City of Wheaton City Council met May 6

Here are the minutes provided by the council:

1. Call to Order and Roll Call 

The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were:

2. Presentations 

Mayor Suess read and presented the Wheaton Historic Preservation Month Proclamation to Louise Ferrebee, Chair of the Historic Commission. Louise reported the Wheaton Historic Commission has  distributed 150 signs this week for display at historic properties. She detailed the signs are complete with QR codes that direct users to the City website which contains detailed information about each home. Louise reported there are 20 permanent historic markers throughout the City which exhibit Wheaton’s  rich history.

4. Consent Agenda 

Councilman Barbier moved and Councilman Weller seconded that the following action be taken on the  Consent Agenda item: 

1. Approve the minutes of Wheaton City Council Regular Meeting – April 15, 2024, as submitted.

2. Approve the minutes of Wheaton City Council Public Hearing – April 22, 2024, as submitted. 

3. Pass Ordinance O-2024-14, An Ordinance Amending the Official Motor Vehicle and Traffic Schedules (Chapter 70) for the City of Wheaton - Lowell Reduced Speed School Zone.  

4. Approve an Application for a Class B Liquor License – Mra Kitchen, LLC – 226 W. Front Street.  

5. Approve an Application for a Class A Liquor License – Sabores Chingones 1 LLC d/b/a Sweetchilango 133 W. Front Street.  

6. Approve an Application for a Class S Liquor License – Munddhrimaa Krupa Corp d/b/a 7-Eleven  #30137F 625 W. Roosevelt Road.  

7. Adopt Resolution R-2024-38, A Resolution Approving the Final Plat of Subdivision for Ahiska Subdivision.

5. Approve Appointment to City Commission and Reappointment to City Board Mayor Suess moved and Councilman Clousing seconded that David Wesolowicz be appointed to the Band Commission and Anne Wanzenberg be reappointed to the Board of Police and Fire Commissioners for three-year terms through May 6, 2027.

6. Adopt Resolution R-2024-39, A Resolution Accepting the Transfer of Certain Private Water Mains within the Briarcliffe Lakes Condominium Manor Homes to the City of Wheaton Councilwoman Robbins moved and Councilman Weller seconded that R-2024-39, A Resolution Accepting the Transfer of Certain Private Water Mains within the Briarcliffe Lakes Condominium Manor Homes to the City of Wheaton, be adopted. 

City Manager Dzugan noted city code permits the transfer of certain private utilities to the City. He stated that Briarcliffe Lakes petitioned the City to transfer their private water main system and has met all requirements to allow the transfer of ownership to the City.

7. Pass Ordinance O-2024-15, An Ordinance Authorizing the Signing of an Annexation Agreement 2015 N. Stoddard Avenue – Levon 

Councilman Barbier moved and Councilwoman Bray-Parker seconded that O-2024-15, An Ordinance  Authorizing the Signing of an Annexation Agreement 2015 N. Stoddard Avenue – Levon, be passed.  

City Manager Dzugan stated a Public Hearing was held by the City Council on April 22, 2024 to consider the terms of the annexation agreement.

Councilman Barbier moved and Councilwoman Bray-Parker seconded that O-2024 16, An Ordinance  Annexing a Certain Property to the City of Wheaton, Illinois 2015 N. Stoddard Avenue - Levon, be passed.

Councilman Barbier moved and Councilwoman Robbins seconded that O-2024-17, An Ordinance Amending the Wheaton Zoning Map on Certain Property Commonly Known as 2015 N. Stoddard Avenue  – Levon, be passed.

10. Adopt Resolution R-2024-40, A Resolution Authorizing the Purchase of One (1) Replacement Street Sweeper from Standard Equipment Company in Accordance with the Sourcewell Purchasing Cooperative for a Total Amount Not to Exceed $258,660 

Councilwoman Robbins moved and Councilwoman Bray-Parker seconded that R-2024-40, A Resolution Authorizing the Purchase of One (1) Replacement Street Sweeper from Standard Equipment Company in Accordance with the Sourcewell Purchasing Cooperative for a Total Amount Not to Exceed $258,660, be adopted. 

City Manager Dzugan reported the current street sweeper is over 10 years old and due for replacement. Roll Call Vote:

11. Adopt Resolution R-2024-41, A Resolution Authorizing the Purchase of LED Streetlight Fixtures from TWG Infrastructure Solutions for a Total Amount Not to Exceed $178,104 Councilwoman Bray-Parker moved and Councilman Barbier seconded that R-2024-41, A Resolution Authorizing the Purchase of LED Streetlight Fixtures from TWG Infrastructure Solutions for a Total Amount Not to Exceed $178,104, be adopted. 

City Manager Dzugan stated two bids were received for the LED streetlight replacement program replacing 164 coach style high pressure sodium fixtures with more efficient LED fixtures. He reported an additional 100 will be completed due to the receipt of a grant in the amount of $115,000 from the US Department of Energy.

12. Pass Ordinance O-2024-18, An Ordinance Amending the Calendar Year 2023 Budget Contained in Ordinance No. O-2022-57 

Councilman Weller moved and Councilman Barbier seconded that O-2024-18, An Ordinance Amending the Calendar Year 2023 Budget Contained in Ordinance No. O-2022-57, be passed. 

City Manager Dzugan stated the ordinance amends the 2023 budget where expenditures exceeded the budgeted amount. He noted the amended amount in the general fund appears high at $5.5 million, however, $5 million of that was due to internal transfers moving excess funds to other funds.

13. First Reading of an Ordinance, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 74 (Utilities) & Appendix B

City Manager Dzugan stated the ordinance amends the City Code by reconstructing the stormwater fee which will now be based upon a parcel’s impervious area and not the amount of water that is consumed. He detailed the calculation methodology change does not increase the amount of revenue being raised.  

Lynn Engel, 111 N. Wheaton Ave., asked for clarification regarding impervious areas. City Manager Dzugan confirmed that sidewalks in front of a building or home are not included in the calculation, however, a roof or patio would be included.  

14. Adopt Resolution R-2024-42, A Resolution Authorizing the Execution of a Service Agreement for  Food and Beverage Concessionaire Services at the Wheaton Public Library Between the City of Wheaton and Awake Wheaton LLC 

Councilman Clousing moved and Councilwoman Bray-Parker seconded that R-2024-42, A Resolution Authorizing the Execution of a Service Agreement for Food and Beverage Concessionaire Services at the Wheaton Public Library Between the City of Wheaton and Awake Wheaton LLC, be adopted. 

City Manager Dzugan stated concluding an RFP process, the library board recommended the approval of Awake Wheaton, LLC to provide food and beverages at the library’s cafe. He detailed the agreement provides for payments of $1000 monthly or 10% of gross revenue, whichever is greater. 

Councilwoman Bray-Parker expressed excitement for the café to be occupied by a vendor again. City Attorney Didier confirmed that the café is expected to be open within the next month.

16. Approval of Warrant 

Councilman Barbier moved and Councilwoman Bray-Parkerseconded that Warrant No. 871 in the amount of $2,918,448.13, be approved.
