Jesús G. "Chuy" García, U.S. representative for Illinois’s 4th congressional district, said that an ICE officer killed one of "his constituents." He later clarified that the individual was a criminal who fled arrest and struck the officer with a vehicle, prompting the officer to shoot in self-defense. This statement was highlighted by RNC Research on X.
According to the ICE FY 2023 Annual Report, ICE’s Enforcement and Removal Operations (ERO) made 170,590 administrative arrests during Fiscal Year 2023. These arrests included 73,822 noncitizens with a criminal history, with those individuals averaging about four charges or convictions each. This data illustrates that a substantial portion of ICE’s operations involve individuals with criminal records, which contextualizes claims about enforcement encounters.
The report also indicates that among the charges or convictions of noncitizens arrested, there were 33,209 for assault, 7,520 for weapons offenses, 1,713 homicide-related incidents, and 1,655 kidnappings in FY 2023. These numbers reflect the severity and risk profile in many of the enforcement cases ICE handles. Such data supports claims that ICE agents sometimes face dangerous situations, including flight with force or vehicular assaults.
Reporting from TRAC (Transactional Records Access Clearinghouse) shows that as of early September 2025, ICE had 58,766 individuals in detention. About 70.8% of those detained had no criminal convictions. This suggests many detained noncitizens are held for civil immigration violations rather than violent or serious criminal offenses. Critics often cite this kind of data when discussing the balance of ICE enforcement and due process.
