PROPOSED RESOLUTION

TO APPROVE AND ADOPT A FOREST PRESERVE TREE PROTECTION AND PRESERVATION MANUAL

WHEREAS, the Forest Preserves of Cook County (the “Forest Preserves”) received a grant from the U.S. Forest Service Urban and Community Forestry Program via the Morton Arboretum and such grant was used for the development of a tree protection and preservation manual; and

WHEREAS, as one of the largest landowners in Illinois, the Forest Preserves harbors open space which includes a diverse array of tree species that have stood for generations, and represent the ecological history of our region; and

WHEREAS, trees provide ecosystem services such as cleaning the air, controlling soil erosion, and reducing the impacts of flooding; and

WHEREAS, despite the finite nature of this resource, the Forest Preserves also faces constant pressure to add development features which may lead to the harm or destruction of trees if not protected; and

WHEREAS, the Forest Preserves works to protect and manage trees and forests by providing specifications for licenses and construction agreements that require tree and shrub removal to be minimized and compensated for according to the Forest Preserves’ Tree Mitigation Plan approved by the Forest Preserves’ Board of Commissioners (Board Items 07143, 16-0233, and 16-0308); and

WHEREAS, even with these standards and specifications in place, however, construction activities on Forest Preserves lands have not always adequately planned for the protection of trees, resulting in collateral damage to the Forest Preserves’ forests and tree canopy; and

WHEREAS, in recognition of these concerns, the proposed Tree Protection and Preservation Manual details internal measures to protect trees and other vegetation from construction impacts; and

WHEREAS, it is intended that the proposed Tree Protection and Preservation Manual will also apply to external entities and that compliance with such manual will be added as a contract requirement in applicable contracts, and that such manual will serve as a guide when individuals or entities not under contract with the Forest Preserves damage its trees and other vegetation; and

WHEREAS, the proposed Tree Protection and Preservation Manual was developed by a consultant, with input from an advisory working group comprised of representatives from multiple departments and partner organizations; and

WHEREAS, the terms of the grant through which the Tree Protection and Preservation Manual was developed requires recognition by the grantee’s governing body.

NOW, THEREFORE, BE IT RESOLVED, by Toni Preckwinkle, President, and the Forest Preserves of Cook County Board of Commissioners that the Forest Preserves’ Tree Protection and Preservation Manual is hereby adopted by resolution and is effective immediately.

BE IT FURTHER RESOLVED, that the Forest Preserves, at the discretion of the General Superintendent, is hereby authorized to modify such Tree Protection and Preservation Manual based on changes in arboricultural best practices.

PROPOSED INTERGOVERNMENTAL AGREEMENT

Department: Department of Resource Management

Other Part(ies): United States Geological Survey, Urbana, Illinois

Request: Authority for the Forest Preserves of Cook County (the “Forest Preserves”) to enter into an Intergovernmental Agreement with the United States Geological Survey (“USGS”)

Goods or Services: Installation of two (2) precipitation gauges on Forest Preserve properties near the intersections of Cermak Road and Mannheim Road in the Village of Westchester, and Riverview Avenue and South Des Plaines River Road in the City of Des Plaines.

Agreement Number(s): N/A

Agreement Period: Date of Execution - 12/31/2030

Fiscal Impact: None

Accounts: N/A

District(s): 9, 16

Summary: The USGS is proposing to install two (2) precipitation gauges in cooperation with the U.S. Army Corps of Engineers (“USACE”) Lake Michigan Diversion Accounting (“LMDA”) program. Data from the gauges are used along with other hydro-meteorological information to simulate stormwater runoff from the Lake Michigan and Des Plaines River watersheds. The precipitation gauge network is a primary component of the LMDA program to ensure that the USACE is in compliance with a Supreme Court decree regarding diversion of water from Lake Michigan.

The precipitation gauges would be installed on a 3'x5' concrete pad, located at the aforementioned properties. USGS technicians will visit the sites on a monthly basis in order to download data, service the instrumentation, and maintain the area surrounding the pads. The USGS will be responsible for all installation and maintenance costs.

Water-resources data collected by the gauges will be available online to Forest Preserves staff and the public through the public National Water Information System. The data collected can potentially provide the Forest Preserves information for assessing stormwater levels within our region. Under the proposed agreement, the Forest Preserves is waiving its standard fees as well as standard agreement terms such as insurance and indemnification.

In the event of damage to Forest Preserves real property, the Federal Tort Claims Act may apply. Final agreement is subject to legal review and approval.

PROPOSED PREVIOUSLY APPROVED ITEM AMENDMENT

Department: Department of Planning and Development

Request: Authorization to amend a previously approved Board item as it is no longer feasible for the Metropolitan Water Reclamation District of Greater Chicago (“MWRD”) to install a new water line under 1st Avenue to provide service to the Forest Preserves’ Central Garage Compound from the west side of 1st Avenue.

Item Number: 19-0465

Original Text of Item: PROPOSED INTERGOVERNMENTAL AGREEMENT

Department: Department of Planning and Development

Other Part(ies): Metropolitan Water Reclamation District of Greater Chicago (“MWRD”)

Request: Authorize the Forest Preserves of Cook County (the “Forest Preserves”) to enter into an Intergovernmental Agreement with, and convey permanent and temporary easements to, MWRD.

Goods or Services: Construction and maintenance of stormwater conveyance improvements along a portion of 1st Avenue between Roosevelt Road and Cermak Road in Maywood

Agreement Number(s): N/A

Agreement Period: Continuous

Fiscal Impact: Revenue Generating. Estimated compensation $122,000.00 $257,124.00 ($113,180.00 for permanent easement and $10,744.00 for temporary easement and $133,200.00 for tree mitigation)

Accounts: N/A

District(s): 1

Summary: MWRD proposes to construct new stormwater conveyance improvements along 1st Avenue between Roosevelt Road and Cermak Road in Maywood to alleviate chronic flooding conditions affecting access to several hospitals including Loyola University Medical Center. The flood control project includes tree removal prior to installation of new underground storm sewer pipes along the 1st Avenue Cutoff at the south end of Miller Meadow, a new outlet to the Des Plaines River, new storm sewers and on each side of 1st Avenue from Roosevelt Road to Cermak Avenue and a new bioswale and other drainage improvements on the east side of 1st Avenue at Miller Meadow.

MWRD is requesting temporary and permanent easement areas for construction staging and future maintenance of all improvements by the Illinois Department of Transportation (“IDOT”) except for mowing or maintenance of vegetation in a new hybrid bioswale along 1st Avenue that would be maintained by the Forest Preserves. MWRD will make improvements at their sole cost and expense and provide additional benefits to the Forest Preserves by installing new storm conveyance infrastructure to alleviate flooding on Forest Preserve land, and relocating underground pipes to the edge of the Forest Preserves to minimize future tree impacts and installing a new water line under 1st Avenue to provide service to the Forest Preserves Central Garage Compound from the west side of 1st Avenue.

Tree mitigation and other fees will would normally be fully waived for MWRD consistent with a Memorandum of Understanding providing for mutual waiver of fees between MWRD and the Forest Preserves approved by the Forest Preserves’ Board of Commissioners on May 11, 2017. In this case, however, due to the limited benefits to the Forest Preserves, MWRD has agreed to partial waiver of tree mitigation fees for removal of roughly fifty-six (56) trees.

The final agreement is subject to legal review and approval.

REQUEST TO REGISTER BERGMAN SLOUGH AS AN ILLINOIS LAND AND WATER RESERVE

Department: Department of Resource Management

Summary: Requesting authority to submit Bergman Slough for Illinois Land and Water Reserve ("ILWR") registration through the Illinois Nature Preserve Commission (“INPC”).

This registration contributes to one of the key goals set forward in the Next Century Conservation Plan to dedicate 20,000 acres as Illinois Nature Preserves or ILWRs by 2025. Registration of a site as an ILWR provides a high level of protection for land in Illinois and is granted only to natural areas of important ecological quality.

The proposed Bergman Slough ILWR is an approximately 280-acre preserve adjacent to the Village of Palos Park in southwest Cook County. The site consists of a high-quality prairie restoration, wetlands, and a slough. Ecological management of the site began in the 1990s by volunteers and Forest Preserves of Cook County staff, and today the site remains under management by a vibrant volunteer community. The site features beautiful open prairie, a diverse set of wildflowers, and a number of rare grassland bird species.

The Forest Preserves of Cook County (the “Forest Preserves”) currently has twenty-five (25) dedicated Nature Preserves and four (4) registered Land and Water Reserves. The addition of Bergman Slough would establish the Forest Preserves’ 5th ILWR and bring the Forest Preserves’ total INPC protected lands (including all pending registrations) to approximately 10,320 acres.

It is respectfully requested that authority be granted to the Forest Preserves to submit Bergman Slough to the Illinois Nature Preserves Commission for review and formal registration as an Illinois Land and Water Reserve.

Summary: The Forest Preserves has been sub-awarded funds from The Nature Conservancy via the National Fish and Wildlife Foundation’s Save Our Great Lakes Program in support of habitat restoration at Burnham Prairie and the Sand Ridge complex in the Calumet region.

Burnham Prairie, located in the Village of Burnham, contains sand prairie, sedge meadow, and emergent wetlands that provide valuable habitat for marsh birds. The Sand Ridge complex in Calumet City consists of habitat collectively composing the second largest globally rare dune-and-swale remnant in Illinois. Both sites have been the recipients of significant investments in restoration over the past decade.

Restoration activities will include invasive species control across 50 acres at Burnham Prairie, and 300 acres at Sand Ridge Nature Preserve. The primary targets are invasive brush and wetland species such as purple loosestrife and reed-canary grass. This project will bolster previous restoration efforts at these sites to ensure their long term ecological integrity and expand high-quality habitat by preventing the spread of invasive species that threaten to re-invade recovering areas.

The grant sub-award requires the execution of a subrecipient agreement with TNC. Final agreement is subject to legal review and approval.

Total project costs are $360,000.00, of which the Forest Preserves are providing an amount not to exceed $200,000.00 in direct match.

Report Title: Forest Preserves of Cook County Annual Business Diversity Report FY 2019

Report Period: 1/1/2019 - 12/31/2019

Summary: In July 2012, state legislation authorized the Forest Preserves of Cook County (the “Forest Preserves”) to establish provisions to address the underuse of minority and women-owned businesses with respect to procurement contracts. An ordinance establishing the program’s parameters and guidelines was passed by the Forest Preserves of Cook County Board of Commissioners in September 2012. This initiative is significantly benefitting the residents of Cook County by increasing the pool of qualified minority and women-owned businesses that have the opportunity to be selected for contracts awarded by the Forest Preserves each year.

To remedy historic inequity and to facilitate greater inclusion, the Forest Preserves established aspirational contract goals for the participation of minority and women-owned as set forth under the ordinances that comprise the Forest Preserve District of Cook County Municipal Code.

The Minority and Women-Owned Businesses program accomplishments in FY 2019 include awarded contracts achieved 41% minority and women-owned businesses participation; and 43% of contract payments were made to minority and women-owned businesses either as prime contractors or sub-contractors.

The Forest Preserves participated in sixteen (16) outreach and workshop conferences, many in collaboration with various government entities. Also, in 2019, the Forest Preserves, in collaboration with Cook County provided monthly workshops to Minority and Women-Owned Businesses on how to do business with the government.
