Village of Cherry Valley Village Board of Trustees met March 2.

President Jim E. Claeyssen Called The Village Board Meeting To Order At 7:02 Pm And Led The Pledge Of Allegiance.

A Roll Call Was Taken By Village Clerk Kathy Trimble:

Also present: Attorney Jim Stevens, Sergeant Jesse Pearse, Patrol Officer Robert Harris III, Village Treasurer Maureen Gumowski, Village Clerk Kathy Trimble.

Adoption Of The Agenda:

Trustee Schroeder moved to adopt the agenda. Trustee Hollembeak seconded. All “Aye;” none opposed. Motion carried by voice vote.

Approval Of The Village Board Minutes:

Trustee O’Hara moved to approve the February 16, 2021 Village Board Meeting Minutes. Trustee Belt seconded. All “Aye;” none opposed. Motion carried by voice vote.

Public Comment: None.

Treasurer’s Report:

Treasurer Gumowski stated that revenues in the General Fund of $366,000 were lower than expenditures of $384,000 by $18,000. Expenditures were mainly Salary & Benefits ($251,000), Legal Services ($22,000), Deicer Salt ($21,000), Guardrail Repair ($13,000) which was reimbursed by Insurance. Revenues of $62,000 were higher than expenditures of $53,000 in the Water Fund by $9,000. Expenditures were mainly Salary & Benefits ($28,000) Contingency; Blacktop Paving NW side of CherryVale Mall ($3,000). In the Capital Improvements Fund, revenues of $158,000 were higher than expenditures of $48,000 by $110,000. Expenditures were mainly the Mobotrex Battery Backup Units ($44,000). Trustee O’Hara moved to have the February 2021 Treasurer’s Report placed on file with the minutes. Trustee Fustin seconded. All “Aye;” none opposed. Motion carried by voice vote.

PRESIDENT’S REPORT:

1. President Claeyssen spoke about a proposal from the Maguire Development Corporation regarding a cell tower installation within the Village of Cherry Valley. The Maguire Development Corporation has approached the Village to see if we would consider leasing them a 40’x40’ area on our Public Works Facilities Grounds for their new location since their tower has been removed between Harrison Ave. and Vandiver Rd. After much discussion the consensus of the Village Board was to continue to talk to Maguire Development Corporation. Attorney Jim Stevens was asked to research fall areas for cell towers for a future meeting.

2. President Claeyssen updated the Village Board on the village’s recent MS4 IEPA Inspection. President Claeyssen has asked Ms. Sheri Kosmos of C.E.S. Inc. to give the village a quote on their cost to help us with the tasks that need to be completed to be in compliance with the IEPA. This information will be available at the Committee of the Whole Meeting on March 8, 2021.

Attorney’s Report: Jim Stevens:

Attorney Stevens stated that he will be filing a motion with the courts for additional Attorney fees in regards to the Jay Pierce Case. Attorney Stevens will keep the village board updated.

Engineer’s Report: Sheri Kosmos, C.E.S. - No Report.

Jeff Fustin – Planning And Zoning Commission:

Trustee Fustin stated that there will not be a March 2021 Meeting.

David Schroeder – Recreation Board:

Trustee Schroeder stated about 32 people attended and skated at the Outdoor Skate Night at Doty Park in Belvidere, IL. The next Recreation Board Meeting will be held tomorrow, Wednesday, March 3, 2021 at 7:00PM to discuss the Easter Candy Scramble and Movie Night. Everyone is welcome to attend.

ORDINANCE REPORT BY TRUSTEE NANCY BELT:

1. Trustee Belt moved that the Village Board consider this the first reading of “An Ordinance Granting Text Amendments to the Code of Ordinances for The Village of Cherry Valley, Illinois Sections 82-281, 82-282, and 82-283 Industrial Districts; Sections 82-181 and 82-182 Agricultural Districts – Special Uses and Section 82-3 Definitions.” (Solar Farms). Trustee O’Hara seconded. All “Aye;” none opposed. Motion carried by voice vote.

2. Trustee Belt moved that the Village Board consider this the first reading of “An Ordinance Amending the Code of Ordinances for The Village of Cherry Valley, Illinois, Chapter 6 – Advertising”. (Sections 6-36, 6-37 and 6-38). (The revised Sign Ordinance). Trustee Hollembeak seconded. All “Aye;” none opposed. Motion carried by voice vote.

Trustee Belt stated that Ordinance passes.

Finance Report By Trustee Jeff O’hara: - No Report.

Public Safety Report By Trustee: Jeff Fustin. No Report.

Public Works Report By Trustee: Jim Alsbury.

1. Trustee Alsbury moved that the Village Board award the bid for the Cherry Valley North Street Maintenance 2021 Improvements to Schroeder Asphalt Services, Inc. Huntley, Illinois, as the lowest responsive bidder, in the amount of $108,927.63. This is from line item 5390 Capital Improvements, from the village’s FY2021-2022 Budget. Trustee Hollembeak seconded. A roll call vote was taken:

Motion carried 6-0

2. Trustee Alsbury moved that the Village Board approve a one-year renewal of the Intergovernmental Agreement (IGA) between the Village of Cherry Valley and the City of Rockford regarding Annual City-Wide Pavement Marking (Paint) beginning March 31, 2021 to March 30, 2022. Trustee Belt seconded. A roll call vote was taken:

Motion carried 6-0

3. Trustee Alsbury moved that the Village Board authorize Public Works Employees Garrett Anderson and Andy Wesseln to attend the Cross-Connection Control Device Inspector Certification Training on September 14 -September 17, 2021 in Rockford, IL at a cost of $1,150.00 ($575.00 each) from line item 5195 Water. Trustee Hollembeak seconded. A roll call vote was taken:

Trustee Alsbury stated that PUBLIC WORKS passes.

Planning And Development Report By Trustee: David Schroeder.

1. Trustee Schroeder moved that the Village Board approve a contract with Melrose Pyrotechnics for the 4th of July Fireworks Show for 2021 at a cost of $11,500.00 from line item 5360 Administration. Trustee Belt seconded. A roll call vote was taken:

4. Trustee Schroeder moved that the Village Board approve a one-year extension of the Melrose Pyrotechnics Fireworks Contract until July 4, 2022 at a cost of $23,000 from line item 5360 Administration. Trustee Hollembeak seconded. A roll call vote was taken:
