City of Wheaton City Council met July 20.

Here is the minutes provided by the council:

1. Call to Order and Roll Call

The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess.

Upon roll call, the following were:

2. Presentation

Mayor Suess presided over a swearing-in ceremony for new police officer Nicole Olsen following remarks by Chief Murphy.

3. Citizens to Be Heard

4. Consent Agenda

Councilman Barbier moved and Councilwoman Bray-Parker seconded that the following action be taken on the Consent Agenda items:

1. Approve the minutes of the July 6, 2020 regular Wheaton City Council meeting as submitted.

2. Pass Ordinance No. O-2020-26, An Ordinance Amending the Official Motor Vehicle and Traffic Schedules (Chapter 70) for the City of Wheaton.

3. Adopt Resolution R-2020-53, A Resolution Authorizing the Disposal of Certain Surplus Property (PD).

5. Pass Ordinance No. O-2020-27, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois

Councilwoman Robbins moved and Councilman Zaruba seconded that Ordinance No. O-2020-27, An Ordinance Amending the Pay Schedules for Officers, Assistants and Employees of the City of Wheaton, Illinois, be passed.

City Manager Dzugan advised the City Council discussed employee pay a couple of times recently. He indicated the proposed ordinance would increase the managerial/professional, department heads and part-time pay scales by 2%.

6. Appointment to City Boards/Commissions

Mayor Suess moved and Councilwoman Fitch seconded that Rachel Bautista be appointed to the Community Relations Commission for a term ending on November 19, 2021 to finish out the remaining term of a former member.

7. Adopt Resolution R-2020-54, A Resolution Petition for the Candidacy of Gwen Henry for the Office of Executive Trustee – Illinois Municipal Retirement Fund Councilman Rutledge moved and Councilman Barbier seconded that Resolution R-2020-54, A Resolution Petition for the Candidacy of Gwen Henry for the Office of Executive Trustee – Illinois Municipal Retirement Fund, be adopted.

Mayor Suess stated Gwen Henry is a former City Council member, a former Wheaton City Mayor and currently serves as the DuPage County Treasurer. He indicated she has served as an executive trustee to the Illinois Municipal Retirement Fund since 2008.

8. Adopt Resolution R-2020-55, A Resolution Authorizing the Execution of a 2nd Amendment to Intergovernmental Agreement Between the Wheaton Sanitary District and the City of Wheaton for the Northside Interceptor Sewer Project

Councilwoman Robbins moved and Councilman Zaruba seconded that Resolution R-2020-55, A Resolution Authorizing the Execution of a 2nd Amendment to Intergovernmental Agreement Between the Wheaton Sanitary District and the City of Wheaton for the Northside Interceptor Sewer Project, be adopted.

City Manager Dzugan advised this second amendment would place the responsibility with the Wheaton Sanitary District for all costs, reporting and administrative duties regarding a grant from the State of Illinois the City sponsored on behalf of the District.

9. Adopt Resolution R-2020-56, A Resolution in Furtherance of the Fair Housing Act Councilwoman Fitch moved and Councilman Barbier seconded that Resolution R-2020-56, A Resolution in Furtherance of the Fair Housing Act, be adopted.

City Manager Dzugan stated the proposed resolution relates to the previous item. He stated as part of the grant procedure, an affirmation furthering the Fair Housing Act is required for not only the grant for the Wheaton Sanitary District, but for future grants the City may seek.

Mayor Suess stated the City of Wheaton was one of the first suburbs to adopt a Fair Housing Act under the term of Mayor Marget Hamilton back in the 1960’s and this is something the City has been responsive to in the past.

10. Adopt Resolution R-2020-57, A Resolution Establishing an Open Data Policy and Directing the City Manager to Establish an Open Data Program and Report on the Progress of the Program Councilwoman Fitch moved and Councilwoman Bray-Parker seconded that Resolution R-2020-57, A Resolution Establishing an Open Data Policy and Directing the City Manager to Establish an Open Data Program and Report on the Progress of the Program, be adopted.

City Manager Dzugan stated the proposed resolution follows a presentation made to the Council at last week’s Planning Session and provides for an open data portal being available on the City’s website.

11. Adopt Resolution R-2020-58, A Resolution Authorizing the Execution of Agreement No. 136 with Thyssenkrupp Elevators for Elevator Preventative Maintenance and Repairs for a Two-Year Term and a Total Amount Not to Exceed $37,324 (Year 1 - $17,298, Year 2 - $20,026)

Councilman Barbier moved and Councilwoman Robbins seconded that Resolution R-2020-58, A Resolution Authorizing the Execution of Agreement No. 136 with Thyssenkrupp Elevators for Elevator Preventative Maintenance and Repairs for a Two-Year Term and a Total Amount Not to Exceed $37,324 (Year 1 - $17,298, Year 2 - $20,026), be adopted.

City Manager Dzugan stated the City received three bids for this project with Thyssenkrupp Elevators submitting the lowest bid.

In response to Councilman Barbier, City Manager Dzugan stated the company would also respond to calls for repair.

Councilman Rutledge moved and Councilwoman Fitch seconded that Warrant No. 780 in the amount of $2,913,027.39, be approved.

Councilwoman Bray-Parker moved and Councilwoman Robbins seconded that the Wheaton City Council adjourn to closed session at 7:18 p.m. for the purposed of discussing Collective Bargaining – 5 ILCS 120/2 (c) (2).
