Village of Cherry Valley Board of Trustees met Oct. 20.

President Jim E. Claeyssen Called The Village Board Meeting To Order At 7:00 Pm And Led The Pledge Of Allegiance.

A roll call was taken by Village Clerk Kathy Trimble:

Also present: Attorney Jim Stevens, Attorney Roxanne Sosnowski, Treasurer Maureen Gumowski, Interim Police Chief Roy Bethge and Village Clerk Kathy Trimble.

ADOPTION OF THE AGENDA:

Trustee Schroeder moved to adopt the agenda. Trustee O’Hara seconded. All “Aye;” none opposed. Motion carried by voice vote.

APPROVAL OF THE VILLAGE BOARD MINUTES:

• Trustee Hollembeak moved to approve the September 22, 2020 Village Board Minutes.

Trustee O’Hara seconded. Trustee Schroeder expressed his concern over the last sentence of Trustee Belt’s statement. After a lengthy discussion Trustee Belt agreed to redact the fourth sentence of her statement. Motion carried by voice vote with 4 “AYES”, 1 “NAY” and 1 “ABSTAIN”.

• President Claeyssen stated that there is an issue with the October 6, 2020 minutes and they will be placed on the November 2, 2020 Village Board Meeting Agenda for review.

PUBLIC COMMENT: No one has signed up for Public Comment.

TREASURER’S REPORT: No Report.

PRESIDENT’S REPORT:

1. Trustee Hollembeak moved that the Village Board approve Resolution 2020-16; “A Resolution of the Village of Cherry Valley, Illinois Authorizing and Approving A Memorandum of Understanding with The Illinois Fraternal Order of Police”. Trustee O’Hara seconded. Interim Police Chief Bethge explained that in the current contract with the Fraternal Order of Police states that if a Patrol Officer takes a sick day when they are supposed to work and they have overtime, the overtime counts toward regular time not overtime. Since COVID-19 this Resolution allows a Patrol Officer, if they are sick, to earn overtime. This Memorandum expires on 12/31/2020. A roll call vote was taken:

2. Trustee Hollembeak moved that the Village Board approve $250.00 for this year’s Veteran’s Day Remembrance Event from line item 5085A. This event will be held on Saturday November 7, 2020. Trustee Belt seconded. A roll call vote was taken:

3. President Claeyssen stated that the Cherry Valley Historical Society’s Museum at 101 E. State Street will be closing at the end of the year. The Historical Society Board Members have asked the Village Board for suggestions on how to keep the museum open since they are not able to operate it anymore. This will be sent to the October 26, 2020 Committee of the Whole Meeting for further discussion.

ATTORNEY’S REPORT: JIM STEVENS:

Attorney Stevens stated that he is working on various projects for the village. He will be in court on Friday October 23rd regarding the Pierce Case.

ENGINEER’S REPORT: SHERI KOSMOS, C.E.S.

President Claeyssen reported on the updates for Ms. Kosmos this evening.

• The ADA Sidewalk Projects will be starting October 28th weather permitting.

• The Paving of the CherryVale Mall parking lot is being done today.

JEFF FUSTIN – PLANNING AND ZONING COMMISSION:

Trustee Fustin stated that there will be a Special Planning Zoning Meeting on November 4, 2020 at 6:30 PM.

DAVID SCHROEDER – RECREATION BOARD:

Trustee Schroeder stated that our Annual Halloween Parade will take place on Halloween beginning at 4:00 PM at the Tennis Courts and ending at the old School Property. Everyone is welcome to participate, but you have to wear a costume.

ORDINANCE REPORT BY TRUSTEE NANCY BELT:

1. Trustee Belt moved that the Village Board consider this the second and final reading of “An Ordinance Amending the Code of Ordinances for The Village of Cherry Valley, Illinois, Chapter 6 – Advertising”. Trustee O’Hara seconded. A roll call vote was taken:

2. Trustee Belt moved that the Village Board pass and approve Ordinance 2020-28; “An Ordinance Amending the Code of Ordinances for The Village of Cherry Valley, Illinois, Chapter 6 – Advertising”. Trustee O’Hara seconded. A roll call vote was taken:

3. Trustee Belt moved that the Village Board consider this the second and final reading of “An Ordinance Amending the Code of Ordinances for the Village of Cherry Valley, Illinois, Chapter 22 – Building and Building Regulations, Article IV Self-Contained Portable Toilets”. Trustee Hollembeak seconded. A roll call vote was taken:

4. Trustee Belt moved that the Village Board pass and approve Ordinance 2020-29; “An Ordinance Amending the Code of Ordinances for the Village of Cherry Valley, Illinois, Chapter 22 – Building and Building Regulations, Article IV Self-Contained Portable Toilets”. Trustee Hollembeak seconded. A roll call vote was taken:

FINANCE REPORT BY TRUSTEE JEFF O’HARA:

1. Trustee O’Hara moved that the Village Board approve the bills reviewed and approved by the Budget Director on October 20, 2020 and reviewed and approved by the village trustees present at the October 20, 2020 Village Board Meeting at a total cost of $159,922.93. Trustee Hollembeak seconded. A roll call vote was taken:

2. Trustee O’Hara moved that the Village Board approve the Illinois Municipal League Risk Management Association (IMLRMA) Minimum/Maximum Contribution for Liability Insurance of $163,427.76 for 2021 and to authorize President Jim E. Claeyssen and Treasurer Maureen Gumowski to sign the Agreement. This will be from line item 5110 Administration. (There was not an increase in the annual renewal contribution again this year). Trustee Hollembeak seconded. A roll call vote was taken:

PLANNING AND DEVELOPMENT REPORT BY TRUSTEE: DAVID SCHROEDER. No Report.

PERSONNEL REPORT BY TRUSTEE: SALLY HOLLEMBEAK.

1. Trustee Hollembeak moved that the Village Board approve the Blue Cross/Blue Shield Health Care Plans Medical HSA RPEQ1Z0720 and PPO RPPC2423 for the upcoming enrollment period of 2020-2021 for the Village of Cherry Valley. Trustee Alsbury seconded. A roll call vote was taken:

2. Trustee Hollembeak moved that the Village Board approve the Group Dental Insurance Plan with Delta Dental – Option 1, for the upcoming enrollment period of 2020-2021 for the Village of Cherry Valley. Trustee O’Hara seconded. A roll call vote was taken:

3. Trustee Hollembeak moved that the Village Board approve a voluntary employee funded optional vision program, Delta Vision Care – Option 1, for the upcoming enrollment period of 2020-2021 for the Village of Cherry Valley. Trustee O’Hara seconded. A roll call vote was taken:

4. Trustee Hollembeak moved that the Village Board approve the hiring of a new Patrol Officer (to fill a vacancy within the Police Department), a Lateral Hire Step 1 position, at a starting salary of $56,867.00 pending approval of all pre-employment requirements. Trustee Fustin seconded. A roll call vote was taken:

5. Trustee Hollembeak moved that the Village Board approve hiring Mr. Larry Gray as a Seasonal Snow Plow Driver for the Village of Cherry Valley at an hourly rate of $20 per hour for the 2020-2021 Winter Season. Trustee O’Hara seconded. A roll call vote was taken:

Trustee Hollembeak stated that PERSONNEL passes.

EXECUTIVE SESSION:

President Claeyssen entertained a motion that the Village Board go into Executive Session for the following:

(5 ILCS 120/2) (C)(1) (Personnel Matters) The appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body or legal counsel for the public body, including hearing testimony on a complaint lodged against an employee of the public body or against legal counsel for the public body to determine its validity. Trustee Hollembeak moved that the Village Board go into Executive Session at 7:30 PM. Trustee Belt seconded. A roll call vote was taken:

Motion carried 6-0.

Let the record show that Interim Chief Roy Bethge, Treasurer Maureen Gumowski and Village Clerk Kathy Trimble were excused from the remainder of the meeting. Attorney Jim Stevens will be taking the Executive Session Minutes.

The Village Board was in Executive Session from 7:30 PM to 7:55 PM.

RECONVENE TO OPEN SESSION:

President Claeyssen called the Village Board back into Open Session at 7:55 PM.
