not to Exceed $558,360 and a 10% Contingency

Councilwoman Robbins moved and Councilman Brown seconded that R-2023-96, A Resolution Authorizing the Execution of Agreement No. 422 with AMS Industries, Inc. for the Replacement of the Reber Street Pump Station Generator for a Total Amount Not to Exceed $558,360 and a 10% Contingency, be adopted.

City Manager Dzugan stated two bids were received for the replacement of the generator, underground fuel storagetankandautomatictransferswitchforthe ReberStreetwaterpumpstationwhich hedetailed is a critical piece of equipment to maintain water pressure on a portion ofthe City's water distribution system.

In response to Councilman Barbier, City Manager Dzugan stated the 10% contingency was included in accordance with the City's Procurement Policy passed recently by the City Council in consideration of unforeseen conditions or change orders.

Councilman Brown moved and Councilwoman Robbins seconded that R-2023-97, A Resolution Authorizing the Purchase of One (1) 2024 Bobcat Skid Steer Loader from Atlas Bobcat in Accordance with the Sourcewell Purchasing Cooperative for a Total Amount Not to Exceed $46,814.71, be adopted.

City Manager Dzugan stated the purchase of the skid steer loader will be $16,000 under budget resulting from a trade in.

Adopt Resolution R-2023-98, A Resolution Authorizing the Execution of a Memorandum of Understanding Between the City of Wheaton and the County of DuPage, Illinois Designating the County as the Responsible Entity for an Environmental Review of the Wheaton Library's Proposed West Plaza Replacement Project

Councilwoman Bray-Parker moved and Councilman Brown seconded that R-2023-98, A Resolution Authorizing the Execution of a Memorandum of Understanding Between the City of Wheaton and the County of DuPage, lllinois Designating the County as the Responsible Entity for an Environmental Review ofthe Wheaton Library's Proposed West Plaza Replacement Project, be adopted.

City Manager Dzugan stated the Intergovernmental agreement with DuPage County for the County to complete the environmental review ofthe Library Plaza Project funded by a grant managed by HUD. He detailed HUD identified to the City that the County is the agency to complete the review.

16. Receive Report ZA # 23-15/ Rezoning & PUD/ 100 W. Roosevelt Road/ Wise Capital Fund Chicago 1LLC

Councilwoman Robbins moved and Councilman Weller seconded that Planning and Zoning Board Report Re: Receive Report ZA # 23-15/ Rezoning & PUD/ 100 W. Roosevelt Road/ Wise Capital Fund Chicago 1 LLC, be received.

City Manager Dzugan stated the Planning and Zoning Board report recommended approval ofthe Planned Unit Development with the inclusion of exceptions on the conversion of an office condo building to 16 dwelling units at the southwest corner of Main and Roosevelt Roads. He detailed exceptions to the perimeter landscaping, usable open space for individual dwelling units, screening of HVAC units and further review of the preliminary engineering plan were outlined in the report. He stated staff further recommended Council to consider a requirement to eliminate an additional 28 parking spaces above what is required by ordinance and convert it to green space mitigating the open space variation for each dwelling unit.

Mike Mallon, Wheaton resident, spoke on behalf of the petitioner for the property located at 100 W. Roosevelt Rd. He stated revisions were made to the original overall plan based upon feedback from the initial meeting with the Planning and Zoning Board. He stated parking had been reduced from 80 to 64 spaces, the southern perimeter of parking area was increased from 15' to 30', and an easement was granted to improve pedestrian and bicycle crossing at Roosevelt and Main. He stated a market study was conducted, floor plans were revised and flood plain and engineering issues were addressed. He detailed the desire to meet and exceed all requirements. He stated 1.3 cars per bedroom is necessary and a further reduction in parking makes the project economically unfeasible and stated the developer is prepared to walk away.

Mayor Suess stated if the developer is not prepared to reduce parking, then it is the consensus of council not to proceed further.

Mr. Mallon stated the additional costs to reduce the parking will make the project uneconomical and asked the council to support their Planning and Zoning Board's 5 to 1 approval of the project.

Councilman Brown expressed disappointment in the owner and architect for not attending. He confirmed he would be a no vote even with the reduced parking as the project misses the spirit of the Roosevelt corridor and information in economic model seems too thin. \-\e further stated the target audience for this type of development is ambiguous and believes it is not a positive project for the City.

Mr. Mallon expressed disappointment as he feels the proposed project is an excellent redevelopment and would appreciate the council reconsidering their position.

17. Council Comment

Councilman Barbier expressed gratitude to the Warrenville Park District for their Halloween Fest. He stated the Downtown Wheaton Association's Trick-or-Treat event was well attended and noted difficulty navigating through downtown sidewalks with strollers due to the reduced minimum walkway widths especially on the west side of Hale.   

Mayor Suess invited the community to celebrate Veterans Day by attending the Veteran's Day Ceremony hosted by the American Legion Post #76 in Memorial Park on Saturday, November 11, 2023, at 10:45 a.m.
