Newly passed bill authored by State Sen. Robert F. Martwick aims to improve the management of funds and property related to deceased state employees and unclaimed assets, while establishing a licensing framework for finders and enhancing state cooperation, according to the Illinois General Assembly.

In the House, 73 Democrats voted in favor of the bill, while 40 Republicans opposed it.

Meanwhile, in the Senate, 36 Democrats and 19 Republicans voted in favor of the bill.

Martwick introduced the bill in the Illinois Senate on Feb. 5, 2025 during the 104th session.

The legislation, known as SB1667, was passed on May 20, 2025 during the general assembly session 104.

According to the Illinois General Assembly site, the legislature summarized the bill's official text as follows: "Amends the Illinois Trust Code. Requires a trustee to maintain, for a minimum of 7 years after the termination of the trust, a copy of the governing trust instrument under which the trustee was authorized to act at the time the trust terminated. Amends the Revised Uniform Unclaimed Property Act. Provides that property held in an account or plan, including a health savings account, that qualifies for tax deferral under the United States income tax law, is presumed abandoned 20 years after the account was opened. Requires State agencies to report final compensation due a State employee to the Treasurer's Office as unclaimed property if the employee dies while employed. Requires a holder who holds property presumed abandoned to hold the property in trust for the benefit of the State Treasurer on behalf of the owner from and after the date the property is presumed abandoned. Requires that the State Treasurer provide written notice to a State agency and the Governor's Office of Management and Budget of property presumed to be abandoned and allegedly owned by the State agency before it can be escheated to the State's General Revenue Fund if the property remains unclaimed after one year. Creates authority for the Secretary of the Department of Financial and Professional Regulation to order a regulated person under the Act to immediately report and remit property subject to the Act if the Secretary determines that the action is necessary to protect the interest of an owner. Establishes a procedure regulating agreements between an owner or apparent owner and a finder to locate or recover property held by the State Treasurer. Requires a finder to be licensed by the State Treasurer and creates qualifications to be so licensed. Makes definitions. Makes other changes. The Treasurer is authorized to adopt rules as necessary to implement the Act. Effective immediately."

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, the bill amends various aspects of the Illinois State Finance Act and other related statutes to address the handling of funds and property of deceased state employees, abandoned property, and professional regulations for finders. Estates of deceased state employees are entitled to receive accrued benefits with unpaid amounts reported to the state if not settled within a year. The bill mandates trust account establishment for presumed abandoned properties held for the state administrator. It emphasizes cooperation among state bodies to locate property owners and enables the escheatment of unclaimed state agency funds after specific conditions are met. It also establishes a licensing framework for finders—individuals or entities helping reclaim unclaimed property—effective Jan. 1, 2026, including qualifications, fees, and penalties for non-compliance. Additionally, it grants the Secretary of Financial and Professional Regulation authority to demand the immediate reporting of certain properties to protect owners' interests.

The bill was sponsored by Rep. Diane Blair-Sherlock (Democrat-46th District) and Sen. Michael W. Halpin (Democrat-36th District).

Bills in Illinois follow a multi-step legislative process, beginning with introduction in either the House or Senate, followed by committee review, floor debates, and votes in both chambers before reaching the governor for approval or veto. The General Assembly operates on a biennial schedule, and while typically thousands of bills are introduced each session, only a fraction successfully pass through the process to become law.

Martwick, a Democrat, was elected to the Illinois State Senate in 2019 to represent the state's 10th Senate District, replacing previous state senator John G. Mulroe.
