Chicago police disciplinary appeals await appellate court ruling

As previously reported by Police Board President Kyle Cooper, the Fraternal Order of Police, representing Chicago police officers below the rank of sergeant, has appealed two rulings from a March 2024 Cook County Circuit Court decision. This decision allows officers to opt for arbitration over a Police Board hearing in serious disciplinary cases.

The appeal is now with the Illinois Appellate Court. The union contests the Circuit Court's decisions that arbitration be public and that officers may face suspension without pay during proceedings. Oral arguments are scheduled for June 17, but a final decision could take several months. An appeal to the Illinois Supreme Court remains possible.

In 2025, four new disciplinary cases have been filed with the Police Board. Of these, three officers have requested arbitration, increasing such requests to 19 cases currently pending before the board. These cases are paused pending a public arbitration process establishment since no hearings can occur without officer consent.

Five other cases proceed as accused officers opted for Police Board hearings instead of awaiting arbitration.
